Calculating the cost of a claim
When the plaintiff cannot determine the cost of the claim on his own, he has the right to ask the court to do so. If the state fee is not paid, the claim will be abandoned. This means that the court will not consider the application.
The following should not be included in the claim price:
- Court expenses.
- Compensation for moral damage.
- Compensation for a claim for protection of honor, good name or business reputation.
Before filing a statement of claim, the initiator is required to make a calculation of the claims and indicate the cost of the claim. If a discrepancy between the price and the real value (for example, of property) is revealed, then representatives of the judiciary will independently make the necessary calculations.
State duty rates when applying to the Armed Forces of the Russian Federation, courts of general jurisdiction or magistrates

Fixed and “floating” amounts of state duty
The amount of payment of the state fee to the court is determined by the reason for the application - from the application to the claim. It is also influenced by the requirements presented - material or not, and the possibility of assessing them. Therefore, payment can be fixed or non-fixed. The amounts are prescribed for litigation in courts of general jurisdiction, magistrates and arbitration.
In addition to strictly fixed duties, there are also “floating” ones. When applying to a court of general jurisdiction or a magistrate, the applicant himself finds out the amount - in accordance with Article 333.20. If the plaintiff was unable to correctly calculate the price or cannot determine the size, the court indicates it independently, but at the same time leaves your statement of claim without progress with the requirement to eliminate the shortcomings by paying an additional fee to the court.

Cost of claim in statement of claim: meaning
The cost of the claim is the cost of the plaintiff’s claims in monetary terms, in rubles (Part 1 of Article 317 of the Civil Code of the Russian Federation), which the plaintiff asks to recover from the defendant in accordance with his requirements (clause 16 of the information letter of the Presidium of the Supreme Arbitration Court of the Russian Federation dated November 4, 2002 No. 70 ).
This calculated value is an important element of the statement of claim (clause 6, part 2, article 131 of the Civil Procedure Code of the Russian Federation, clause 7, part 2, article 125 of the Arbitration Procedure Code of the Russian Federation). It is determined by the plaintiff taking into account the amount of the penalty (penalty, fine) (Article 333.22 of the Tax Code of the Russian Federation), and in cases determined by law or its incorrect calculation - by the court. The statement of claim does not contain an indication of the price, for example, if the claim:
- non-property nature (on declaring the transaction invalid);
- not subject to assessment;
- on the claim by the heirs of their share of property in the event that the dispute over recognition of the ownership of this property by the court has previously been resolved.
Based on the price of the claim, the amount of state duty payable is calculated.
The consequence of failure to indicate the price of the claim is leaving it without movement. In such cases, the arbitration court invites the plaintiff to present evidence allowing the value of each item claimed to be established.
State duty rates for state registration of civil status acts (marriage, divorce)
