Who has the right to care for a pensioner over 80 years of age?

In accordance with the rules approved by Decree of the Government of the Russian Federation No. 343, a Russian citizen can care for a pensioner over 80 years of age:

  1. A person who has reached the age of majority, does not have an official place of work and has not undergone the registration procedure as an unemployed person with an authorized government agency.
  2. A person who has reached the age of majority and is studying full-time at a secondary or higher educational institution. It does not matter whether he is given a scholarship, since it is not considered income.
  3. Having reached the age of fourteen, provided that he has the consent of his parents (legal representatives), executed in writing.

As for the place of permanent registration (“registration”), it does not play a role. For example, an eighty-year-old person can be registered in Moscow, and the person caring for him can be registered in Tambov. There is no need to live together either. In general, the current legislation does not explain what care for a pensioner over 80 involves: buying food, washing clothes, or just having heart-to-heart conversations in the evenings.

The following groups of persons are prohibited from caring for a pensioner over 80 years of age:

  1. Pensioners (both those who continue to work and those who are not unemployed). This is explained by the fact that a pension is a type of income.
  2. Those who were taken into the Armed Forces of the Russian Federation (RF Armed Forces).
  3. Individual entrepreneurs, even if they temporarily do not make a profit, which is reflected in the reporting documentation.

Thus, the main requirements for someone who wants to apply for registration of care for a pensioner over 80 years of age are the presence of Russian citizenship, classification as able-bodied citizens and the absence of an official place of work.

Experience caring for a pensioner; how to register

  1. Lack of employment and official income. This means that such work is not suitable for working pensioners and individual entrepreneurs.
  2. Residence in the Russian Federation.
  3. Lack of unemployment benefits received into the account. In other words, the applicant for guardianship should not be registered with the employment center.

To complete all questions, it is enough to come to the Pension Fund with a person in need of care or a trusted entity, fill out an application and submit a package of documents. How much do they pay for this?

The money that is transferred by the state for helping the old man is called a compensation payment. Its size is determined by Decree of the President of the Russian Federation No. 175, issued and entered into force in February 2013, and is 1,200 rubles.

The peculiarity of these funds is that they are transferred to the old man, and not to the one who helps him in everyday life. It is important to emphasize that the pensioner is not obliged to give them to his assistant. In other words, you need to take into account that you can receive either 1200 rubles or, for example, 500 rubles or nothing at all - it all depends on the desire of the ward.

It was said a little higher that both one and two old people will receive 1.8 points per year. However, this rule does not apply to compensation payments.

In some constituent entities of the Russian Federation, in particular in regions of Russia that are recognized as the Far North or similar territories, the compensation payment is higher. It increases by the so-called regional coefficient (it corresponds to the regional coefficient used to increase the size of pensions for residents of the mentioned areas). This state of affairs is explained by the fact that people in the Far North and similar territories are forced to live in difficult climatic conditions and, therefore, incur additional costs to maintain a normal standard of living.

And the last thing that should be said regarding the issue of compensation payment is that it is not subject to indexation. This means that its size can be increased solely on the basis of a new decree of the president of our country.

Conditions for assigning compensation payments

The peculiarity of this form of payment is that it is accrued to the ward as an additional payment to the pension, so that he can independently pay his trustee. At the same time, if for persons under 80 years of age a special commission is required to determine the need for patronage, then for persons older than this age or with a Group I disability, a guardian is appointed without examination.

The payment amount is 1,200 rubles/month, regardless of the amount of work done and the age of the person being cared for. There are two exceptions:

  • Registration of guardianship over an incapacitated or partially capable person. In this case, the trustee himself manages payments for caring for the elderly.
  • A situation where benefits are paid to the mother, father or guardian caring for a group I disabled child . In this case, the monthly payment is accrued to the trustee himself and the consent of the ward is not required. The amount of the benefit will be greater than generally accepted - 5,500 rubles.

One of the conditions for granting care pay is that the caregiver must be unemployed. As compensation for the opportunity to accumulate insurance experience in another place, he is annually assigned 1.8 pension points to form an individual pension coefficient (IPC).

At the same time, it is important that the citizen has intervals of other work activities before and after the period of guardianship. Only in this case, the experience of caring for the elderly over 80 years of age (or other pensioners) will be taken into account when forming a pension. The duration of these intervals does not matter - the minimum length of service is 1 day.

Procedure for receiving compensation payment for care

Registration process

The registration process is relatively simple and does not take much time. All that is necessary from you is to obtain the consent of the old man and come with him to any branch of the Pension Fund of the Russian Federation (PF RF). The pensioner will need to sign the consent to leave, and the one who will help him will need to sign a document accruing compensation payments. The length of service will begin to increase from the date of registration of leave.

If the old man is unable to travel with you (for example, due to some serious illness), then there are two ways to solve the problem:

Russians who care for group I disabled people and elderly citizens in need of constant assistance will not have to provide a number of documents to the Pension Fund of the Russian Federation.
