About the procedure for refunding money upon early departure

Government Decree No. 176 of 04/01/2005 approved the rules for receiving compensation for travel to and from a vacation spot. To provide it, certain conditions must be met:

  1. A citizen is a recipient of an old-age or disability insurance pension.
  2. The person claiming compensation lives in areas of the Far North or equivalent to it.
  3. The resting place must be located on Russian territory.
  4. The pensioner must have unemployed status.

This type of compensation is provided once every two years. The count starts from January 1 of the year in which the compensation was made. For example, if the trip took place in April 2014, then the two-year countdown will begin from 01/01/2014. Starting from January 1, 2016, the pensioner will be able to apply for a new trip.

1.General conditions for refund

1.1. The Client has the right to refuse all services provided by the Contractor at any time, subject to payment to the Contractor of the expenses actually incurred by him related to the fulfillment of obligations stipulated by the sanatorium-resort voucher, in the amount of the cost of one bed-day of the Client's voucher (clause 1 of Article 782 of the Civil Code of the Russian Federation, Article 32 of the Law of the Russian Federation “On the Protection of Consumer Rights”);

1.2. Refunds to the Client are not made if it is impossible to perform the service due to the fault of the Client (Article 781 of the Civil Code of the Russian Federation);

1.3. If the Client violates the arrival date agreed with the Contractor, the period of stay in the Sanatorium for days of delay is not extended, the cost of unused days of the tour is not refundable;

1.4. Failure to attend procedures prescribed by a doctor due to the fault of the Client without documented valid reasons is not grounds for a refund;

* if the Client refuses to perform the services provided by the sanatorium-resort package (accommodation, meals, treatment) by the Contractor, the refund is made minus the expenses actually incurred by the Sanatorium, taking into account the amount of bed days used by the Client. If the Client cancels two days before check-in and later than the check-in date, the cost of one bed-day is deducted from the refund amount;

* refunds for unused bed days of the voucher are made in the amount of 100% if the Client refuses the services of the sanatorium for valid reasons, which include: illness of the Client or his relatives, death of a relative, call to work, documented.

* if it is impossible for the Sanatorium to provide the services paid for by the Client, a refund will be made in the amount of 100% minus the cost of the services provided. The impossibility of providing services means a power outage, cold water supply, or force majeure circumstances.

1.6. In case of purchasing a sanatorium-resort voucher not at the Sanatorium (through intermediaries), the return of funds due to the consumer is carried out to the payer (intermediary);

1.7. The cost of the trip is refunded to the person who paid for it. Refunds for the cost of vouchers purchased using budget funds through state or municipal contracts are made to the payer in accordance with the terms of government contracts.

2. List of documents required to make a refund

* application for a refund, drawn up on a standard form, containing bank card/personal account details, full name of the recipient, date of departure indicating the reasons for departure;

* confirmation from the attending physician about contraindications to the procedures;

* receipts for payment of services;

* justification of the valid reasons for refusal (with supporting documents attached).

3. Terms of refund

3.1. Funds for services not provided are returned to the Client within 5 working days from the date of provision of a complete set of documents in accordance with clause 2.1. of this Regulation (Article 31 of the Law of the Russian Federation “On the Protection of Consumer Rights”), by transfer to a bank card, or by issuing cash through the sanatorium cash desk.

3.2. Funds transferred by bank transfer are returned by bank transfer to the details specified in the application.

4. Return procedure

4.1. The senior sales specialist accepts the application, marks it with the date of receipt and, within two working days from the date of receipt of the application, calculates the refunded amount.

4.2. The senior implementation specialist checks the departure date indicated in the application with the actual departure date, which is noted in the application.

4.3. When determining the actual date of arrival/departure of the Client, be guided by the standard check-out/check-in time. Thus, if the application was received after the check-out time, the current day of stay, including paid food services, is not refundable.

The checkout time for treatment vouchers and vacation vouchers is 00:00, the checkout time for accommodation vouchers is 12:00.

4.4. The final refund amount must be approved by the General Director of the sanatorium, taking into account the valid reasons for the refusal, after which the application is submitted to the accounting department for the refund.

4.5.1. To clarify the cost of the treatment completed, the client contacts the Administrator of the medical department.

4.5.2.1. Check with the medical department about the number of procedures the client has undergone.

4.5.3. The administrator of the medical department, within 24 (twenty-four) hours from the receipt of the application, calculates the refund amount; when calculating, it is necessary to take into account the amount for which the consumer used medical services, indicates the refund amount on the application, which is submitted to the manager for signature.

4.5.4. If the client is late for the procedure or missed it without documented valid reasons, no refund will be made.

4.5.5. If the client refuses to receive procedures, or wants to change the appointment time or the procedure itself at least 1 (one) day before the date of the procedure, a 100% refund is made.

5. The procedure for informing clients about the refund procedure

5.1.1. Familiarization of the client with these Regulations when selling a voucher and writing about this on the Client's invoice.

5.1.2. Posting of the Regulations on the sanatorium website.

  • Medical certificate (if the refusal was due to illness); a copy of the written refusal to obtain a visa; and so on, the main thing is written confirmation of the circumstances that have arisen;
  • A copy of the contract for the provision of services;
  • Postal receipt or notification of receipt by the tour operator of the claim;
  • Written statement.

How to correctly write an application for a refund for a trip? A sample application for a refund for a trip can be drawn up arbitrarily, but below is a possible example: [Company, full name of the tour operator] [Full name of the consumer, address and contact phone number] Claim [Date] I entered into an agreement with [company] for the sale of a tourist product [number contract], in accordance with which you assumed the obligation to organize a tourist trip to [country, number of people], travel dates [dates of travel]. But before going to court, you should invite the travel agency to resolve all issues peacefully. If this does not help, you need to proceed according to the following scheme:

  • Prepare a statement of claim for termination of the contract, in which you indicate the requirements, circumstances of the case and evidence. You can also ask for compensation for moral damage (usually up to 10 thousand rubles).
  • Collect all necessary documents. These include: a copy of the statement of claim, an agreement with the travel agency, documents on payment for services, a reservation application, written evidence of contacting the company in pre-trial proceedings, a document confirming the company’s refusal to refund the funds, as well as a calculation of the amount of the claim.
  • Submit your claim and documents to the court. If the amount is 50 thousand rubles or less, the case will be handled by a magistrate; if the cost of the claim is higher, the case will be sent to the district court.

  2. in the Multifunctional Center (MFC);
  3. through the government services portal.

The application must be submitted no later than October 1 of the year preceding the year in which the benefit will be cancelled. For example, to receive compensation in 2021, the application must be submitted before October 2018.

There is no need to reapply for each year. It is submitted once and is valid for all years until the submission of a document on the renewal of social assistance.

An application for renewal of receiving social assistance is submitted in the same manner as an application for compensation.

Who is entitled to a free ticket?

1. Federal level. Based on Art. 6.1. and Art.6.7. Federal Law No. 178-FZ of July 17, 1999 “On State Social Assistance”, vouchers can be provided to:

  • disabled people of all groups, disabled children;
  • disabled war veterans or families of those killed;
  • WWII participants, family members of deceased WWII participants;
  • combat veterans;
  • persons who have the sign “Resident of besieged Leningrad”;
  • victims of radiation, etc.

2. Regional level. Funding for assistance comes from the budget of the constituent entity of the Russian Federation on the basis of a regulatory act of the constituent entity. For example, in Moscow vouchers can be obtained (Moscow Law No. 70 of November 3, 2004):

  • honorary donors of the USSR, Russian Federation;
  • victims of a terrorist attack, their families in case of death;
  • children from large families;
  • labor veterans;
  • pensioners, families consisting of pensioners, etc.

Similar acts have been adopted in almost all regions of the Russian Federation.

3. Departmental level. This means that a certain department or department finances and organizes free referrals for treatment. For example, the Ministry of Defense, the Ministry of Internal Affairs, the Federal Tax Service, etc.

The minimum package of documents to obtain a voucher is:

  • statement;
  • passport, SNILS;
  • certificate in form No. 070/u-04 (issued by a local doctor after a medical examination);
  • a document confirming the status of a beneficiary (pension certificate).

The availability of a voucher must be notified two weeks in advance.

Compensation, amount of deduction

From the moment of submitting an application to replace the social assistance measure with a monetary supplement to the pension, the Pension Fund is given 1 month to review the documents and make a decision.

The package of documents includes:

  • passport;
  • statement;
  • a document confirming the right to receive benefits (pension certificate, disability certificate, certificate of a large family, etc.).

A pensioner can apply for compensation:

  1. on one's own;
  2. through a proxy;
  3. through a social worker (if such services are provided and if there is an agreement between the social protection authority and the pension authority).

Based on Order of the Ministry of Labor and Social Protection No. 849n dated December 15, 2017, financial support per citizen for 2021 was established:

  • for the provision of sanatorium-resort treatment - 127.9 rubles per month;
  • for travel to a holiday destination by intercity transport - 18.2 rubles;
  • for travel by rail to the sanatorium - 101.1 rubles.

These amounts will be accrued in addition to the pension amount every month.

How to return money for a tourist package? detailed instructions

Of course, your unforeseen circumstances will need to be documented. Return of train tickets

Example: you return your ticket one day before departure. In this case, you will only lose commissions and fees from paragraphs. 2–4. The rest of the money will be returned back in the same way you paid (for more details, see the table above).   1. Part of the cost of a reserved seat. If the train leaves more than 8 hours later, nothing is deducted. Cancellation of the tour: is it possible to get all the money back and how to do it?

Only facts are important, for example, instead of 7 days, you rested for 6, or instead of a four-star hotel, you were given a room in a three-star hotel. Hand one of the copies to the company representative, and keep the other one, with the stamp, signature of the person who accepted the document and the date of delivery of the claim.

Provided that the travel agency refuses to stamp and sign, send the application and a copy of the contract by mail, the letter must contain a notification and a description of the attachment. Wait 10 days. During this time, the tour operator must either offer and issue a compensation amount, or notify in writing why it does not consider it appropriate to satisfy your requirements.
