Responsibility for delay of pension to PENSIONER.

It is no secret that older people are one of the most vulnerable groups of the population in Russia. Often they have no other financial support other than pension payments: they are used to pay for bank loans, housing and communal services, large purchases and the whole range of everyday expenses. That’s why it’s so important to receive your pension on time—a delay in payment can seriously complicate the life of an elderly person.

Unfortunately, no one is immune from pension delays today: against the backdrop of the economic crisis, interruptions in payments occur even in the most prosperous areas. That is why it is important to know about the reasons for untimely accruals, as well as about the algorithm of actions - where to go for a pensioner whose pension was not credited to the plastic on time.

Pension delay in 2021

Reasons for delay in pension payment

Let's start with the pension payment schedule. The specific day on which the accrual should occur depends on your place of residence - all necessary data in this regard must be provided by the local representative office of the Pension Fund (hotline telephone number). Before you start worrying about pension delays and calling the relevant authorities, remember: payments may fall on a non-working day or public holiday. In this case, you will be required to accrue your pension earlier than this period.

They are being killed all over the country: three arguments in favor of the fact that postmen should not give away their pensions

Director of the analytical agency "Reference Point" Mikhail Klimarev, arguing that pensioners should use cards and they can be taught this, cites two stories as examples . The first is about how in a game, the essence of which was to optimize fleet maneuvering in the ocean, the optimizing algorithm proposed to sink the slowest ship in the squadron, so that the fleet would have time to reach the point of contact with the enemy, and at the same time the enemy would have no options left with capturing the military property.

To confirm the journalist’s words, political scientist Evgeny Potapov gives several examples of news about how postmen delivering pensions were killed in different parts of Russia . For example, in March 2021, in the Kaliningrad region, they brutally dealt with 49-year-old Tatyana, taking away her bag, which contained about 400 thousand rubles: the killers smashed the woman’s head and pushed her into a drainage ditch. In August 2021, in the Karmaskalinsky district of Bashkiria, a 48-year-old female postman was brutally killed and 900 thousand rubles were stolen from her, while in the Kaluga region 300 thousand rubles were stolen from a 64-year-old woman, and she herself was killed. In November 2021, due to 160 thousand rubles. dealt with a 30-year-old woman in the Khabarovsk Territory; the criminals hid her body in the underground of her own house.

Where to go if your pension payment is delayed?

If one of the above reasons applies to your case, you can begin to act. There is no need to sound the alarm too early: given a number of technical issues, as well as the uncoordinated work of Russian social services, you should contact the relevant authorities 5-7 days from the date of non-payment of the pension, and not earlier. We propose to act according to the simplest scheme:

  • First, get a document from the financial institution stating that the pension was not accrued on the due date. For example, if there was a delay in pension payment to a Sberbank card, immediately visit one of the institution’s branches: bank representatives will be required to provide a report on the transactions made on your account.
  • Also request from the financial institution documentary evidence that the pension was not credited to the card account.
  • Having received the necessary papers at the bank branch, contact the next authority - the Pension Fund.

Fraudsters at the post office

I am a pensioner, every month on the 4th I receive a pension. My pension is brought to my house by the postman. It turned out that I could not receive a pension because I was away. Previously, there were such moments and the next month they brought it to me immediately 2 months in advance, which is what I planned this time too. 06/04/13 the day came to receive the money; they brought me a pension for only one month. I asked the question where was the pension for last month on 05/04/13, to which the postman answered that the money for this month was sent back to the pension fund and they have not yet received it. At that moment, I did not worry and did not suspect anything, since the postman was a pleasant woman whom I had already known for more than 15 years. As usual, they let me sign the statement and gave me some additional papers, as it turned out later they are called one-time receipts. Another month passed, I repeatedly went to the post office and was told that there was no money, then that they couldn’t find me in the statements, then I went to the pension fund, explained the situation and they told me the number of the statement which was the transfer of money from the pension fund to the post office. When I came back to the post office and said the number of the statement, they found it and it turned out that these were new papers that the postman had not brought me before where I signed! It turns out that I was misled and given documents to sign that I signed. I remember exactly that they gave me more documents to sign than usual and the signatures were actually mine, but I only received the money at one time. Tell me what should I do, where should I complain? As I understand it, this is article 159, since they slipped me a statement for 05/04/13 where I put my signature thinking that it was a statement for 06/04/13

Dear Vitaly! If you think that the postman has committed fraudulent acts regarding your pension, simply submit a statement to the police or the prosecutor's office, in which you state everything that you wrote and ask that the perpetrators be prosecuted. Your application will be reviewed and an appropriate legal assessment will be given.

The pensioner can change the method of delivery and receipt of the pension at any time. For example, during the summer period, you can transfer the delivery of your pension to a bank account, deposit account, or to a bank card account opened with a credit institution. To do this, you need to open a bank account and contact the territorial office of the Pension Fund.

If you haven’t transferred your pension to your Sberbank card: what to do and where to go

  1. Find out if they have your application or bank letter to transfer your pension payment into your bank account.
  2. If these documents are available, then present more recent statements received from Sberbank. This is necessary in order to reconcile the data.
  3. If the application and letter are not found, fill it out on the spot, providing bank details.
  4. Find out if the fund made pension transfers at a time when you were not receiving them.
  5. If all transfers were made on time and the details were entered correctly, the Pension Fund is obliged to make a request about their location to the bank. To do this you need to write an application.
  1. The Pension Fund has not accurately formed the payment order. As a result, the payment may be returned.
  2. A letter with bank account details was sent to the Pension Fund with a delay.
  3. A card was issued with data that does not correspond to the open account: a data entry error during the registration process.

What if I couldn’t get my pension on time?

Yanina Yulia 09.27.12 21:01:28 Good afternoon! They called my mother at home and said the following: “Your social card is ready, you will receive it when you come to collect your pension.” Mom doesn’t want to receive a card; she didn’t write an application for a card! Questions: - when she comes to her SB branch and, as I understand from the article, she will be forced to receive a card, what should she say in order to leave a passbook? (You can answer, for example, I’m happy with the savings book.) - be sure to write an application for refusal to receive the card. I don’t understand why she would write a refusal when she didn’t write an application for a card. — Today, is it legal to transfer a pension to a card without the consent of pensioners (mother born in 1943)?

Delivery of pensions is carried out through credit organizations, postal organizations and other organizations engaged in the delivery of pensions (hereinafter referred to as the delivery organization), with which the territorial body of the Pension Fund of the Russian Federation has concluded agreements, the standard forms of which are approved by the Ministry of Labor and Social Protection of the Russian Federation.

What to do if your pension is delayed? Legal advice

  • The name of the authority to which you are filing a complaint;
  • Your data (last name, first name, patronymic, address, telephone number);
  • The essence of your complaint (describe the situation);
  • Your requirements (with references to current legislation);
  • Date of filing the complaint;
  • List of attached documents.
  • Lack of necessary funds in the Pension Fund;
  • Delay of funds due to the fault of the bank (sometimes the transaction to transfer funds may not complete for several days);
  • Incorrectly completed documents (relevant if you are receiving a pension for the first time - perhaps you yourself made a mistake when filling out the forms).

Violation of deadlines for assigning pensions

The fact is that if you are assigned a pension now, and in this case a decision is made and the pension certificate indicates the amount of the pension, then the recalculation according to the certificate will occur as a new recalculation, but I’m not sure that from the date of filing the application. Since it is not the PF’s fault that you demanded a pension based on the available certificates.

The procedure for issuing pensions

Russia has a system through which disabled citizens can receive benefits in the form of pension payments. They are accrued every month, and the amount depends on why the person receives money from the state.

We recommend reading: What subsidies are available to a young family with one child in Bashkiria free of charge?

Citizens of this category receive a pension once a month. At the same time, the exact number is assigned depending on the time frame within which the citizen was able to confirm the status of a disabled person. In this regard, the accrual date may change every year after completing the necessary procedure.

If you brought your pension home, but the pensioner is not at home, what should you do?

If the pensioner knows that on the day he receives his pension at his place of residence, he will be guaranteed to be absent for a valid reason, for example, treatment in a sanatorium or a routine examination in a hospital, then a statement is written in advance and the time is specified when this pension will be awarded to him or he himself He will personally receive it at the post office at his place of residence or in any other place where he will be at that time.

The fact is that if the pensioner was not at home when the postman brought the pension directly to his house, then no one will be concerned about bringing this lost pension home to the pensioner again. The postmen hand over all the money from unpaid pensions back to the post office along with the lists, and now the pensioner himself needs to find some time to go to the nearest post office and receive the pension in person.

Why your pension may not come

Pensioners receive their payments according to a clear schedule. As a rule, every pensioner knows his payment date, most often this is a certain date from the 4th to the 22nd of each month. If the pension arrives through a bank, the dates may be slightly different (then they may arrive even a little earlier than through the mail). When the payment date falls on a weekend or non-working holiday, the pension will arrive on the last working day (and if there are many weekends, then according to a special schedule).

In other words, every pensioner knows when his pension will arrive, up to the day

. Accordingly, if the pension did not arrive on that day, it means something went wrong.

The absence of a pension on the appointed date can be due to a variety of reasons - from the human factor (the postman got sick and there is no one to bring the pension to) to a temporary suspension of pension payments.

Here are the most common reasons why the pension did not arrive on the appointed day:

  • problems with delivering pensions by mail - the postman did not have time to bring the pension or did not show up for work at all, or came when the pensioner was not at home, etc. This problem can be solved simply - you will need to go to the post office and get a pension there (and think about paying it through the bank - if the postman is late too often);
  • problems with crediting the card - the bank did not have time to distribute the money to the accounts (the Pension Fund advances it in advance), the pensioner’s account was blocked or closed, or his details changed. This is also quite simple to decide - you need to either wait or bring new details to the Pension Fund;
  • a pensioner for some reason has lost the right to a pension - temporarily or permanently.

The first two reasons are technical in nature, but the third is much more serious. Not all types of pensions are granted indefinitely and without additional conditions - for some of them, some actions are required from pensioners.

You can lose your right to a pension for various reasons:

  • For a pensioner, someone else received a pension for more than a year by proxy. The law requires that a pensioner receive a pension in person at least once a year or come to an appointment with the Pension Fund;
  • The pensioner has not received a pension for more than 6 months. This only applies to receiving it via mail (you can leave it on the card for longer - without consequences);
  • the pensioner lives abroad and has not “checked in” at the consulate for more than a year. In this case, the payment of the pension is also suspended;
  • a full-time student received a survivor's pension, but he was expelled from the university, he transferred to distance learning, or he turned 23 years old;
  • the person received a social pension (for example, in the absence of sufficient work experience) and got a job. Working pensioners do not receive a social pension;
  • the person received a disability pension and did not undergo re-examination within the prescribed period;
  • if the Pension Fund double-checked the documents and discovered that the person is not actually entitled to a pension (not enough experience or points, documents have been falsified, etc.). This option is very rare.

Accordingly, as soon as a pensioner loses the right to a pension, its payment is suspended or terminated (depending on the situation).

They didn’t bring the pension to the house, who should I call?

In such cases, the question invariably arises: how to get a pension after being away from home for a long time? During the pay period of each month, you can also get a pension even when you have been away from home for several months. But no more than six months - in this case, the payment of the pension will be temporarily suspended. To renew it, you will have to write a corresponding application to the Pension Fund office at your place of residence.

Pension is the only income of most pensioners. The current economic crisis has hit the most financially vulnerable citizens of our state, namely, the hardest. Indeed, in most all cases, state pension benefits are the only monetary income of such citizens. Unfortunately, not all pensioners are able to find a job, continue working and support themselves with their earnings. And although the law prohibits this, many company owners do not like to employ pensioners, preferring younger workers to them. If citizens’ pensions arrive late, problems immediately arise with paying utility bills and purchasing medicines and food.
