General concepts

To receive a pension, you must have an official certificate and other confirmation of the status of “disabled”, obtained during the MSA (Medical and Social Examination). In case of assignment of 3 disability groups (both 1 and 2), a person acquires the right to material support and social benefits.

Existing preferences are designed to support citizens with disabilities financially and in consumer terms. In particular, persons of category 3 can count on benefits and payments in the minimum amount, since the group in question is working. In other words, it is assumed that with group 3 disability a person is able to take care of himself and carry out work activities.

In the Russian Federation, pension payments are calculated according to several options, and the pension consists of funded and insurance. That is, if they have a working (insurance) record, the disabled person is additionally given the specified type of funds.

How a pension is calculated: we analyze formulas and examples

The pension is calculated when, in addition to the minimum amount (social pension), a citizen is entitled to receive additional accruals for length of service, pension points, and so on.

In general, the amount of payments to people with disabilities cannot be lower than the subsistence level - on average 8,540 rubles, therefore, for each part there are allowances, which can be calculated using special formulas (about who is entitled to FSD for a disability pension of group 3 and what basic payments are due to non-working people, read here, and what the federal social supplement may be is described here).

Social

A little earlier we looked at the social pension (SP) and its size - 4215.9 rubles. per month. But in addition to this amount, every disabled person of group 3 has the right to receive a monthly cash payment (UMS) and a set of social services (NSS). EDN = 2022.94 rub. per month, and NSU = 1048.97 rub. per month.

From this we have: SP=SP+EDS+NSU

Let's look at an example of how to calculate it: Ekaterina did not work for a single day: at school, during a physical education lesson, she injured her leg, as a result - a complex hip fracture and disability at the age of 16. She receives a social pension, which is 5973 + 2022.94 + 1048.97 = 9044.91 rubles. per month.

This option of spending federal budget funds in the form of a set of social services seems more profitable to the girl, because a trip to a sanatorium and prescribed medications are much more expensive.

For people who became disabled in childhood, a different minimum pension in the field of social benefits is established - 5973 rubles. per month.

Insurance

If a person has work experience (from 2 days or more), on the basis of Federal Law No. 400-FZ of December 28, 2013 “On insurance pensions in the Russian Federation,” the insurance pension (StP) is calculated according to the formula:

StP = SP*50%+KPB*ZB , where:

  • SP - social pension, payment due to all disabled people of group 3 (4215.9 rubles).
  • KPB – number of pension points.
  • ZB – point value expressed in monetary terms (RUB 78.58).

The CPB depends on how many months the pension recipient worked and what insurance contributions he paid to the bank.

Let's take another example: Elena Ivanovna has group 3 disabled status and worked as a mathematics teacher at school for 15 years. Over the entire period of cooperation with the school, Elena Ivanovna earned 205 pension points.

Now her pension is: 4215.9 * 50% + 205*78.58 = 2107.5+16108.9 = 18216.4 rubles. per month.

State

When forming a state pension, they take into account the size of the fixed social payment and increase it by 100%.

Ivan Petrovich took part in the fighting in Syria. There he suffered complex poisoning, which resulted in partial loss of vision. This brave man is dependent on his wife and two children. His pension is:

Amount of payments for disabled people

However, this pension depends on length of service and is not always enough to meet various needs. Therefore, if necessary, a citizen is provided with social state benefits.

For example, social Disability payments are minimal, constant and subject to indexation. That is, disabled people of group 3 are awarded 4,927 rubles every month. Here you can add a monthly cash payment (MCA), which is different for categories of persons with disabilities. For group 3, the benefit is 2,336 rubles. Thus, in 2021, in total, a person with disabilities assigned to group 3 can receive 7,263 rubles monthly.

Note that children are usually paid more than adults and the standard for them is generally 13,912 rubles. EDV provides an additional 2,919 thousand rubles, that is, the total payment per month for children reaches 16,831 rubles.

In addition, a maximum pension is possible if you have insurance coverage. Then a citizen, if he has dependents, can receive a basic payment in the following order:

The legislative framework

Benefits are provided to persons with disabilities (group 3 and not only) on the basis of legislative acts. First of all, this is the Decree of the Government of the Russian Federation No. 95 “On the procedure and conditions for recognizing a person as disabled.” This document sets out the key aspects of the group's appointment.

Law No. 181-FZ “On social protection of disabled people in the Russian Federation” presents benefits provided for disabled people. Art. 28.1 contains information on monthly payments for citizens with disabilities. And in Art. 17 establishes the rights of this category to receive apartments or rooms. And finally, Art. 20 talks about the employment of persons with disabilities.

Social supplements to pensions for non-working pensioners are determined by law and are of two types. These are federal and regional payments. Can both types of help be installed at the same time? Who is assigned group 3?

Establishing an appropriate status is possible for people with health problems from:

- psyche;

— internal organs;

- eyes, throat, nose, ears, etc.;

— anatomy (meaning the presence of defects requiring surgical intervention).

In addition, group 3 can be given to WWII veterans. In any case, this group is considered working and means that:

- work activity is permitted and considered feasible;

- a disabled person can use mobility aids (for example, a cane) to walk long distances;

— the existing illness does not interfere with normal perception, be it educational material, etc.;

— orientation in time and space is not impaired, communication occurs without intermediaries.

Regulations

The special status of people with disabilities, as well as social guarantees aimed at protecting this category of citizens, is regulated by Federal Law No. 181 , which states that a person with disabilities is a person who has a permanent loss of health due to illness or injury, as a result of which he is provided with a number of guarantees that are aimed not only at material support, but also at social adaptation, as well as the opportunity to realize oneself in different spheres of society.

However, despite the opportunities provided, not every disabled person can take full advantage of them, because the degree of health loss for each of them is different, which is determined by the same disability group and predetermines the list of benefits, as well as working conditions that must be created for a fruitful labor activity.

Disability groups

  • In particular, the first group of disabilities in most cases is not working, since a disabled person not only has permanent damage to the body for the rest of his life, but in most cases he cannot care for himself, not to mention work.

Although in some cases, when certain working conditions are created and assistance is provided, the same wheelchair users may well work on an equal basis with other people - for example, doing mental work.

  • But the second group is already working, because although disabled people require some help, they can still work.

For example, with partial loss of vision, an employee may well engage in physical labor, assembling the same sockets in the workshop, and with loss of hearing or speech, disabled people can be employed in almost any industry, doing both physical and mental labor.

  • The third group of disability assumes that the worker has only partial labor loss, which allows workers to be employed in any industry, but with some restrictions that involve increased workload.

In particular, disabled people are prohibited from being involved in work under hazardous conditions or in night or overtime work on the basis of Article 99 of the Labor Code of the Russian Federation.

Calculation of pensions for disabled people of group 3

In the group under consideration, a person with disabilities is entitled to an early social pension (standard payment). As for calculating pension benefits for the insurance part, standard methods are used here. In general, a disabled person can qualify for full pension benefits.

Calculation of the amount of pension payments

To determine the amount of the pension benefit, factors that are relevant in a particular situation are taken into account, so it will not be possible to indicate a 100% exact amount of the benefit within the framework of this material. We only note that the calculations will be accurate if a minimum insurance pension and a fixed social pension are used.

If a disabled person of group 3 works, regardless of the fact of employment, he is awarded, as noted above, 4,000 rubles (social pension). When assigning an insurance and funded pension, some details play a role.

Funded pension

If a person with disability group 3 has a funded part of their pension, it is added to the insurance one. The benefit is calculated by establishing the amount in the savings account. This figure is then divided by 240 months (this is the norm for 2021). The result should be the amount of the funded pension.

Who is disabled category 3

A citizen who has certain health problems that entail various physical limitations and subsequent loss of work can count on the minimum pension for a disabled person of group 3. A person with a third group disability:

  • Has the ability to serve himself alone, without resorting to the help of strangers (subject to the use of special aids).
  • He is quite capable of moving independently, but his walking speed and the distance he covers without rest are significantly lower and less than those for a relatively healthy person.
  • During the learning process, he needs additional rest, a special regime, and the use of special equipment.
  • During work, he feels the need to reduce the proportion of physical activity.

The size of the pension of a disabled person of the third group is a value that consists of three components:

  • social;
  • insurance (labor);
  • state pension.

Everyone with a category 3 disability is entitled to receive a monthly allowance of about 1,000 rubles. Please note that it is only available to officially unemployed disabled people - when applying, you must show your work book. To receive this benefit, you need to contact the Pension Fund with a corresponding application.

Since a category 3 disabled person can take care of himself independently, he is not entitled to benefits for caring for him. However, a person who takes care of such a citizen during the latter’s illness is entitled to receive payments for temporary loss of work activity. Since the size of the social pension for disabled people of group 3 is small, they are also entitled to a number of benefits:

  • Preferential sanatorium-resort rehabilitation.
  • Free provision of technical devices necessary for rehabilitation, including prosthetic and orthopedic products.
  • 50% discount on housing, utility bills and, if necessary, the purchase of fuel for heating the house.
  • The right to your own living space within one room (see the List of Diseases required for this, approved by the Government).
  • Obtaining land in the first order for individual construction and farming.
  • Creation of conditions in the workplace appropriate to the disabled person’s condition.
  • Annual leave of at least 30 calendar days.
  • Provision by the employer of unpaid leave of 60 calendar days without consequences for a disabled employee at the request of the latter.
  • Work at night, on weekends, and overtime work is possible only with the written consent of the disabled person.
  • Exemption from insurance contributions to funds: compulsory medical insurance, pension, social insurance, employment.
  • Repeated receipt of free vocational education in the direction of the state employment service.
  • Refund of 50% of the insurance amount paid under the MTPL agreement.
  • Citizens who become disabled as a result of the introduction of a harmful vaccine are entitled to receive monthly compensation up to 1,000 rubles.
  • For disabled people since childhood - a refund of 500 rubles per month when paying personal income tax.
  • For citizens who became disabled during military service, a refund of 3,000 rubles per month upon payment of personal income tax.

Category 3 disability involves not only payment to a citizen of a pension, consisting of social, insurance and state parts, but also a number of additional payments and exceptional benefits.

As is known, social payments are subject to periodic indexation. From 2021, the amount of benefits for disabled relatives under the care of pensioners has changed.

In the absence of disability, persons under 80 years of age are assigned:

  1. For one disabled relative – 3,416 rubles.
  2. For two – 4270 rubles.
  3. For three – 5124 rubles.

Citizens over the age of 80 who do not have a disability are entitled to:

  1. For one disabled person – 5978 rubles.
  2. For two – 6832 rubles.
  3. For three – 7686 rubles.
  • One – 4004 rubles;
  • Two – 6443 rubles;

Where should a group 3 disabled person go?

The exact amount of the funded and insurance components of the pension is specified in the Pension Fund of the Russian Federation. The office at the place of residence of the person applying must provide information regarding the registration of a pension and provide information about its amount.

If the holder of group 3 only applies for a social pension, you should visit the social protection authority at your place of residence. Here the status of “disabled person” and the entitlement benefits with benefits will be issued.

Documents required to apply for a pension

The applicant must come to the Pension Fund with:

How is a group 3 disability pension assigned?

Regardless of the conclusion of the medical commission determining the disability group, only citizens of the Russian Federation permanently residing in the country have the right to receive benefits.

To whom is it assigned?

This disability group is given if a person has lost or lost his certain skills, his health has deteriorated and he will not be able to perform his professional duties. He may retain the ability to move and care for himself, but the decision of the medical commission is the basis for assigning a disability pension of group 3, regardless of age. The minimum social benefit in case of complete absence of work experience is 4,491.30 rubles.

Registration procedure

To receive social disability benefits, you will need to collect documents and undergo a medical examination. Stages of registration:

  • obtaining a medical examination report from the ITU;
  • preparation of the necessary documents for the Pension Fund at the place of residence: the application will need to be accompanied by a Russian Federation passport, SNILS, medical examination certificate or disability certificate;
  • submitting an application: at this stage it is necessary to decide on the type of monthly payment and indicate it in the application (it can be social, labor or state).
  • calculation and receipt of monetary compensation.

Pension increase

The benefit amount may change upward during indexation. If you have enough experience, your pension can also be increased. Insurance pensions are indexed by the government from January 1, and social pensions from April 1.

Remuneration for disabled people

Of course, in essence, disabled people are the same workers as all other workers, but since this category has some peculiarities, certain benefits are provided for them at the legislative level.

In particular, remuneration for working disabled people implies a special procedure.

With reduced working hours (shortened work week)

Thus, on the basis of Article 92 of the Labor Code of the Russian Federation for disabled people of groups 1 and 2, the working week is established at 35 hours, therefore, hours in excess of the norm established for them are already overtime work, which is subject to additional payment, even if the hours of work in general will be only 40 hours, which is the norm for all other workers.

That is, a disabled person can work no more than 35 hours a week, while the company is obliged to pay him the full salary for his position.

Although an employee of this category may agree to perform his duties for a longer time, say, 40 hours a week, but on the condition that the additional 5 hours will already be paid as overtime, on the basis of the same Article 152 of the Labor Code of the Russian Federation.

How much do disabled people of group 3 get paid?

Payments to disabled people of group 3 are not limited to pensions; there is also a whole range of monthly payments.

If the totality of these payments is less than the subsistence level in the region, then another additional payment comes into force - the FSD.
Next, we will consider specific examples taking into account the type of pension.

3 disability group working

Unlike a social disability pension, an insurance pension allows a disabled person to receive additional money for dependents (1,600 rubles for each). It is also worth considering the form of receiving a set of social package of services.

All disabled people, regardless of category, are eligible to receive the cash benefits listed below. The size of the pension of a disabled person of group 3 will increase if he complies with all the conditions for their calculation:

  • Monthly cash payments (MCB) are a replacement of benefits in kind with cash. From February 1, 2017 it is 2022.94 rubles. for disabled people of the third category. To receive it, you need to visit the Pension Fund at your place of residence or registration. To submit an application, you need a passport, SNILS, documents indicating the presence of a disability (disability certificate, conclusion of a medical expert commission, etc.).
  • A set of social services is a component of the EDV. Includes per month: provision of medications prescribed by the attending doctor (RUB 807.94): funds for purchasing a voucher to a sanatorium that complies with the doctor’s recommendations (RUB 124.99); free travel to and from the place of treatment (RUB 116.04). To cancel the NCU and receive an equal monetary reward, you must submit a corresponding application to the Pension Fund - it is submitted once, it does not need to be renewed every year.   • Add. monthly financial support (DEMO). 1000 rub. provided to category 3 disabled people who were participants in the Second World War; disabled due to injury received during military service; former child prisoners (under 18 years old) of concentration camps. 500 rub. received by military personnel of units of the army that did not participate in the battles and were included in them during the Second World War; widows of WWII participants who died at the front; residents of besieged Leningrad; adult concentration camp prisoners. To receive payment, all specified persons should contact the Pension Fund with a corresponding application.
  • Federal social security payment (FSD) is accrued to unemployed disabled people of category 3, whose total monthly income is below the established regional subsistence level. When calculating, both the pension itself, EDV, DEMO, NSU, and benefits for travel, utility bills and telephone use are taken into account. To receive an FSD, you need to come to the Pension Fund of the Russian Federation with a corresponding application, photocopies of pages of your passport and work book.

Group assignment

Usually a 3rd group is assigned; the 2nd degree is often assigned for a year. If correction with a hearing aid does not give the required result, then a period of 2 years can be determined. After the rehabilitation period, it decreases to group 3. When a disability is assigned for hearing loss to a child who is in a specialized institution, its duration is equal to the training time.

Once a disability group has been assigned, it must be reviewed annually. Obtaining a lifelong form is possible in the following cases:

  • if disability is confirmed for 15 years;
  • if there was a replacement for the second group;
  • if the patient is a pensioner.

Taxation

It should be noted that disabled people are not only guaranteed a decent remuneration for their dedicated work, taking into account the characteristics of their health, but also are provided with some tax benefits.

In particular, on the basis of Part 3 of Article 217 of the Tax Code of the Russian Federation, upon dismissal due to reduction, severance pay is not subject to taxes.

Also, on the basis of Article 218 of the Tax Code of the Russian Federation, disabled people are entitled to a tax deduction in the amount of 3,000 rubles:

  • upon receipt of disability during the liquidation of consequences at the Chernobyl nuclear power plant;
  • if you have the title of WWII veteran.

And a tax deduction of 500 rubles:

  • disabled people of groups 1 and 2;
  • persons participating in the liquidation of the consequences of the Chernobyl accident.

Insurance premiums

Of course, disabled people are a preferential category, which, however, is not a basis for providing certain benefits.

In particular, in 2021, enterprises with disabled employees will pay insurance premiums in full due to changes in legislation and, as a result, the abolition of reduced rates.

Calculation features

Taking into account some of the distinctive features of labor, the wages of disabled people are also calculated in a slightly different order.

3 group

In particular, for a disabled person of group 3, the salary will be calculated as follows.

Based on Article 58.2 of Federal Law No. 212, the enterprise will list:

  • 22% to the Pension Fund;
  • 2.9% in the Social Insurance Fund;
  • 5.1% to the Compulsory Medical Insurance Fund.

Tax deduction will also be taken into account.

Example:

The salary is 15 thousand rubles, a bonus of 3,000 rubles and 470 rubles for 5 hours of overtime work will be added to it, so the accruals will be 18,470 rubles. Then the tax will be calculated - VAT in the amount of 13%, which will be 2401.1, a total of 16568.9 rubles will be provided for issue. And the above-mentioned transfers will be transferred directly by the enterprise in the total amount: 5540.7 rubles.

2nd group

The salary of disabled people of group 2 is calculated in a similar way, but taking into account the fact that this group may have a large tax deduction - for example, 3 thousand, and in this case 19,068.9 rubles will be due for payment.

1 group

Employees with 1st disability group are subject to exactly the same benefits when calculating wages as those given above, that is, the tax deduction and contribution amounts will be equivalent.
