The legislative framework

All conditions for the procedure for assigning and issuing status are prescribed in federal legislation.

The third disability group is regulated by general legislative projects for all three groups:

  • Federal Law No. 181 - fixes the categories of citizens who have the right to obtain the status of a disabled person;
  • Order of the Ministry of Health of the Russian Federation No. 247 - fixes issues and assignment of lifelong disability. In addition, there is a list of certain pathologies;
  • Order of the Ministry of Health and Social Development - determines the list of diseases that belong to the group of corresponding disabilities.

There are also other bills that regulate the nuances associated with disability. They can be found in the current legislation.

What does disability of the third group mean?

Distribution into disability groups depends on a person’s legal capacity and ability to perform daily activities and take care of himself.

Today in Russia there are three groups for people with disabilities:

  • The first group is given to those citizens who cannot independently organize the process of daily life;
  • The second group - receiving this category of disability means that a person needs social assistance in the course of his life, but can partially perform actions independently;
  • The third group is recognized as fully functional and is assigned to citizens who have pathologies that allow them to organize their daily activities, but with minor restrictions.


Registration of the third group of disability can occur both when a person receives a partial loss of ability to work in accordance with congenital diseases, and for those people who acquired a general disease during life (injury, illness, accidents, etc.).

What benefits are available to disabled people from the state?

According to the law, a disabled person is a person with a persistent health disorder that limits him in everyday life. For example, a person cannot take care of himself, move independently, communicate, control his behavior or work. The cause can be any: injury, illness, congenital malformations.

Living conditions. The standard housing area for a disabled person is 36 m², twice as much as for a healthy person. Housing is equipped with special equipment and devices that are required by IPRA. For example, if, according to IPRA, grab bars are needed in the toilet, you can write an application to the social protection committee, and they will be installed at the expense of the state. And the management company is obliged to install a ramp for wheelchair users.

Recently, my friend’s mother, who has a disability, reached retirement age. And she thought about what kind of pension would be more profitable for her to receive. After the calculations were made to the Pension Fund, her insurance pension accruals significantly exceeded the amount she received for disability. But the question arose whether she would be able to receive both pensions at once, because the arrival of retirement age does not cancel her illness.   • For disabled people, 1 gram received in childhood is 12,082.06 rubles.
  • The allowance for disabled people 1 gram is 10,068.53 rubles.
  • Disabled people 2 years since childhood receive 10,068.53 rubles.
  • Payment for disability of 2 grams occurring in adulthood is equal to 5034.25 rubles.
  • And finally, people with 3 grams are entitled to a payment of 4279.14 rubles.

Group 3 disability list of diseases

When assigning the status of disabled person of the third group, the medical commission is based on the presence of the following pathological conditions.

Diseases that allow you to apply for permanent disability

The determination of a disability group requires its confirmation every two years. However, in some cases, state legislation provides for a number of diseases, upon diagnosis of which permanent disability may be prescribed.

An indefinite disability group is established for the following diseases:

  • Tumor formations of a malignant nature;
  • Tumor formations of a benign nature that cannot be operated on;
  • For spinal cord and brain injuries;
  • Pathologies caused by increased pressure in blood vessels;
  • Developing neuromuscular pathologies;
  • Complete loss of vision and hearing;
  • Intellectual impairment;
  • Cardiac ischemia;
  • Pathological processes of the brain;
  • Respiratory diseases caused by insufficiency of the respiratory system;
  • Mutilation and alteration of limbs, also amputation and absence of more than three fingers, removal of feet or hands.


The determination of a disability group requires its confirmation every two years.
The establishment of the third disability group occurs not only in the above-mentioned diseases, but also in the following situations:

  • The age category of a disabled person has reached sixty years for males, or fifty-five for females;
  • Receiving injuries during military operations during military service. At the time of the medical examination, the citizen must be fifty-five years old;
  • Formalized status of a disabled person of the third group during the Second World War, or during defensive battles in the USSR in the period before the war, subject to registration of any disability group for the last five years;
  • A disability group that has not changed over the past fifteen years;
  • Achievement of a citizen with a disability of a certain age group - fifty years for women and fifty-five for men;
  • The deadline for re-passing the medical examination is after the age of sixty for men and after fifty-five for women.

How to get a disability group?

In order to correctly achieve the assignment of the third disability group and obtain the right to use the expected benefits and payments , you will need to take the following actions:

  • Contact the attending doctor, who will determine the feasibility of assigning a disability, who will issue an appropriate referral for a medical examination;
  • Appear for a medical examination to confirm the status of a disabled person;
  • Apply for all necessary benefits.

To conduct a medical examination, a citizen applying to be assigned a third group disability will have to provide the following documents:

  • Employment history;
  • A certificate from the attending doctor with a referral for a medical examination;
  • Passport;
  • Patient's card from the place of treatment, containing the medical history and methods of its treatment;
  • Characteristics from the place of study or work;
  • Certificate of average salary (for official employment);
  • All medical examination reports;
  • Completed application for the need for an expert examination.

The commission is scheduled in medical institutions at the place of residence. If it is impossible to come to the place of medical examination, there are grounds for prescribing a medical examination at home.

After the examination, the determination of the conclusion is issued in the form of an act in which the disability group is established. Within three days, the conclusion is sent to the Pension Fund, after which you can begin to legally register preferential benefits.

Each patient is issued a certificate of assignment of the third disability group and an individual course of treatment.


Having gone through the procedure for obtaining a disability group, disabled people of the third group are required to undergo an annual medical examination to confirm their status.

Benefits for disabled people of group 1

Among the benefits guaranteed to citizens with 1 group of disability are:

  • EDV - 3896.43 rubles;
  • 50% discount on utilities;
  • housing subsidies;
  • educational preferences;
  • free use of all types of city public transport and 50% discount on other types of transport;
  • preferential prosthetics, sanatorium stays, medications;
  • a list of social services such as benefits for funeral expenses, a qualified nurse, etc.

If a citizen’s income does not reach the minimum wage, then he is entitled to a federal subsidy, the amount of which is determined by the region of residence.

Payments for disabled people of group 3

This category of disability is easier than 1 and 2, but still has restrictions for some professional activities. There are no prohibitions on labor activity by state legislation.

However, a disabled person with a third group may be given a list of contraindicated professions in which the employer must provide the person with easier working conditions.

In cases where the 3rd disability group is assigned, the citizen is entitled to both social benefits and monthly cash payments. When calculating the amount of payments, a disabled person must take into account the length of service and average salary. The formula for calculating the required material resources is indicated below:


Pension calculation formula

The insurance part of the pension is a transfer by the employer to the Pension Fund of Russia in the amount of sixteen percent of wages.

The funded part of the pension is formed for citizens who were born in 1967 and later. Each employer contributes six percent of the salary to the employee’s individual personal account in the Russian Pension Fund.

In addition, annual investment income received from managing these funds is added to pension payments.

Every citizen has the right to independently choose the organization that will manage his funds - private or public.

Survival period is the amount of average life expectancy after retirement.

What awaits working disabled pensioners in 2021: latest news

Dmitry Medvedev agreed to return to the discussion of this issue, but in relation to one category of citizens it may become a reason for other persons to appeal to the Constitutional Court, for whom such a relaxation of the legislation will not be provided. On April 25, 2019, Medvedev signed an order to the Ministry of Labor, the Ministry of Finance and the Ministry of Economic Development to study the issue of indexing disability pensions for workers. He instructed to prepare a financial and economic assessment of such a proposal by July 1, 2019. However, so far no statements have been made on this matter, and a report on the results of studying this issue has not been published.

V. Putin about the indexation of pensions for working disabled people

However, the authorities have repeatedly discussed the possible lifting of the moratorium and “unfreezing” the indexation of pensions specifically for working disabled people. In particular, President Vladimir Putin instructed to work on this issue in 2021.

On January 1, the amount of accrued funds due to all disabled citizens with at least 1 day of work experience will increase by 6.3%. The bonuses assigned to pensioners will increase similarly (length of service for work in the Far North, presence of dependents). Russians with disabilities will receive increased amounts of payments on December 30-31. But only those whose payment falls on the 1st-9th of the month (weekends in January).

List of benefits

Federal legislation provides benefits for people with disabilities, and for the third group too. They can be expanded by regional benefits, which are provided only in the territory of a certain district.

The state provides the following benefits:

  • Free receipt of medications prescribed by the attending physician;
  • Visiting health centers at state expense;
  • Travel by rail to the place of treatment and in the opposite direction;
  • Mandatory state scholarship for studying at federal educational institutions;
  • Admission out of turn on the budget to secondary and higher educational institutions of the country that have budget places. The only condition is passing the entrance exam with a positive mark;
  • Unscheduled medical procedures are provided at discounted rates;
  • There are no probationary periods during the employment period;
  • If necessary, a disabled person of the third group is provided with a part-time working day or a shortened week;
  • When a disabled person is in need, he has the right to receive leave at the right time;
  • Opportunity to get on the waiting list for subsidized housing;
  • Preferential procedure for providing land plots;
  • Exemption from property and transport taxes;
  • Exemption from a number of other taxes;
  • Possibility of partial payment, or in installments, of state fees for government services.

Each disabled person of the third group can choose preferential benefits, or receive monthly cash payments instead, either partially or in full.

In addition, regional benefits can significantly expand the list of preferential benefits for a citizen who is considered disabled.

The following benefits apply within the capital:

  • Free travel in city and suburban transport;
  • Discounts on utility bills up to fifty percent;
  • Compensation for using a landline telephone, etc.

Citizens are eligible for all payments and benefits only with a valid medical examination report.

Receiving a disability and old age pension at the same time

Disabled children also have the right to receive all the benefits granted to adults. If a child is in such a serious condition that he needs constant care from a parent, then the latter receives payments every month - compensation for the inability to go to work.

  • disabled people of the first group (from childhood), disabled children can receive about eleven thousand rubles a month;
  • disabled people of the first group and disabled people of the second group since childhood - nine thousand and five hundred rubles;
  • disabled people of the second group - up to five thousand;
  • disabled people of the third group - up to four thousand.

Work restrictions

Any restrictions on the implementation of labor activities are determined for each disabled person of the third group by a medical commission.

Also, the medical examination determines a list of professions in which it is prohibited to work, in order to avoid further progression of complications, or the occurrence of situations dangerous to health or life.

In addition, disabled people of the third group may be provided with preferential benefits in the form of increased annual leave of up to sixty days for the purpose of rehabilitation.
