There are some other conditions:

  1. If a military man has become disabled, a pension is assigned in connection with this fact;
  2. The maximum age for service in the armed forces for women is 45 years , regardless of rank;
  3. For all military personnel, except for special categories, the age for acquiring the right to a pension is 50 years (before 2014 it was 45 years);

Rules for receiving additional payment to a disability pension

Insurance and state pensions may have a “base”, calculated on the basis of length of service, length of service, pension savings, etc. - by analogy with a regular pension. The additional payment implies an increase in the basic part of the benefit, taking into account the disability group, previous experience and other factors.

Let us remind you that for disabled people of groups 1 and 2 the fixed payment is set at a single amount. But people with group 3 receive only 50% of this amount. This rule is enshrined in clauses 1, 2 of Art. 17 of Federal Law No. 400-FZ of December 28, 2021

Or always apply for compensation for housing and communal services and tax benefits when changing property ownership.

Regional benefits

The legislation in force in the Russian Federation provides for the provision of benefits to certain categories of citizens. These include veterans and military retirees. They can apply for federal and regional preferences. Some of the benefits provided to them apply to family members living with them.

What benefits are provided and to whom?

All types of benefits are provided based on the submitted application. Documents are submitted along with it, the list of which depends on the type of benefit received. Documents required for registration of all types of privileges include:

According to Federal Law No. 5-FZ dated January 12, 1995, veterans of military service are military personnel of the USSR Armed Forces, the Russian Armed Forces or other types of troops, military formations or government bodies in which citizens may serve in military service.

The title of veteran of military service is awarded to persons described in Part 1 of Art. 5 Federal Law dated January 12, 1995 No. 5-FZ. In accordance with the norms of this act, Decree of the President of the Russian Federation dated May 19, 1995 No. 501 was adopted to regulate the procedure and conditions for awarding the title.

Who can be recognized as a veteran?

Due to the fact that such a benefit is not prescribed at the federal legislative level, conflicts arise in local social protection authorities. Especially if such preferences are not duplicated in a local law or other act. Veteran applicants are denied benefits and then go to court.

We recommend reading: How long can a pensioner be kept working?

To receive compensation payments, a veteran will need to fill out an application and present a tax notice, documents confirming the payment of tax, as well as title documentation confirming the applicant’s status and his rights to benefits.

Persons who participated in hostilities should be provided with full social support from the state. Their contribution to matters related to the defense of the country's independence and defending its interests in the international arena required significant effort and courage. Therefore, the state provides benefits for military personnel that apply to all spheres of public life.

Preferences for wives of military personnel

If a spouse is transferred to serve in a unit in another city, his family, of course, follows him at the expense of the Ministry of Defense. At the new location, they are provided with guaranteed housing for the entire period of service.

The inconveniences associated with the duty to serve are compensated by several points:

  • Calculation of the pension of a military man's wife. If she was unable to get a job at her husband’s place of service (for example, her specialty was not useful in a military camp), her work experience will be counted: until 1992 - for the entire period of her husband’s service, until 2014 - only for the years when the wife could not find work at the husband’s place of duty, and from 2015 – up to 5 years of work experience will be added;
  • Benefits for paying for housing and communal services are transferred to the spouse if the military husband dies or is killed;
  • Tax and medical benefits in most cases go to the spouse who has lost a military husband or the husband of a military retiree.

The main condition is that the marriage is not dissolved by mutual desire of the parties. A woman can count on benefits if she is the spouse or widow of a military man.

A retired military man can refuse this type of compensation and pay for housing and communal services in full, but with the condition that half of the payroll amount is transferred to his bank card.

Preferences in the field of education

Military personnel finish serving at a young age and can obtain a civilian profession. The state has prepared a number of measures that pensioners can take advantage of, since it is important to meet qualifications to get a job.

In this case, the state meets halfway and provides privileges for admission to certain educational institutions on preferential terms - without writing entrance exams.

Medical services and medicines

Military service is associated with many dangers that affect the health of a pensioner.

  • Providing medical care free of charge.
  • Receipt of medical products and medicines, but solely at the discretion of the attending physician.
  • Manufacturing of dentures, their necessary repairs, except for expensive products.
  • Spa treatment.

Fare

Pensioners do not need to pay for travel on public transport, since these costs are fully borne by the state. Some regions provide discounts on train travel and train tickets. To take advantage of the privilege, you must present a pension certificate.

Right to housing

Preferential purchase of housing is very important for a person with a military profession who has retired, and this must be approached very carefully, because the requirements for this are extremely strict. The rules and procedure for obtaining subsidized housing are prescribed in the Federal Law “On the Status of Military Personnel.”

  • Participation in the savings-mortgage system (NIS).
  • Obtaining a housing certificate.
  • Registration of a subsidy.

NIS was developed exclusively for people with a military profession, which is valid for 36 months - this is how long a pensioner needs to stay in NIS. This system is specially designed for military personnel to obtain subsidized housing. The age of the program participant must not exceed 45 years.

A housing certificate entitles you to financial support from the state for the purchase of living space in the region chosen by the retiree.

A subsidy is a one-time payment for the purchase of an apartment or house. A military pensioner must have a signed contract for service, dated no later than January 1, 1998. A minimum living area is allocated for one and two people, with an additional 18 square meters for each new resident.

Compensation for spa treatment

A retiree is allowed to apply for sanatorium-resort treatment at the expense of the state budget, if such a decision is made by the attending physician. The state allocates funds to pay for the trip once a year, but this decision can be reviewed by a military commission.

The former military man must pay a quarter of the cost of the trip, and his relative – half. If a decision is made to refuse the discount, the state is obliged to pay compensation.

Compensation payments to widows

  • one-time monetary compensation for burial;
  • monthly payment due to the death of the breadwinner;
  • child subsidies;
  • discounts on housing and communal services;
  • benefits related to medical care;
  • discounts on sanatorium treatment once a year;
  • the possibility of enrolling children in educational institutions and kindergartens on preferential terms;
  • payment for services for changing residence and payment for a trip to the burial place of the spouse once a year.

Benefits for paying utility bills

If a soldier dies, these relatives can continue to enjoy benefits. They are also provided with survivor benefits. Such social guarantees are also provided to widows of military pensioners. In the absence of first-degree relatives, rights cannot be transferred to other persons. However, the brothers and sisters of a military man and his grandchildren can receive funds from the NIS. The norms of inheritance legislation are enshrined in the Civil Code of the Russian Federation.

Family rights

If any employee with more than 3 years of work experience in the authorities can participate in the system and improve their living conditions, then the pensioner should be recognized as needing to participate in the program. The citizen must submit a corresponding application. The forms of assistance are:

  1. Preferential utilities and partial payment for major repairs.
  2. Free holidays in sanatoriums.
  3. Free medicines.
  4. Discounts on public transport.
  5. Tax benefits.
  6. Annual leave at any time during official employment. The right to unpaid leave for up to 30 days at any time.

How to apply for benefits - step-by-step instructions

Discounts are not automatically assigned to retired military personnel, but the process for obtaining them is simple. You need to go to the relevant authorities: the Federal Tax Service to receive tax breaks, the social security department for housing and communal services benefits, the pension authority and the MFC for other preferences.

  • passports of a citizen of the Russian Federation;
  • pension certificate;
  • a completed application according to the sample;
  • other documents that confirm the right to the benefit.

The state regularly expands social guarantees for the military and uses other tools to attract people to the Armed Forces. However, an unstable economic situation may affect these processes.

Therefore, it is important to apply now for the privileges and preferences due, since there is no confidence in the continuation of social programs.

The military profession is constantly associated with increased mental and physical stress, which subsequently has a negative impact on health. It is quite reasonable that the state supports military personnel not only during their service, but even after their retirement.

State assistance is expressed in providing individuals with a variety of social guarantees and benefits.

Military pensioner status

Persons who have the right to social guarantees and benefits are listed in the Federal Law of May 27, 1998 No. 76-FZ “On the Status of Military Personnel” and in the Law of the Russian Federation of February 12, 1993 No. 4468-1 “On Pension Security...”

  • military personnel who served in the commonwealth of troops;
  • soldiers who served on a contract basis;

  • fire service workers;

V.R.: — In accordance with the Federal Law “On the Status of Military Personnel”, social assistance is extended to officers, warrant officers and midshipmen dismissed from military service upon reaching a certain age or for health reasons. But to receive it, the total duration of service must be 20 years.

In accordance with the order of the Minister of Defense of the Russian Federation dated December 27, 2017 No. 815 “On determining the Procedure, cases and features...” military pensioners can be provided with free tickets to sanitary and resort institutions.

Increased pension

The right to receive a military pension arises for citizens who have 20 or more years of military service , calculated in accordance with the Decree of the Government of the Russian Federation of September 22, 1993 No. 941 “On the procedure for calculating length of service...”.

When calculating a pension, various circumstances are taken into account: years of service spent in particularly dangerous territory, the presence of awards, rank, etc.

The size of the military pension for non-working pensioners is: 50% of the average salary of a military personnel + 3% for each irregular year of service.

The size of the military pension for working pensioners is: 50% of the average salary + 1% for each overtime year.

The size of the pension for disabled military personnel is: 85% of the average salary, subject to the presence of 1 or 2 groups of disability.

Medical support

Military retirees can take advantage of the following medical benefits:

  • free medical care;
  • free provision of necessary medications;
  • free dental procedures;
  • annual medical examination;
  • free trips to the sanatorium;
  • completely free or partially free sanitary-resort treatment.

Medicine

Each region offers an individual set of benefits for military veterans. They are added to federal preferences, but do not cancel them. Veterans are provided with financial assistance, discounts on transportation services and other benefits.

We recommend reading: Gas benefits for military veterans in the Bryansk region

Regional assistance

Russian legislation is very unstable, especially with regard to social preferences for the population. In 2021, discounts and concessions for potential veterans in military service are regulated by the following regulatory documents:

Benefits for property tax for individuals.

Veterans who are disabled people of groups I or II, or who have a total duration of military service of 20 years or more, do not pay property tax on one piece of property of each type owned by the veteran. Please note that this benefit does not apply to property whose cadastral value exceeds 300 million rubles. But if a veteran of military service has a garage and/or a parking space in such an object (worth more than 300 million rubles), then the tax exemption benefit will apply to him. An important point: to receive benefits, a veteran must not use his property in business activities.

Military pensioners: features of obtaining status

The features and conditions for retirement of military personnel are determined by several parameters . This is how you can register your right to payments and tax breaks:

ATTENTION, PROMOTION! If you have questions, you can ask them to social lawyers:

  1. Based on existing length of service.
  2. Based on established disability (acquired during service).

Also, the right to receive a pension extends to the family of a serviceman in the event of his death.

In order to obtain status and start enjoying benefits, you must serve at least 20 years . Those dismissed from service due to deteriorating health conditions will need to fulfill the following two conditions:

  1. Reaching a certain age ( 45 years ).
  2. Having 25 years of insurance experience, of which at least 12.5 years are military service.

The age limit also determines the time of retirement:

  • military personnel (not older than lieutenant colonel) - 50 years old ;
  • colonels - 55 years old ;
  • the average general composition is 60 years old ;
  • senior command personnel, including marshals, colonel generals - 65 years ;
  • women - 45 years old .

In addition to a military pension, it is possible to obtain a second (insurance) pension if a person continues to work in a civilian enterprise for at least 15 years . In this case, an additional payment of funds forming the insurance pension .

Tax benefits and mandatory contributions are also provided for by current legislation. They cover the entire range of social support, which applies to all pensioners in our country.

Registration of benefits is carried out at the relevant institutions - the Pension Fund or the tax office (determined by the type of tax collection).

Utility benefits

Relaxations and privileges for paying for housing and communal services and other public services are one of the benefits provided by the state. A pensioner gets the opportunity to pay bills for an apartment and services with a significant discount - half the amount received in the payment order. That is, you only need to pay 50%.

To apply the corresponding relief, you need to contact the Pension Fund at your place of residence with the following package of documents entitling you to the benefit:

  • pension certificate (issued to all people who have retired without exception);
  • agreement for the provision/provision of a set of housing and communal services;
  • subscriber accounts.

An important feature is that only those military pensioners who have reached the generally accepted old age pension age at the legislative level can apply for benefits - that is, no earlier than 55-60 years . Also, in each region, the list of reliefs on utility bills includes various services, which should be checked with local services. For example, there may be a discount for using a telephone (landline) or a recalculation of payments for major repairs.

Medical benefits

This category of benefits is important for military personnel, since the risk of injury and injury during service is very high. The relaxation is enshrined in law in Article 16 of Federal Law No. 76. All required medical care is provided free of charge.

You can use the required medical care not only at your place of residence, but also in any institution in the country.

Retired military personnel can also receive the medications to (necessary for treatment) completely free of charge, but with a prescription written by a doctor. Additional medical benefits:

  • free dentistry (prosthetics and treatment);
  • obtaining vouchers (for recovery or planned treatment).

Relatives are provided with partial compensation for the funds spent on the trip - from 25% , including the cost of the voucher and travel to the place of treatment.

Tax benefits

Taxes are a special point of support for pensioners. You need to know what benefits are available to military pensioners in order to apply for them on time. The collection of funds for the benefit of the budget provides for relief for former military personnel. The main types of support are:

  1. Benefits for paying compulsory tax on a dacha or land plot, if owned (valid in some regions).
  2. Relief on property tax payments.
  3. Income tax benefits. Not taxed:
      pensions;
  4. income from an insurance contract and savings system;
  5. compensation.
  6. Exemption from the state fee paid when filing a claim with the courts.
  7. Benefits when paying transport tax (valid in some regions).

It must be remembered that each of the available relaxations has its own characteristics, which depend on the region , as well as the scope of their use.

Land benefits

Country plots are owned by a large number of people who have reached retirement age. Former military personnel are no exception, which is why they, like other retirees, are covered by a preferential payment program.

According to regional laws, everyone who has the status of a “military pensioner” has the right to apply for relief and a reduction in the amount required to be paid.

The registration process requires the submission of documents and the personal presence of the person (or his authorized representative) - the benefits are not automatically assigned.

To do this, a citizen applies to the tax office in the area where the land plot is located and provides documents confirming his identity, status and right to use the land. You will need to make copies of all documents, and also have them certified by a notary if authorized persons will deal with issues of benefits.

Transport benefits

Today, benefits extend to the transport sector. There is a division into:

  • transport tax benefits;
  • discounted travel on public transport.

It must be remembered that transport benefits are local privileges, that is, the amount of discounts is formed on the basis of opportunities and budget allocations in a certain region of the country.

Regarding transport tax relief, military pensioners will be able to take advantage of the benefit in 2021 only in those cases if:

  1. The fact of disability received during service or during combat operations or actions has been established.
  2. The person is recognized as a combat (military) veteran.

Additionally, you should remember that depending on the region, the % discount will vary - it can be the full cost of the tax ( 100% ) or cover a certain part of it - up to 50% .

Preferential travel on public transport is valid for all military pensioners. The discount applies to ground transport, metro, as well as local and long-distance trains. If treatment is necessary, the discounted travel is 100% , and for a family - from 25% of the total ticket price.

Conclusion

People who have retired due to length of service to the state have the opportunity to receive benefits and privileges in various areas and spheres of life:

  • discounts on housing and communal services;
  • treatment and necessary rehabilitation;
  • exemption from certain taxes and the use of deductions when calculating the amount of personal income tax;
  • travel benefits.

Benefits must be issued and confirmed in the institutions corresponding to the category of discounts - Pension Fund or Tax Inspectorate.

Military service belongs to the category of activity that involves increased psycho-emotional stress and early loss of ability to work. Considering this factor, as well as the fact that the protection of the state is of particular importance, in Russia military personnel have a number of benefits and preferences.

One of them is relatively early retirement.

At the same time, persons discharged from military service have a special status and associated benefits. However, not all military pensioners are aware of their availability and the possibility of using them in practice.

The legislative framework

The procedure and nature of providing benefits to citizens who served in military service under a contract, including officers, are normatively established. Thus, the main legislative act that you should pay attention to first of all is the Federal Law of May 27, 1998 No. 76-FZ “On the status of military personnel .

In addition, issues related to pension provision for citizens who served in military service are considered in the provisions of the Law of the Russian Federation of February 12, 1993 No. 4468-I “On pension provision for persons who served in military service...”. It establishes that military personnel with an officer rank, as well as soldiers and sailors who served under a contract, have the right to social security.

The procedure for providing benefits is established by departmental documents of the Ministry of Defense and other structures.

It should be noted that social benefits provided to military pensioners can be divided into two large groups:

  1. Federal. Former military personnel throughout the country can count on them. The source of their financing is the federal budget.
  2. Regional. Regions have the right to provide benefits for army pensioners on their territory, having established the grounds and procedure for receiving them in the relevant regulations of the constituent entity of the Russian Federation.

How to get a veteran's ID?

Current legislation provides citizens with guarantees in the form of social support. Recipients include persons belonging to various categories. Military personnel are one of them. Preferences for the military are enshrined in the following main legal acts:

Procedure for obtaining the title

Thus, the issue of providing military service veterans with benefits and other privileges is completely regulated at the legislative level. A citizen applying for the corresponding preferences can contact his place of service or the administration of the municipality to obtain complete information about the list of measures and the procedure for their execution.

We recommend reading: Austrian Citizenship Law 1965 text

This support measure applies exclusively to government organizations. When treating, examining or receiving services in commercial medical centers, the benefit does not apply, unless otherwise agreed by the commercial organization itself.

Support for families of fallen soldiers

The law provides for a set of support measures for the families of fallen servicemen.

  • receiving state benefits for children;
  • receiving a voucher to a departmental sanatorium once a year;
  • payment for travel to the burial place of the deceased spouse;
  • obtaining a trip to a sanatorium for a child.

Are there any plans for changes to preferences in 2021?

There are no plans to introduce significant changes to federal legislation regarding the provision of benefits to military pensioners and members of their families.

At the same time, next year former military personnel can expect a change in the level of pension provision in the form of its indexation. This also applies to state survivor pensions.

Military pensioners in the Russian Federation, due to their status, in addition to material support, are entitled to a number of benefits and preferences. They relate to exemption from a number of tax payments, provision of subsidies for housing and communal services, the right to priority medical care, education and preferential vouchers to departmental sanatoriums.

At the same time, the law takes into account the rights of not only the military themselves, but also their family members. Thus, persons who were dependent on a deceased serviceman receive survivor pensions, and also enjoy part of their benefits.
