Preferential pension for electric and gas welder: list of conditions for granting a pension

In Russia, the profession of an electric welder is considered not only in demand, but also preferential. Being associated with risks and special working conditions, this activity falls into the category of “particularly harmful.” Upon retirement, the electric and gas welder will receive a preferential pension. We will look at the list of basic conditions and privileges in this article.

electric and gas welder

Electric and gas welder

Why is this profession included in the category of “especially harmful”?

Many people wonder why the profession of an electric welder is classified as especially dangerous? Today this specialty is highly paid and this is due not only to the complexity of the process, but also to special working conditions.

Also find out how to arrange delivery of your pension to your home?

Despite the fact that the work is usually carried out in a factory environment, that is, where strict safety standards apply, the electric welder exposes his health to increased danger. Often, some types of work have to be performed “in the fields,” outside workshops, on construction sites, or at high altitudes.

Therefore, the master takes a great risk when performing electric welding when installing high-rise buildings, in conditions of strong gusts of wind and snow.

A separate category includes workers who perform welding on ships, which often involves working in special, extreme conditions.

But this is not even what classifies the profession as “harmful”. When welding seams or soldering metal, the worker’s vision is subjected to severe strain. Over time, many specialists in this field note a decrease in visual acuity and partial loss. Also, this profession is characterized by other chronic diseases: bronchitis, asthma, arthritis, etc.

Nowadays this profession is in demand

Nowadays this profession is in demand

During work, specialists have to perform serious physical activity while on their feet. This is hard physical work, often at heights, in an uncomfortable static position.

But, despite all these difficulties, many young people still choose this profession. And there are a number of reasons for this:

  1. High wages. At all times, this specialty is in great demand, and finding a highly qualified specialist in this field is not so easy. Compared to similar blue-collar professions related to construction, installation and repair work, welders earn 2-3 times more. Of course, the level of income depends on the qualifications, class of specialist and the region in which he works.
  2. The accumulated experience and qualifications favor rapid career growth.
  3. High demand for welders. Unlike other professions, even for a young, inexperienced welder, finding a job will not be difficult.
  4. Specialists have the right to a preferential pension.

Decor

For persons who have preferences for early retirement, it is necessary to start registration at least 1-2 years before the due date.
This approach allows us to eliminate bureaucratic delays. The preparation algorithm looks like this:

  1. Contacting the employer for information on conducting assessment activities of production conditions. In the absence of such, it is necessary to request relevant documents indicating the certification of the workplace;
  2. Collect relevant papers;
  3. Write an application to the Pension Fund of the Russian Federation to receive data on the list of professions. Such actions must be taken to confirm harmful working conditions. The department should also make a request regarding length of service - this becomes important if the management did not provide any information about the employee;
  4. After the work experience has been collected, the citizen must contact the branch of the Pension Fund of the Russian Federation with the prepared documents;
  5. An employee of the organization will conduct a check and register the new person in the database.

Note: if a Pension Fund employee denies a person a preferential pension, then it is necessary to obtain papers indicating legal reasons. In addition, the welder can receive advice on further actions on site.

List of required documents

The following documents should be submitted to the Pension Fund of the Russian Federation:

  • original passport;
  • individual tax number;
  • Statement of salary in form 2-NDFL for the last five years;
  • employment history;
  • SNILS;
  • evidence of employment in hazardous conditions;
  • details and contacts of the employer.

In a situation where an enterprise is unable to provide evidence of production belonging to the relevant conditions, the person will not be able to receive preferential benefits.

Who is eligible for the benefit?

For electric welders, unlike other categories of citizens, a separate retirement period is established:

  • men have the right to receive a pension upon reaching 55 years of age;
  • women - 50 years old.

For comparison, today all other citizens of the Russian Federation have a different age threshold for entering a well-deserved retirement. Men - 60 years old, women - 55.

Preferential age for women – 50 years

Preferential age for women – 50 years

The basis for calculating the term is 30 - 32 art. Law of the Russian Federation No. 400 “On pensions”.

Special conditions are assigned due to poor “harmful” working conditions.

According to these articles, in order to assign preferential conditions, the commission must confirm that the subject actually had work experience in his specialty. However, in order to fully take advantage of all the government benefits due, you must have a certain work coefficient.

Therefore, you should not definitely count on the same preferential conditions. Electric welders, depending on their category, production time, working conditions and length of service, may have completely different benefits.

Pension privileges for gas welders

According to the current articles of legislation, lowering the working age affects the following working conditions:

  • The place of work is recognized as dangerous or harmful, as confirmed by the certification sheet.
  • Professions are included in the government register.
  • Before retiring, citizens must have general and special experience.

The age for retirement can be adjusted depending on the length of continuous service and additional circumstances.
If the special activity does not comply with the standards, then the granted benefit is still taken into account.

In such situations, for female welders or gas-electric welders, two years of work with difficult working conditions and a year of special experience are added to each working year with difficult working conditions. For men - for every 2 years and 5 months of harmful work.

For example, after a woman has worked in a dangerous position for more than five years, pension insurance is due at age 53.

How to calculate experience correctly?

How to correctly determine whether a specialization falls into the category of those who are entitled to earlier, preferential retirement? If you read Article 30-32 of the federal law, there is no direct reference to this specialization. It will list the working conditions that may give rise to such rights.

The Decree of the Russian Federation No. 10 of 1991 outlines a list of professions that qualify for early retirement

The Decree of the Russian Federation No. 10 of 1991 outlines a list of professions that qualify for early retirement

Another document confirming such benefits is Decree of the Russian Federation No. 10 of 1991. Section 23 states that a number of professions have been identified that allow early retirement. This list includes such professions as gas welder and electric welder.

But here the class of harmfulness plays a big role.

Classification of working conditions according to the degree of harmfulness and danger

Classification of working conditions according to the degree of harmfulness and danger

This category is defined by GOST 12.1.005-88 and GOST 30756-2001.

Table No. 1 - Harm class and benefits

Harm classTypes of workPrivileges
1 (optimal working conditions)Working with automatic devices
2 (acceptable conditions)contact welding
3 (especially dangerous)This category includes welding machines with flux up to 10% silicon dioxide.+
4 (extreme)Metal cutting and melting+

From this table it is clear that in many respects the right to benefits will be calculated based on the class of work.

To carry out certification of working conditions, a special commission is created that examines workplaces, determines the air level and draws up a Report. Certification of the hazard class of a workplace is carried out according to GOST GOST 12.01.005-88 “General sanitary and hygienic requirements for the air of the working area.”

Welders who work with other types of gases (for example, argon) and engage in press welding are not included in the preferential category according to this state standard.

Welder's pension according to harmfulness

argon workers mostly sit in one place. and they have ventilation nearby. But what about someone who works as a handbrake on the installation of pipes in a workshop where with a super shield you can’t get around only pipes, and still not a single respirator can protect you from welding aerosols, someone worked in these places. He earned harmfulness. And now they have no young people there will be harm and who will then voluntarily ruin their health

In 2015, it was planned to set these tariffs 1.5 times higher - at the level of 9 and 6 percent, respectively. Receiving income to the pension fund would then amount to 80 billion rubles.”

Additional payments and compensations

In addition to the basic pension and preferential earlier retirement, workers in this profession can count on various additional payments and compensation.

The amount of such benefits largely depends on the length of service and the severity of the working conditions in which the specialist worked.

Special working conditions require the accrual of preferential leave

Special working conditions require the accrual of preferential leave

A welder whose work belongs to class 3-4 can, without additional documents, qualify for preferential conditions for going on retirement leave. Workers involved in performing class 1-2 labor tasks do not have such benefits. Their retirement period is standard - 60 years for men, 55 years for women.

An important point is a document that confirms the corresponding class of work. That is, this data must be written down in the work book in accordance with GOST. You can clarify these details with the personnel inspector at the enterprise.

The commission takes into account several types of experience when calculating

The commission takes into account several types of experience when calculating

The right to leave is established by a special Commission. She reviews the documents and decides whether the specialist has enough grounds to retire.

The commission takes into account the following factors:

  • total work experience;
  • working conditions;
  • production hazard class;
  • the company has appropriate certification.

It does not matter what schedule the subject worked on. When calculating total length of service, only working days (not hours) are taken into account.

Takes into account total work experience

Takes into account total work experience

A man's minimum work experience must be 25 years. In this case, the duration of work in this position is taken into account. The experience must be at least 12.5 years.

For women, different rules apply: 20 years of total experience and 10 years of work as a welder.

An electric welder can claim a pension 5 years earlier

An electric welder can claim a pension 5 years earlier

But there are other nuances that may become the basis for approval of a preferential pension. These relaxations make it possible to reduce the calculation of length of service by 50%. Even after working 75 months as a welder, for men, every 2.5 years will add an additional year of experience. Thus, a specialist will be able to claim his right to retire much earlier than his peers.

It is enough for a woman to work without a break for 5 years, so that every 2 years she gets an additional year.

Recommendations for young employees

In order to retire early, you need to take care of your own future from the start of work. For this, the following conditions are met:

  1. Work is carried out only if there is official employment.
  2. It is necessary to control the execution of documentation in accordance with the law.
  3. Conduct regular workplace certification (once every five years).
  4. Make sure you have the correct job title.
  5. Control transfers to the Pension Fund.
  6. Watch SNILS.
  7. Save all documentation.

If you follow the rules, you will not have to worry about the lack of early retirement for a welder and its size.

Thus, the profession of electric and gas welder belongs to the second list of hazardous working conditions. The law allows termination of work activity while exercising the right to early retirement. This is possible if you have full work experience and pension savings.

In some cases, a reduction in indicators is allowed, for example, if the special experience is at least half of the total. Getting a pension on preferential terms is quite difficult. It is important to take care in advance of the correct execution of all documents and the availability of official employment.

Benefits when calculating pensions

Since the profession of a welder, according to Russian legislation, is one of the preferential professions, the law provides for two options for calculating pension benefits.

Much attention should be paid to how the specialization is recorded in the work book. Sometimes employees are not interested in this fact, and unqualified personnel inspectors make an incorrect entry in the document. Subsequently, this can greatly affect not only the period of retirement, but also the overall amount of benefits and other benefits.

Until 2002, the entry electric welder and gas welder were classified into different categories. But since 2002, the Ministry of Labor, after considering the characteristics of work and analyzing the classification of the category of hazardous production, equated these two specialties to one when calculating benefits.

Many citizens who will soon be filing documents for retirement are wondering whether the pension reform in 2021 has made any changes to the general procedure for calculating length of service. However, no changes are envisaged for this profession.

Therefore, the calculation requirements remain the same. The total length of service, harmfulness of production and the mark on the preferential category in the work book are taken into account.

Grounds for calculating preferential benefits for welders

What time welders should retire largely depends on the availability of the required work experience and the number of IPCs on the citizen’s individual account. The legislative acts list all the grounds for receiving preferential benefits as part of early retirement.

Working category for benefits

Pension benefits for welders require the employee to comply with a number of mandatory conditions:

  1. The workplace must be official. At the same time, the employer must make correct entries in the work book. In the absence of an agreement, a citizen can bring witnesses to prove that the person has the right to preferential benefits. However, doing this is extremely problematic and only through the courts;
  2. The pension fund must receive regular contributions;
  3. The main requirement is a 100% match of the profession code of electric and gas welder with the position specified in List No. 2. In this case, the employee is required to provide supporting documents. If there are discrepancies in the papers, the granting of a preferential pension will be refused;
  4. A welder, regardless of category (category), is required to undergo an assessment at work. The employer thus assesses the degree of dangerous working conditions.

Number of years worked

For workers employed on general terms, the law specifies the retirement age:

  • the male population retires at the age of 60;
  • women aged 55.

At the same time, it is important that the insurance period is developed in full.
For welders, the pensionable experience is:

  • male representatives are required to work for at least 12.5 years in this position;
  • for women there is a relaxation of the minimum term of 10 years.

Separately, it is necessary to highlight the accounting of the period worked, which determines the total length of service. For 2021, this indicator is formed according to the calendar. It is noteworthy that a full 12 months of work is equal to one year and is included in the service life. This exception to the rules applies to those electric and gas welders who are involved in the workplace part-time.

Influence of the coefficient (IPC) on working conditions

Accounting for accumulative points on an individual pension account of citizens does not differ between professions, for example, a machinist and an electric and gas welder.
Note: accounting is carried out on the basis of the sum of the coefficients on the balance sheet before the 15th year and after. So, for 2018, the IPC amount was 13.8 for early retirement, and by 25 it is planned to raise the bar to 30 points. There are a number of features for applying for early exit benefits. The main document certifying the right to benefits is the work book. In addition, it is required to have a full duration of work in appropriate conditions. Considering that the profession of electric and gas welder is endowed with the early formation of chronic diseases, it is important for a person that all documents are in order.

Who is entitled to preferential benefits?

List No. 2 of specialties that are entitled to a pension earlier than the established general norms is as follows:

  • metal gas cutters;
  • electric welders working on semi-automatic or automatic devices;
  • welders operating manual equipment;
  • and others.

These professions are related to the first category, which has the right to receive preferential benefits. Therefore, errors made in employment contracts and other reporting documents lead to a violation of the interests of citizens.

For information: if the specialty of a gas-electric welder is registered in the book instead of an electric welder, then this will not affect the receipt of benefits with early retirement. This is due to the same characteristics of the profession according to the established code in List No. 2.

List of documents for appointment for electric and gas welders

Based on the current regulatory legal acts of Russia, the specialty “electric and gas welder” refers to hazardous work activity.
What is the basis for calculating benefits with preferences upon reaching the appropriate age. The legislation establishes the following requirements for documents that an employee submits to the Pension Fund of the Russian Federation:

  • a personal file in which it is indicated that the person’s work involves the use of fluxes of the third class of harmfulness, which negatively affect the body;
  • an employment contract or book where it is recorded that the citizen worked full time;
  • the presence of the appropriate number of IPK in the individual account - this is confirmed by an account statement.

Rules for applying for a preferential pension

In order to declare your right to retire, you must prepare the following documents to the Pension Fund of the Russian Federation:

  • passport;
  • work book;
  • SNILS;
  • certificate from the accounting department about salary calculation for 5 years;
  • distinctive signs (if any).

When calculating pensions, social service workers may require other documents that confirm the preferential category. Such documents may include medical certificates confirming the assignment of a disability group and other certificates.

Registration of pension

Registration of pension

The subject must prepare the documents independently. The exception is the fact of recognition of incapacity.

If all the conditions for preferential calculation of benefits are met and the documents are in order, then the government agency will assign a pension from the day the documents are submitted. In this case, the pension cannot be assigned earlier than provided by law.

There are cases when, when preparing documents, employees of a government agency do not accept certain certificates or insist that the entry in the work book was made incorrectly.

In this case, the subject must contact the employer and ask for written confirmation of the entry made in the work book.

Employment history

Employment history

This document should reflect the following information:

  • the working conditions in which the subject worked;
  • name and class of equipment;
  • certification sheet;
  • personal account details for salary;
  • Order of appointment to a position;
  • production hazard class.

The employer does not have the right to refuse to issue such a document, therefore, even if controversial issues arise in the Pension Fund, they can be resolved.

The basis for awarding a preferential pension to a government agency is the fact that employers have paid an increased insurance contribution to the Pension Fund. If such data is not confirmed, it will be difficult to count on benefits.

Documents for verification and registration can be sent to the government agency in three ways:

  1. Through the official website of the Pension Fund of the Russian Federation online.
  2. By postal transfer (preferably a registered option).
  3. Bring it in person.

You can also issue a Power of Attorney to another person who will conduct all affairs and act on behalf of the subject.

Also in the application you can immediately indicate the method of receiving benefits: by bank transfer, at the post office or in person through the postman.

What is a grace period for a welder?

Early retirement for welders is indicated in the General List No. 2 of professions, dated January 26, 1991 (section No. 33).
This list stipulates that workers who are engaged in manual labor in welding or who cut metal on automatic or semi-automatic installations, including when using fluxes, are representatives of labor of the third hazard class. This is due to the fact that the work involves hazardous substances. Thus, only these workers have the right to retire early. To familiarize yourself with the list of harmful conditions, you should refer to GOST 12.1.005-88.

When assigning pension contributions, the Russian Pension Fund also takes into account the following factors:

  • total duration of work;
  • availability of documents confirming harmful labor factors;
  • coefficients;
  • full time work day.

Benefit information

If a citizen meets all the parameters, then he is given the opportunity to retire early for welders, i.e. at 55 years old.
In a situation where the insurance part has at least 25 years of experience, and the labor part has been at least 12.5 years, the right to receive preferential benefits also applies. When a woman has worked as an electric and gas welder for ten years, and her total work activity is 20 years, she can retire at the age of fifty.

However, the new reform establishes exceptional cases. For example, in a situation where production is 50% of the specified period, the retirement age begins to decrease in proportion to the period of work in harmful conditions.

Please note: citizens employed in working with inert gas (argon, press welding) cannot count on preferential benefits.

In other words, a woman, having worked for five years as a welder, can count on the fact that every 24 months her number of years for retirement will be reduced by 12 months. Accordingly, for men these proportions will be - after 6.3 years of work experience, every 2.5 years the period is reduced by 12 months.

However, in the Pension Fund, the calculations will take the total amount of time worked according to the principle: 12 months of work = one year of experience.

Conditions for a well-deserved retirement for welders

To form a pension for a welder based on hazardous conditions, the Russian Pension Fund puts forward a number of requirements that the worker must fulfill:

  1. Have the required amount of working time worked with documentary evidence of length of service, i.e. having a work book or archival extract;
  2. The profession code must be included in the unified preferential List. Therefore, when entering a specialty in the book, the correct spelling of the name is important;
  3. Correct completion of the contract and other accounting documentation;
  4. Submission by the employer of an assessment documenting the presence of harmful working conditions;
  5. Official workplace.

The employer is required to comply with the following rules:

  1. Submit to the Russian Pension Fund a complete list of employees, indicating their full names, who are involved in hazardous industries;
  2. Documents for the formation of an observation case;
  3. Make monthly payments;
  4. Carry out inspections of workshops to identify workers engaged in dangerous work.

At the Pension Fund, employees of the assessment department make an appointment with workers when they reach retirement age. This is necessary for starting a business.

The agency undertakes to monitor production for compliance with standards and requirements once every 6 months.

Conditions of retirement

The profession of a welder is dangerous and difficult. That is why the employer pays an increased insurance contribution to the Pension Fund, and the state allocates the profession to a separate preferential category.

In order to quickly and without unnecessary problems complete all the documents and receive the due pension benefits in a timely manner, you need to make sure that all the conditions for this are met:

  • official employment;
  • correct execution of the work book;
  • indication of the hazard class;
  • the company has certification.

How is a preferential pension calculated for welders in Russia and their retirement age?

How does a preferential pension differ from a regular pension? According to the law in Russia, men retire at age 60, and women at age 55. A preferential pension allows you to circumvent these requirements by receiving your pension ahead of schedule. Workers engaged in hard work, including welders, can hope for a preferential pension.

  1. Compliance with the requirements regarding specialty, profession, position and place of work, which are valid in 2021 according to documents approved by deputies and “preferential” lists.
  2. Must have a certain work experience.
  3. It is important to have a pension coefficient.
  4. If during a special assessment and certification it is confirmed that the welder’s working conditions are truly harmful and dangerous.

How to check your right to a preferential pension?

This question is extremely relevant for everyone who is planning to retire in the near future or wants to calculate in advance whether the period of “harmful” work activity has been reached.

In fact, even before you officially retire, you can find out all this data.

PF may require other documents from OK

PF may require other documents from OK

To do this you need:

  • contact the personnel service at the enterprise and ask to check the entry in the work book;
  • check whether there is a mark on classification, special working conditions;
  • find out whether the employer submits information to the Pension Fund about the subject as a beneficiary. The basis for this should be special increased deductions;
  • Find out about the availability of certification from the employer. A special assessment of working conditions must be carried out and an inspection report must be signed. If general certification has not been carried out, then workplaces must be certified.

Additional terms

The employee must be officially employed. The employer is required to make monthly insurance contributions for employees. Otherwise, the Pension Fund of the Russian Federation will not schedule early retirement. The employer’s responsibilities also include providing a list of specializations with dangerous and harmful working conditions. To do this, an assessment of operating conditions is carried out, and the results are documented.

A special service is invited to conduct an assessment, whose employees determine the presence of harmful working conditions, and the employer is obliged to charge additional contributions for employees.

A properly executed work book plays an important role. If there are errors and an incorrectly recorded position, the person is deprived of the right to early retirement.

Legislation

The general principles for providing citizens with pension benefits are laid down in the following laws:

  • No. 173-FZ dated December 17, 2001;
  • No. 400-FZ dated 12/28/13;
  • No. 426-FZ dated 12/28/13.

If we are talking about old-age benefits for citizens who worked as welders, then the norms of such acts should be taken into account:

  • Decree of the Government of the Russian Federation No. 516 dated July 11, 2002, regulating the procedure for calculating length of service, including in hazardous and hazardous work;
  • List No. 2, approved by Resolution No. 10 of January 26, 1991 of the USSR Cabinet of Ministers.

For information: the name of the welding profession has changed over time.
This led to confusion when granting privileges. The Ministry of Labor of the Russian Federation, in a letter dated August 2, 2000, clarified this issue (No. 3073-17). Download for viewing and printing: Federal Law of December 17, 2001 No. 173-FZ “On Labor Pensions in the Russian Federation”

Subtleties of maintaining personnel documentation

It is necessary to understand that employees of the Pension Fund (PFR), when determining the preferential right to a pension from the budget, act strictly according to the instructions. The latter are compiled on the basis of current legislation. The employee's logic is as follows:

  • privileges due to employment in hazardous or heavy production are granted to persons: those who worked in a profession included in the government list;
  • employed full time, unless otherwise specified;
  • information is taken from entries in work books:
  • the latter must correspond to:
      Instructions for maintaining the worker’s main document (workbook);
  • Unified Tariff and Qualification Reference Book (UTKS).
  • Important: if the position in the document does not correspond to the exact position from the ETKS, then the welder is not entitled to benefits.
    The profession is called: “electric and gas welders engaged in cutting and manual welding, using semi-automatic machines.” Thus, the personnel officer must write the exact name of the specialty in the employment order and in the work book. Otherwise, the person will not receive benefits. Any audit will reveal a violation in the calculation of worker compensation payments.
