Payment of a pension upon the death or disappearance of a breadwinner is carried out within the framework of Federal Law No. 166-FZ of December 15, 2001 and Federal Law No. 400-FZ of December 28, 2013. This type of assistance is paid to the list of persons established by law during the life of the deceased who were dependent on him. Classification of survivor assistance

In case of loss of a breadwinner, a pension of one of two possible types is paid:

  1. Social . Appointed if the breadwinner has not had a single day of insurance coverage. Its size is equal to the minimum regional pension.
  2. Insurance _ Paid if the breadwinner had one or more days of insurance coverage. In this situation, the pension amount is calculated on the basis of points, which will be discussed below.

If the insurance pension is less than the social pension, the latter will be paid. If the insurance company is larger, then that is what they pay.

How is its size calculated?

The rules for calculating such a pension, the basis of which is the insurance part, in the event of the death of the breadwinner are formulated in Art.
15 Federal Law No. 400-FZ dated December 28, 2013 (clause 3). When calculating in general, the formula established by law is used: SPspk = IPK x SPK , where the following data is used:

  • SPspk - the amount of the insurance pension in case of loss of a breadwinner;
  • IPC - individual pension coefficient of the deceased or missing;
  • SPK is the cost of one pension coefficient on the day when the calculation is carried out.

In practice, no questions arise with determining the cost at the time of assigning payments, since this value is fixed, regulated and established at the legislative level. Determining the individual coefficient, as well as how it is calculated, always raises a number of expected problems.

For a correct calculation, the legislative framework should be determined, since the implementation of the pension reform actually established 3 time periods:

  1. 1991-2001 – the calculation is made according to the principles formulated in Law No. 340-1 of November 20, 1990, depending on the length of service and the amount of the “white” salary paid;
  2. 2002-2014 – the effect of the norms of Law No. 173-FZ of December 17, 2001, the calculation is accepted taking into account insurance premiums transferred by the employer and generated by the citizen himself;
  3. from 2015 to the present - according to the formula described above, taking into account the number of pension points.

Since 2015, all insurance savings have been converted into points, the value of which is annually indexed for inflation and fixed at the federal level. For example, if you earn 50,000 rubles/month. for 2021, 5.22 points will be accumulated. One pension point costs 93 rubles from January 1. The minimum pension this year will be assigned if the number of points is at least 18.6, and the work experience is at least 11 years. In 2026, retirement will require 15 years of experience and at least 30 points. In contrast to the above procedure, if a person recognized as a breadwinner at the time of death was already receiving a pension for legal reasons (old age, due to disability), then its amount for dependents is calculated within the framework of the following formula:

  • SPspk - the amount of the insurance pension in case of loss of a breadwinner;
  • IPKu - individual pension coefficient, taking into account which the pension for age or disability was calculated;
  • KN - the number of disabled family members of the deceased breadwinner;
  • SPK is the cost of one pension coefficient on the day when the calculation is carried out.

Pension amount

The amount of benefits due to a relative or family member for the loss of a breadwinner consists of 2 parts. It includes:

  1. Fixed payment (hereinafter - FV), established by law.
  2. Insurance pension for the loss of a survivor, which can be calculated based on the individual pension coefficient (hereinafter referred to as IPC). From January 1, 2018, the cost of 1 IPC point is 81.49 rubles.

Citizens living in the Far North or territories equivalent to it are entitled to an increase in pension in the event of the loss of a breadwinner. Its size is adjusted due to the regional coefficient (multiplied by it) - the indicators fluctuate in the range of 1.15–2 and depend on the subject of the Russian Federation. Applies only during the period of residence of the dependent in the territory of its coverage.

Calculation formula

The size of the survivor's insurance pension is calculated using one of two formulas. The choice of calculation option depends on the status of the deceased at the time of death. If the deceased was a pensioner, the formula PSPK = IPC (1) x SPB is applied, where:

  • IPC – the individual pension coefficient of the deceased breadwinner, applied to calculate his insurance benefit as of the date of appointment;
  • PSPC – payment amounts under the SPC;
  • SPB – the cost of one pension point in rubles on the day the benefit was assigned.

If the breadwinner was not a pensioner at the time of death, the SPK benefit is calculated using the formula PSPC = IPK (2)/CI x SPB, where IPK (2) is the individual pension coefficient accumulated by the deceased on the date of his death. When calculating, the following nuances should be taken into account:

  1. The IPC of deceased parents is summed up when calculating the size of the pension assigned to orphans.
  2. The amount of the IPC can be multiplied by the regional coefficient if the payment is made by a dependent living in the Far North or a territory equivalent to it.

The calculation of the size of the insurance pension under the SPC is based on a static set of rights that the deceased has already earned during his life. Recalculation is possible if there is an increase in the cost of the IPC as a result of indexation, justified by an increase in the inflation rate and the volume of the consumer basket. It is produced according to the formula PSPC = stPSPK + (nIPK/KM/KI x SK), where:

  • PSPC - survivor's benefit after recalculation;
  • nIPK - the individual pension coefficient of the deceased, calculated on the basis of insurance premiums not taken into account at the date of his death;
  • stPSPK – the amount of previous payments as of 31.07 of the year in which the recalculation is carried out;
  • KM – coefficient of the ratio of the standard duration (in months) of the deceased’s work experience on the date of his death to 180 months;
  • KN – number of dependents as of 01.08 of the current year;
  • SC – the cost of the IPC as of the date of recalculation.

Social supplement up to the subsistence level in the region

If the SPC benefit is the recipient’s only income, and its total amount is below the subsistence level (hereinafter referred to as the subsistence minimum) in the region, the pensioner is assigned one of 2 types of allowances. Regional social supplement - RSD - is provided to citizens registered in constituent entities of the Russian Federation with a high price level and a monthly minimum wage higher than the general Russian indicator (for example, in Moscow). The federal social supplement - FSD - is assigned to residents of regions with established minimum wage levels below the average value.

Fixed payment amount

PV refers to a social pension in the event of the loss of a breadwinner and part of the full benefit under the SPC. Minimum size of PV as of 04/01/2018:

Child benefit amount

The amount of benefits received by a child after the death of the breadwinner depends on various factors, for example, the death of a military personnel as a result of the performance of his official duties increases the amount by 2 times. If both parents die or disappear, the child is paid compensation, which essentially consists of two pensions, calculated individually for each of the deceased. If a child loses his mother, who is raising him alone, he should receive a payment based on doubling the mother's pension coefficient.

Minimum survivor's pension

Each family member of the deceased breadwinner, including his dependent child, if he does not have insurance coverage, has the right to receive a minimum payment. Its size is strictly fixed at the legislative level and is updated annually taking into account inflation.

Dependents of the deceased who have at least 1 day of insurance experience have the right to apply to the territorial Pension Fund of the Russian Federation for help in calculating their due pension. Regional surcharge

At the regional level, children left without a breadwinner are entitled to an additional social pension. As a rule, it is assigned in order to equalize the pension paid by law to the minimum subsistence level that operates in the region. This additional payment amounts to the difference between the calculated pension and the subsistence minimum.

Regional authorities are developing additional social guarantees for children who have lost their breadwinner, as persons classified as low-income categories of citizens. Accrual procedure

When reviewing the documents provided, PF employees may request other documents to establish the declared right to a pension and calculate the amount of payments due.

You can submit documents regardless of the period of occurrence of the right to receive pension payments. After submitting the application, after the expiration of the 10-day period, it must be considered and a decision must be made on the accrual or refusal to accrue a pension.

The pension after the death of the breadwinner can be accrued:

  • from the date of death - provided that the application is made within 12 months after that;
  • from the moment of application and submission - in other cases.

Calculation of a pension before the death or recognition by the court of the disappearance of the breadwinner, as well as overpayment of the due amount of the pension, is impossible.

Payments are made on a monthly basis and are made from the next month after the decision is made on the calculation of the pension and its payment. When conditions are met, such as reaching a certain age, the pension payment stops. No additional application is required in this case.

For example, if one of the parents (or both) is lost, the child will receive a survivor's pension until the age of 18. If at this time he is studying full-time at a university, payments will be extended until he is 23 years old.

Procedure and rules of registration

Where to contact

To apply for a benefit under the SPC, you should contact the territorial office of the Pension Fund of the Russian Federation at the place of residence of the applicant, a multifunctional center (hereinafter referred to as the MFC), a post office or, if you need to apply for a military pension, an agency of the Ministry of Defense of the Russian Federation (hereinafter referred to as the Ministry of Defense of the Russian Federation) with a corresponding application. List of required documents

To receive benefits under the SPC, you must prepare a package of required papers. Documents for applying for a survivor's pension:

  • passport of a citizen of the Russian Federation / certificate of registration / residence permit;
  • completed application;
  • birth or adoption certificate;
  • individual personal account insurance number (hereinafter referred to as SNILS);
  • certificate or death certificate of the breadwinner;
  • certificate of service, work book;
  • other documents to clarify the current circumstances:
  1. the reasons for the applicant being dependent on the deceased;
  2. lack of parents/relatives capable of working and providing for the applicant;
  3. the fact of loss of a source of income and livelihood.

Insurance pension structure

The insurance pension paid in the event of the death of the breadwinner consists of the following elements that form its structure:

  • fixed part - established at the federal level, indexed annually and is the same for everyone;
  • insurance part , which is calculated individually for each deceased person.

Regional additional payments made by local authorities, as well as the payment of social pensions, are not included in the structure of the insurance pension and are independent elements of pension and social security for citizens.

Conditions of appointment

The insurance pension for the loss of a breadwinner is paid from the Pension Fund (PFR). It is established if the deceased had an insurance period of any duration. Children are entitled to payments until they reach adulthood or 23 years of age if they are studying full-time.

If you become disabled before the age of 18, financial support will be provided until the child is officially employed or the group is removed. Age does not play a role here.

Parents and grandparents are granted financial support after reaching retirement age or becoming disabled. Brothers, sisters and grandchildren will be able to receive money if they do not have able-bodied parents. In addition, all of the listed citizens, regardless of age, are provided with a pension if they do not work, but care for the relatives of the deceased, until the dependents are under 14 years old.

A state pension for the death of a breadwinner is awarded if the deceased was a military man, an astronaut, or a victim of man-made or radiation disasters.

The source of financing for social pensions is the state budget. It is paid only to the children of the breadwinner until they reach the age of majority or 23 years of age when studying full-time.
