For what diseases are 2 groups given?

The Order of the Ministry of Labor “On classifications and criteria...” dated December 17, 2015 No. 1024n clearly indicates that a person with moderate health impairments can be recognized as a disabled person of the category in question. To be more precise, we mean disorders such as:

• partial inability to move around and use public transport without the help of someone else;
• some disorders related to the ability to adequately perceive the environment, navigate in space, determine the time and place of one’s own presence in it;
• minor difficulties in communicating and establishing contacts, transmitting and receiving information without outside support;
• minor problems with the assimilation, memorization and transfer of knowledge, information, as well as with their practical application, that is, a person can study in a specialized institution or at home;
• restrictions on work that allow him to participate in work under special conditions or using the necessary technical means, help from other people.

Regarding the pathologies for which group 2 is given, one can distinguish, for example, disorders of speech, psyche, tactile sensitivity, vision, hearing, as well as damage to the circulatory system, respiratory system, etc. Some have physical deformities (deformed head, different body parts size, etc.)

In other words, to assign the status of “group 2 disabled” it is necessary that the present problem limits a person’s life activity, affects the general condition, and the applicant for the group himself needs social support and rehabilitation.

Documents for obtaining group 2

Earlier in this material it was already mentioned that in order to assign a group you need to undergo an MSE (medical and social examination). In order for a person’s request to be considered and their health status assessed, the following documents must be provided:

• a referral to the ITU with data on health, compensatory capabilities, the severity of disorders in the functioning of the body and rehabilitation carried out before contacting the members of the commission (a referral can only be taken if you have medical documents not only from the attending physician, but also from the Pension Fund or social security authorities, if the last two organizations refused, the person has the right to immediately go to the bureau);
• application for re-examination (filled out by the applicant himself or his representative);
• passport (copies of pages and original);
• work book (and copy) with income certificate, if the candidate has ever worked;
• outpatient card;
• characteristics issued in an educational institution or at work;
• act on an occupational disease or injury received at work, if any;
• other necessary papers depending on the specific case (the exact list is presented in the Administrative Regulations, which were approved by the Ministry of Labor dated January 29, 2014 No. 59n).

Social disability pension in 2021

Reasons why a citizen may stop receiving a social disability pension:

• The citizen’s disability was not extended or removed;
• The disabled person did not appear at the appointed time for re-examination at the federal institution of medical and social examination - for three months starting from the 1st day of the month following the month in which the specified period expired. After the expiration of the specified three months, the payment of the pension ceases;
• if the established pension is not received for six months in a row - for six months starting from the 1st day of the month following the month in which the specified period expired;
• The death of a disabled person occurs, as well as if he was declared missing in accordance with the procedure established by the legislation of the Russian Federation.

According to the Federal Law of the Russian Federation No. 166 of December 15, 2001 “On state pension provision in the Russian Federation” as amended on December 27, 2018, the following people have the right to receive a social pension for disabled people:

1) The first point is mandatory for all persons listed in point two - permanent residence in the territory of our country.

2) Disabled people of all three groups, also disabled since childhood; disabled children.

Indexation of social pensions is scheduled for April 1, 2020. On average, benefits should increase by as much as 7%. How much is disability group 2 given?

When experts establish a group, the degree of restrictions is taken into account. The complexity of the condition will determine whether you need to undergo re-examination after 12 months. But this procedure is not repeated, that is, group 2 is given indefinitely if the disabled person:

• cancerous (in any part of the body) or benign (in the cerebral cortex) tumor;
• dementia and serious mental illnesses that affect the senses, motor skills, etc.;
• nervous disorders and degenerative brain abnormalities (if the cortex is involved);
• permanent loss of vision or hearing;
• limb defects and amputation.

In general, it is worth noting that group 2 is suitable for those who are capable of self-care. According to experts, the group under consideration may be assigned 1st degree without specifying the timing of recommission, for example, if the height is less than 150 cm, or if there are no fingers. Disability group 2 by general disease

Within the framework of the law, a person has the right to apply for a pension if there are reasons such as:

• injuries, concussions, wounds acquired in childhood due to the Second World War;
• another anomaly that occurred in childhood;
• illness as a consequence of professional activity;
• illness or injury received during service or during the liquidation of the Chernobyl accident;
• other reasons established by law.

In addition, a group is given if a person has become disabled:

• during the period of employment;
• after completing studies or activities at a university, courses, etc.;
• lost his breadwinner;
• served or worked in front-line railway areas, in areas where military operations were taking place, or at airfields, naval and defensive bases, including fighter battalions, platoons and special forces for the protection of citizens.

Experts clarify that to acquire group 2 for a general disease, in addition to medical documents, you will need special ones, for example, certificates from executive committees, extracts from orders, etc. In any case, you need to undergo an ITU so that doctors draw up an examination report and assign the appropriate status, issuing a certificate indicating the group and degree.

Group 2 disability pension in 2021

The first disability group is considered the most serious - it is assigned only to those citizens who have a severe form of illness, injury or congenital malformation that prevents employment and the ability to care for themselves.

If a person, even in simple everyday situations, is forced to resort to the help of loved ones or guardians, because a severe form of illness of internal organs or body systems does not allow him to independently provide for his primary needs, we can say with confidence that the citizen will be assigned the first group of disability.

The conclusion of the medical and social examination on the assignment of the first disability group will be issued to the applicant if:

• a person cannot be responsible for his actions and exercise control over his actions;
• the citizen is unable to maintain communication with people;
• the applicant cannot normally navigate in space and terrain;
• the person cannot walk on his own;
• the citizen has severe health problems due to which he cannot perform even simple housework;
• the patient is completely incapacitated and needs constant supervision from third parties.

Medical indications for which it is necessary to assign the first disability group are:

• blindness, progressive;
• absence of arms or legs or parts of arms and legs;
• periodic epilepsy;
• severe forms of neuropsychic disorders;
• brain disorders;
• paralysis of motor functions;
• disorders of the cardiovascular system and blood circulation;
• oncological diseases that cannot be operated on;
• the last stage of acute tuberculosis.

Pensions for disabled people of group 1 are assigned due to the fact that they cannot earn a living themselves.

Similar to pension payments to disabled people of the 2nd and 3rd groups, the pension of disabled people of the 1st group increases with the age of the citizen and the number of years of official work and consists of:

• basic part (a fixed amount depending on the living conditions of a person and family members living with him);
• the funded part, which is calculated on the basis of the total length of service before receiving the disabled group (the ratio of the insurance period to 180 months is calculated).

The pension for disabled people in 2021 is calculated in the following order:

• disabled people of group I without disabled family members whom they are forced to provide financially (dependants) can count on a basic part of the pension in the amount of 7,820 rubles , plus an allowance for the total number of years of work experience (in the regions of the Far North, the pension reaches large amounts - up to 10,167 rubles of the basic part excluding insurance experience);
• if there are dependents, a pension supplement is awarded up to the amount of 10,427 rubles (if there are three or more dependents, the pension will increase to 11,731 rubles ).

This year, social payments to people with disabilities were increased by 4%, the monthly allowance for group I disabled people is now 3,137 rubles.

Each type of pension provision has its own procedure and conditions for accrual. Payments to disabled people are made in the following order:

1. Group I disabled children and childhood disabled children receive a fixed pension in the amount of 11,446 rubles per month.
2. Disabled people of group I with work experience in the Federal Penitentiary Service who become disabled due to fulfillment of official obligations or within 3 months after dismissal from service will receive a disability or long-service pension (it is not allowed to receive two pensions at once).
3. Disabled persons who have been assigned a disability due to serious injuries during service receive pension payments in the amount of 85% of the amount of their salary (the long-service pension for insurance coverage of more than 20 years will be equal to 1/2 of the amount of the salary + allowances for each additional year of service).

Russian laws provide not only for the payment of disability pensions to people with disabilities, but also for the establishment of the following list of benefits for them:

• free medications from the list approved by the Government (or additional payment to the pension if you refuse them);
• a 50% discount when paying transport tax (only for one vehicle, the engine power of which is no more than 150 hp);
• discount on travel tickets for urban and suburban transport (or additional payment to pension if the benefit is waived);
• free train ticket to any point in the country if necessary to get to the place of treatment and recovery (monetization of the benefit is possible);

Is it possible for disabled people of group 2 to work?

Having a second disability group is not a contraindication to working with minor restrictions. An employee with a disability can only be hired for a position whose work does not contradict the indications in the individual rehabilitation card. Restrictions, as a rule, are introduced on the length of working hours, the intensity and complexity of the work performed, the time and place of the work performed. Regardless of what restrictions are or are not provided for in the rehabilitation card, disabled people are entitled to benefits established by Federal Law No. 181.

Group 3 disability pension in 2021

People with disabilities of group 3 need rest while studying. They may need to use special aids to make learning easier.

Taking into account the increased fatigue that disabled people of the third group may experience, they should limit the load and time they work.

Important! Minor citizens with a disability group, after reaching 18 years of age, undergo a medical commission to confirm this category.

The pension benefit for citizens with group 3 disabilities consists of four parts:

1. Social benefit. Appointed in the absence of work experience to citizens living in Russia.
2. Insurance benefit. Appointed with existing work experience of any length. Having a job and the cause of disability do not affect the receipt of such a pension.
3. Federal benefit. It is prescribed to military personnel, WWII participants and citizens affected by radiation and man-made disasters and astronauts.
4. Additional preferential benefits.

The amount of permanent supplement to the insurance pension benefit, taking into account the increase, will be:

• citizens with disability group 3 who do not have dependents - 2,667.10 rubles. ;
• disabled people of the 3rd group with 1 dependent – ​​4,445.16 rubles. ;
• disabled people of the 3rd group with 2 dependents – 6,223.22 rubles. ;
• disabled people of group 3 with 3 dependents – 8,001.28 rubles. .

Conditions of employment for group 2

A person classified as “group 2 disabled” has the right to work officially, although some nuances apply for such employees. For example, the employer must provide the opportunity to work fewer hours and with an additional break (compared to regular employees). When hiring a person, the recommendations specified in the IPR of a disabled person must be taken into account.

The employer must understand that if there are problems with the internal secretion organs, the psyche and various systems (circulatory, digestive), strong nervous or physical stress will be contraindicated. Mental abnormalities also imply the inability to work in conditions where there is a lot of noise, toxic substances are present, or there is a lot of communication required. For disabled people of group 2, monotonous or fast-paced work is questionable. Height and the need for constant attention are also often on the list of restrictions.

It is interesting that experts did not come to a consensus regarding the performance of work duties on the night shift. The answer to the question “can a group 2 disabled person work at night” will depend on the pathology. For example, a disorder of the digestive or respiratory system, abnormalities in metabolic processes and internal secretion prohibit working at night. Again, the main guideline here is the IPR of a person with a disability.

But exceptions (even if there are prohibitions and corresponding recommendations) apply if the disabled person himself has signed the appropriate consent to certain conditions in terms of working at night or after hours.

Documents for employment

The Labor Code of the Russian Federation (ST.65) states that for employment, in addition to a passport, you need a work book (if this is not a part-time activity or your first job), as well as an education document, SNILS and a military ID (if necessary). That is, it is not necessary to report a disability.

But if a person with disabilities wants to confirm his disability, he cannot do without a certificate from the ITU (it indicates the group and degree of limitation), IPR. Actually, taking into account the information contained in the last document, the employer can create a workplace, etc.

In practice, as a rule, there is no need to make large investments: it is enough to provide a group 2 disabled person with access to the workplace, ensure normal ventilation, the level of illumination, and also, if necessary, install a ramp.

Plus, the disabled person himself has the right to refuse in writing to follow all or part of the restrictions set out in the IPR.

Pension supplements

Disabled people receive not only pensions in the form of social benefits. As a form of monetization (refusal of part of non-material benefits in exchange for monetary compensation), a disabled citizen can receive a monthly additional payment.

The basic amount of EDV is determined for disabled people of the second group and in 2021 is 2701.62 rubles. The first group receives double monthly wages, the rest of the disabled citizens receive half the rate. If a citizen refuses this payment, he can receive benefits as part of the NSO package (set of social services).

Some categories of disabled people may receive additional monthly financial support (DEMO). Only disabled military personnel with Russian citizenship can apply for it. If the total income of a disabled person does not reach the minimum subsistence level established for the region of residence, he can apply for a federal social supplement.

Degrees of disability in group 2

In addition to assigning the specific disability group itself, the degree of disability is also established. As well as disability groups, there are three of them:

First degree

disability is the mildest. The person to whom it is assigned has virtually no restrictions when choosing work, with the exception of difficult, harmful and dangerous conditions.

Second degree

already imposes great restrictions. Such a person needs either a specially organized workplace or special working conditions. The choice of work and their time are also limited.

Third degree

disability is the most severe and implies that a person cannot work. That is, the employer does not have the right to hire such an employee, even with his consent.

Sometimes in a certificate of disability, in the column for the degree of disability, a note may be placed: “does not have”, this means that such a person has practically no restrictions on work ability, but at the same time it is still necessary to establish working conditions that do not contradict the individual rehabilitation card of the patient . Also, such a disabled person retains all the benefits provided by labor legislation.

The maximum period of sick leave for a group 2 disabled person has expired

The only exceptions are citizens whose disability was established on the territory of the USSR before December 8, 1991 - re-examination is not required for them. At the same time, foreign citizens who arrive in Russia do not lose the right to payments at their place of previous residence until the disability pension is assigned in the Russian Federation.

As a general rule, if it is possible to receive both types of payments, a person should choose one. You need to weigh what is more profitable - a pension or benefits.

But the rule has an exception. People who receive government payments - WWII participants, residents of besieged Leningrad and some other categories - have a priority position. They can receive several payments at once.

Yes, according to Federal Law No. 181 of 1995, people with an official disability group can pay half of the cost of rented housing and half of the cost of utilities. The remaining amount is compensated by government subsidies.

Benefits you can count on with disability group 2

For a disabled person of the second group (as is the case with the first group), the paid monthly cash benefit includes disability pension accruals and a monthly cash payment (MCA). The state decides what the pension will be for each group, taking into account the number of dependents, for example, if we talk about young children who are in the care of a person with a disability.

As with people in the first group, people in the second may need individual rehabilitation products, which can be obtained free of charge. These include wheelchairs with orthopedic shoes, hearing aids, and so on.

Also, with both the first and second group, you can count on free help from social workers, for example, with home care. In this case, partial payment for services occurs if the disabled person’s income is higher than the regional subsistence level.
