Who is eligible to receive WWII veteran status?

Veterans of the Second World War are considered to be former soldiers, foremen, midshipmen and officers who took part in hostilities with Germany and its allies in the period from 1941 to 1945 for at least 6 months. The same applies to rear workers who were awarded orders and medals for excellent work during the specified period of time.

  • trainees of combat units, cabin boys who served in active units of the Navy;
  • partisans, figures of underground organizations in the occupied territories;

  • artists who participated in tours to raise morale in the units;
  • civilians who survived the siege of Leningrad.

Note: even if the underground and partisan struggle was carried out on the territory of foreign states, its participants also have the right to count on benefits.

Putin raised pensions for WWII veterans: not everyone will receive payments

The bill was approved by the State Duma on April 18 and the Federation Council on April 22. Now the president has signed it too. In essence, the procedure for calculating pension supplements will change.

Let us recall that to increase pension payments to military pensioners in Russia, the state can use three mechanisms: increase bonuses to monthly payments, increase the payments themselves, or combine old-age payments with disability payments.

Different categories of military pensioners received pensions in different ways. For example, former career military personnel received a pension based on their military rank before retirement: the higher the rank, the higher the length of service, the more substantial the pension. However, the law “On monetary allowances for military personnel and provision of separate payments to them”, which was issued in 2012, equalized all veterans. Both front-line soldiers who went through the war and personnel officers who were not on the battlefield received a reduced pension of 54% of the increased army salaries and allowances. In order to somehow compensate for the underpaid money, the state decided to increase payments by 2% every year until they reach the required amount of payments. But everything is not so smooth: sanctions, crisis. As a result, payments were frozen every now and then. Time passed, and the amount of payments reached 72.2% of the required amount. However, the veterans were not getting any younger. The youngest veterans of the Great Patriotic War are already over ninety years old. You may not get the money you're allotted.

Thus, the new presidential decree cancels this two percent limit when increasing pensions for front-line soldiers. Now their pensions will be paid in full - according to the real allowance of military personnel.

However, the new law will not affect all veterans, since this category includes all people whose lives occurred during the Great Patriotic War.

So, the following will receive a monthly addition to payments:

— pensioners who took part in battles as part of the active army,

- partisans and underground fighters,

- veterans awarded the medal “For the Defense of Leningrad”,

- disabled since childhood due to wounds, contusions or mutilations received during the war,

Payments will not apply to those who served in units or military educational institutions that were not part of the active army in the period from June 22, 1941 to September 3, 1945 for at least six months.

At a meeting with the president in April 2021, Minister of Labor and Social Protection Maxim Topilin reported to Putin that “as of April 1, 74 thousand veterans, disabled people and participants of the Great Patriotic War, direct participants in those events, live in the Russian Federation, and 1.2 million are veterans of the Great Patriotic War, which additionally includes residents of besieged Leningrad, home front workers, and former minor prisoners of fascism.”

According to Topilin, from January 1, 2021, disabled people of the Great Patriotic War receive 43.5 thousand rubles per month, and according to the Russian Pension Fund, in 2021 the average pension of a WWII veteran was 41.5 thousand rubles. It turns out that this year disabled people and combatants will begin to receive about 53 thousand and 51 thousand rubles, respectively. The state will allocate 950 million rubles for payments this year, and another 1.42 billion rubles for payments in the future.

By the way, other participants in the war receive about 35.5 thousand rubles, and residents of besieged Leningrad receive 33.5 thousand rubles each.

Federal laws on veterans of the Great Patriotic War

The main document concerning the status of categories of benefit veterans is Federal Law N5, adopted back in 1995, but repeatedly supplemented. Last changes were made on January 1, 2021.

  1. The second article describes all the characteristics of citizens who may qualify for social assistance.

Categories of beneficiaries

There are two categories of citizens who are entitled to receive assistance from the state:

  1. The direct participants of the Second World War were military personnel and civilians whose activities were related to defense.
  2. Those injured as a result of the fighting are camp prisoners, disabled people (including those killed) and their relatives.

How much will military pensions increase?

Monthly pension: amount

NSO and EDV in 2021

WWII veterans, like all pensioners, are entitled to a range of social services:

  • free medicines prescribed by doctors, as well as medical products (necessary to facilitate life);
  • vouchers to sanatoriums for up to 18 days, if there are appropriate indications from doctors;
  • travel to the place of treatment with 100% compensation from the treasury.

Information: to receive medicines and medical supplies, you should contact the medical institutions at your place of residence with a passport, veteran’s ID and certificates from the Pension Fund on the assignment of benefits. Doctors will review the documents, write a prescription and indicate the location of the pharmacy where you can get the required drug.

But you can refuse benefits. The range of social services has its own cost. The total cost of the entire set in 2021 is about 1,122 rubles. If the entire NSU or some part of it is renounced, this amount will be compensated to the veteran in monetary terms. The refusal must be sent in writing to the social security authorities.

In addition, all categories of veterans and persons equivalent to them are entitled to a monthly payment. The size depends on the characteristics of the status of a WWII veteran.

Calculation of benefits and compensations

To accurately calculate the entire pension payment that must be accrued each month, you should use the general formula:

Kondratiev Alexey Yurievich - WWII veteran. He is 89 years old. He also has a Group III disability, and his total work experience is 55 years. A pensioner lives in Tula. We substitute the following data into the formula:

  • the age allowance is equal to double the monthly payment – ​​5334.20*2;
  • pension coefficient, in our example it corresponds to 72 points (depending on length of service and salary);
  • the cost of one point is 87 rubles - for 2021 (in 2021 - 93 rubles).

Thus, the pension amount = 5334.20*2 + 72*87 = 16932.4 rubles.

Additional payments:

  1. Due to the resulting disability, compensation will be added - 150% of the social pension: 5334.20 * 1.5 = 8001.3 rubles.
  2. Payment as a disabled person during the Second World War for 2021 – 5403.22 rubles.
  3. Additional monthly maintenance - 1000 rubles.

Total: 16864 + 8001.3 + 5403.22 + 1000 = 31336.92 rubles.

What types of pensions can be awarded to veterans?

Currently, payments are provided for WWII veterans for:

  • state pension provision;
  • compulsory pension insurance.

State pension

The procedure for assigning and paying state pensions is determined by the relevant Federal Law - Federal Law No. 166 of December 15, 2001. According to this document, disabled people of all existing groups who are participants in the Great Patriotic War or “blockade survivors,” as well as some other persons listed in Article 4 of the above-mentioned law, can receive government payments. In this case, the reason for receiving disability does not affect the establishment of this type of benefit.

However, if a citizen has become disabled as a result of illegal actions or intentional harm to himself, he is assigned a social disability benefit. In this case, he will no longer be able to count on receiving a state pension.

At the same time, some military personnel who participated in the Second World War may be awarded a pension for length of service. The procedure for its establishment is determined by Law No. 4468-I of February 12, 1993.

Insurance

Before the entry into force of Federal Law No. 400 of December 28, 2013, the insurance benefit was called labor benefit. Citizens who have reached the generally established retirement age and have a sufficient amount of work (insurance record) are entitled to receive such a pension. At the same time, some persons who have worked a sufficient amount of time under certain conditions have the right to retire earlier than expected.

Important: If insurance premiums were paid for a citizen, but subsequently he became disabled for reasons beyond his control, he may be assigned a disability retirement pension. In this case, neither age nor the amount of contributions paid will be taken into account.

How to calculate a WWII veteran’s pension: rules, formulas and calculation procedure

Today, the old-age pension benefit is calculated using a new formula, which means that for persons just retiring, the amount of payments is formed a little differently.

Currently, the formula for calculating old-age insurance benefits is as follows:

  • SP = FV + IPK x SIPC,

Where:

SP – insurance benefit;

FV – fixed payment;

IPC – the sum of accumulated pension points;

SIPC is the value of the pension point at the time of retirement.

Due to the long history of events, WWII participants and “siege survivors” are already receiving a labor pension, but at the time of its calculation the old formula was used. In this regard, after the adoption of Federal Law No. 400, pensions calculated earlier are subject to recalculation. But if the amount received is lower than the established amount, then the final amount of the benefit will remain at the same level.

Disability pension amount

According to Article 16 of Federal Law No. 166, disability pensions for WWII veterans and residents of besieged Leningrad are assigned depending on the size of the social pension according to the following scheme:

At the same time, if a disabled person is dependent on disabled family members listed in Article 8 of the above Federal Law, the amount of disability payments is determined on the basis of the amount of social benefits specified in subparagraph 1 of paragraph 1 of Article 18 of the same document, and increased by 1208, 9 rubles per month for each dependent (but no more than three).

Additional measures of state support and social payments

In addition to the pensions listed above, “blockade survivors” and WWII veterans are entitled to a variety of social measures of state support. Such additional payments include

  • EDV - monthly cash payment;
  • NSO – a set (package) of social services included in the monthly cash payment;
  • DEMO – additional (not included in the EDV) monthly financial support.

One-time and monthly payments

Monthly cash payments are provided in the amount of:

  • 3538.52 rubles - disabled people of group I;
  • 2527.06 rubles - disabled people of group II;
  • 2022.94 rubles - disabled people of group III;
  • 5054.11 rubles - to participants of the Second World War;
  • 2780.74 rubles – to individuals, Fr.

It should be noted that if a citizen has the right to receive a monthly cash payment under one law for several reasons at once, then the payment is established only for one of them, which provides the largest amount.

DEMO

The following categories of federal beneficiaries have the right to receive DEMO - additional monthly financial support:

  • WWII participants - 1 thousand rubles;
  • “Siege survivors – 500 rubles.

As in the previous case, you can receive DEMO only for one of the reasons.

NSO

Another type of social support for older citizens is a set of social services provided to recipients of the monthly allowance and included in its amount.

This state assistance includes services for the provision of additional medical care, the provision of vouchers for sanatorium treatment, as well as the right to free travel on railway transport.

Attention: Those accompanying a disabled person of group I have the right to receive a second free trip to the sanatorium and free travel to the place of rest and back.

The amount of compensation for the funeral of a WWII veteran in 2021

According to Russian legislation, in the event of the death of a WWII veteran, the funeral organizer receives a lump sum payment in an amount equal to 35 times the minimum monthly wage applicable at the time of the death of a particular veteran.

The amount of compensation payments is determined at the time the applicant applied for them. In this case, the following must be taken into account:

  • the amount of social funds allocated by government agencies;
  • cost of services provided;
  • the total amount of expenses reimbursed by the Pension Fund.

The maximum amount of compensation payments today is 38,400 rubles.

To receive assistance, you should contact the social security authorities at your place of registration with a passport, the veteran’s death certificate, and his documents that confirm benefits. In some cases, it will be necessary to prove relationship, for example, if the deceased was not a close relative of the dependent. It is possible to apply for compensation after the burial. Information: the amount of financial assistance for organizing a funeral in Russia in 2021 cannot be less than 5,946.48 rubles.

A WWII veteran died in St. Petersburg. In 2021, his relatives turned to the municipal authorities for help on the basis that their income was 2 times less than the subsistence level. Local legislation (Law No. 101-22 of 2007) provides for a one-time payment of approximately 9,500 rubles. The amount is issued only for the burial of a combat participant.

Indexation at 2% above inflation

It is worth noting that the law on the federal budget stipulates that the indexation of salary for employees of the Prosecutor's Office and the Investigative Committee will be 5.7%. This amendment to the law was developed and introduced by the Government.

Increase in pensions for military pensioners from October 1, 2021

For military pensioners, this means one thing: there will be no increase due to a change in the value of the reduction factor by 2% in 2021. They will continue to receive only 73.68% of their full military pension.

Problems during registration: questions and answers

The Ministry of Defense has not yet transferred the funds to the seller’s account, and, accordingly, they did not have time to register the housing in the State Register. Will the deal be cancelled?

Answer: There are no grounds to cancel the transaction. Once the agreement is signed by both parties, it must be executed in accordance with the law. The RF Ministry of Defense is obliged to transfer the required funds, and you will register the apartment in your name or divide it among all applicants in shares after inheriting.
