In Russia there is a social program to support pensioners, one of its measures is the establishment of such a standard as a minimum pension. Although there is no such term in the legislation, the state’s obligation to provide non-working pensioners with an income level not lower than the subsistence level is spelled out.

Legal basis

In Art. 12.1 Federal Law-178 “On State Social Assistance” dated July 17, 1999, establishes the following rules:

• the level of financial support of a pensioner cannot be lower than the minimum subsistence level of a pensioner (hereinafter referred to as PMP);
• a similar indicator (amount in rubles) is approved in each region annually on the basis of the norms of Part 4 of Art. 4 134-FZ “On the subsistence minimum”;
• if the income level is below the PMP, the pensioner is given a social supplement up to the required amount.

Based on these standards and in accordance with local legislation, the minimum pension was increased in Krasnodar and the Krasnodar Territory from January 1, 2021, as the PMP increased from 8,657 rubles (indicator for 2021) to 9,258 rubles.

Amounts of pension accruals for residents of the Krasnodar Territory

The amounts in the pension statement have different meanings. The state has taken upon itself the responsibility to monitor only the lower threshold of payments.
The rule is this: a pensioner’s income is limited to the subsistence level (it cannot be lower). Pension accruals are divided by law into separate parts. They are:

1. The basic component is the same for everyone. In 2021, its size was 5334.19 rubles. This component is subject to indexing.
2. Insurance is calculated individually and depends on the following indicators:
   length of service (minimum in 2021 - 11 years, by 2024 it will increase to 15 years);
3. individual points (at least in 2021 - 18.6, by 2025 - 30).
4. Additional payments are assigned based on the norms of federal and regional legislation.

Attention: the legislation identifies several types of material support for the disabled. For example, the social pension in the Krasnodar Territory is assistance to persons who did not participate in work, and the insurance pension is compensation for lost income.

Types of pensions for residents of Krasnodar and the entire region

Disabled citizens receive payments from the budget for various reasons.
Appointment criteria also vary. They are: 1. For old age:

a. insurance is assigned if the criteria for length of service and points are met:

1. after 60 years for women;
2. after 65 years for men;
3. at a different age in the presence of preferential grounds;
4. work experience of at least 15 years (this indicator will be relevant by 2024, in 2021 the minimum experience is 10 years, within 5 years it will increase by 1 year annually);
5. 30 individual pension coefficients (in 2021, the minimum amount of pension points was 16.2, the required number will increase annually and will reach 30 by 2024);

b. social :

1. women who have celebrated their 65th birthday;
2. men over 70 years of age;
3. foreign citizens and stateless persons permanently residing in the territory of the Russian Federation for at least 15 years and who have reached the specified age;

• state : assigned to citizens affected by radiation or man-made disasters;
• The state pension for long service is assigned to federal civil servants, military personnel, astronauts and flight test personnel.

2. For disability:

• insurance in the presence of disability and at least one day of insurance experience;
• social in the presence of disability and lack of insurance coverage;
• state is assigned to military personnel, citizens who suffered as a result of radiation or man-made disasters, participants in the Great Patriotic War, citizens awarded the “Resident of Siege Leningrad” badge, and cosmonauts;

3. In the event of the loss of a breadwinner, a pension is entitled to:

• insurance is assigned upon the death of the breadwinner, who was dependent on the applicant for pension provision. The main condition is that the deceased breadwinner has an insurance period (at least one day);
• social is assigned to children under the age of 18, as well as over this age, studying full-time in educational organizations, until they complete such training, but no longer than until they reach the age of 23, who have lost one or both parents, and children of a deceased single person mothers;

4. State pension is assigned to disabled family members of fallen (deceased) military personnel; citizens injured as a result of radiation or man-made disasters, astronauts.

5. The funded pension is paid together with the insurance if the applicant has entered into an appropriate agreement with the Non-State Pension Fund. Persons born after 1966 have the right to such rights.

Statistical data for the Krasnodar Territory

The standard of living of every pensioner is influenced by statistics tracked by the government. The table shows the main indicators as of 2021:

The minimum wage for employees working in the territory of the region, with the exception of employees of organizations financed from the federal, regional and municipal budgets, is set at the subsistence level for the working population per month, excluding compensation, incentives and social payments.

Additional payments to Krasnodar pensioners

Federal and local laws establish additional payments and allowances for beneficiaries. In Krasnodar and the entire region, the following can apply for such:

• participants and disabled people of the Second World War;
• former concentration camp prisoners;
• repressed and rehabilitated;
• home front workers;
• Heroes of the USSR and the Russian Federation;
• labor veterans;

According to all-Russian standards, additional payments are provided for pensioners:

• having dependents (for example, minor children);
• carers for: disabled people of group 1;
• disabled children;
• elderly people who have crossed the 80-year-old threshold.

Attention: all insurance accruals are adjusted to the PM indicator.

How is PMP formed?

Until 2021, there was no approved methodology for determining the regional indicator, which adversely affected the situation and material security of pensioners. But changes have occurred, and the regions have already approved the amount of PMP for 2021 in accordance with the new Rules developed by the Ministry of Labor and approved by Government Resolution No. 975 of July 30, 2019.

What are the advantages of this approach:

1. Unified rules for calculating PMP are being introduced based on local and federal indicators (a specific formula), which does not allow regions to unreasonably underestimate indicators.
2. As a result, regional PMP is growing at the same pace as the federal one.

Due to the introduction of the new procedure, the figure in some regions increased significantly, by 1,000–2,000 rubles at once.

In the Krasnodar Territory, PMP increased by 601 rubles.

New indexing rules

Note that the PMP is not actually equal to the minimum pension (although according to norm 12.1 of the Federal Law-178 it turns out that way), since there are rules for its indexation. From 2021, the pension size is first indexed, but to determine the size of the social supplement, the initial indicator is taken into account, without indexation. For example, a citizen receives 10,000 rubles, and PMP - 11,000 rubles, the social supplement is 1,000 rubles. Taking into account the indexation of pensions in 2021 for non-working citizens by 6.6%, the following calculation is obtained: 10,000 x 1.066 + 1000 = 11,660 rubles.

Thus, the size of the minimum pension in 2021 is determined by region, taking into account local PMP and indexation.

What determines the amount of benefits in the Krasnodar Territory

Pensions in Krasnodar are divided into several types. Depending on this criterion, the amount of security is determined.

Government authorities have a responsibility to monitor the minimum payment value.

The legislation clearly states that the amount cannot be below the subsistence level established in the recipient’s territory of residence.

There are several components of the manual:

1. Fixed amount. This value has equal expression for all recipients of government assistance. In 2021, the figure is 5,686.25 rubles.
2. Supplement to pension. Payments can be financed from the federal or regional budget, depending on the basis for the accrual.

When calculating insurance benefits, you need to take into account several indicators.

1. having a minimum length of experience (in 2021 this value is 10 years, next year it will increase by 1);
2. accumulation of the required number of pension coefficients - in 2021 you need to have 18.4.

The social pension in Krasnodar is paid to those persons who have not worked during their lives or have not accumulated the required amount of individual industrial complex by the time they retire.

To obtain this status, you must reach the ages of 65 and 70 years. These indicators are given for female and male representatives, respectively.

The situation of working pensioners

Separately, we note that the minimum pension in the Krasnodar Territory in 2020 is not established for working pensioners, since it is believed that the citizen provides himself with additional income at the place of work.

Indexation of pensions for working pensioners based on Federal Law-385 has been “frozen” since 2021. But it is carried out after dismissal in accordance with the standards of Federal Law-400.

Some pensioners, in order to receive a larger pension, quit for some time, and then, with the consent of the employer, take up the same job again. According to the rules of clause 88 of Order No. 885n of the Ministry of Labor of Russia dated November 17, 2014, in this case the pension must be recalculated on the basis of the employer’s reporting, and the latter may be fined (if there is intent, such judicial practice already exists).

If the breadwinner was officially employed, then the insurance portion is added to this amount. The amount of this part is calculated taking into account the IPC of the deceased accumulated during official work, as well as the value of the pension point at the time of payment. Twice a year, the survivor's benefit is indexed. Payments can be made to the Pension Fund or MFC by writing an application and supplementing it with a passport, SNILS and papers confirming the relationship with the deceased, who was the breadwinner.

• those who have worked in agriculture for thirty years are entitled to an increase in payments by twenty-five percent;
• for those who support disabled relatives, payments will increase by a third for each dependent, the number of which should not be more than three.
