Payment for major repairs by pensioners: how to receive compensation and subsidies


Since 2012, the monthly transfer of contributions for major repairs, carried out according to schedule, is the responsibility of each owner of a privatized apartment.

The collected funds pay for the cycle of those major repairs that make it possible to qualitatively and thoroughly restore the safe technical condition of the apartment building and ensure its safety.

The obligation to pay the contribution applies to all adult homeowners, but there are some payment benefits granted to pensioners. From a certain age they receive compensation for repair payments and can be completely relieved of it.

How is compensation for major repairs issued to persons over 80 years of age, and who is entitled to such assistance from the state? You should find out this information in advance so that when you reach retirement age you do not overpay for utility bills.

Categories of citizens

ATTENTION! Not only pensioners, but also other categories who have grounds for such assistance can receive compensation for major repairs and payments for their implementation. The benefit may be provided in the form of compensation.

And in Moscow, pensioners pay for major repairs immediately using reduced payments. This difference by region is not significant, because in any case it makes it possible to reduce financial pressure from the public utilities sector.

Not only pensioners, but also disabled children, those families raising a disabled child, and disabled people of the 1st and 2nd groups themselves must pay with benefits. Compensation or subsidy for retirement homes is paid by the government.

Only those categories that fall under the benefits need to formalize everything correctly and collect the necessary documents.

At what age do pensioners not pay for major repairs?

To receive benefits for 80-year-old pensioners for major repairs, it is not enough to reach the specified age. If you are over 80 years old, you will not automatically receive benefits. To do this, you must submit an application and also attach a list of required documents.

There are also a number of conditions under which benefits are issued, which management authorities pay attention to:

  1. A pensioner who has reached the age of 80, is unemployed and lives alone, is entitled to receive a 100% discount.
  2. If a pensioner lives alone, is not able to work, and is over 70 years of age, then he is entitled to receive a 50% discount.
  3. If an elderly couple lives together, one of whom is over 70 years old and the other over 80 years old, and is also disabled, then they are exempt from payments.
  4. Disabled people of groups 1 and 2 who have a dependent disabled child are given a 50% concession.

Benefits Law

The basic rules for the provision of benefits are regulated not by a decree, but by the country’s Housing Code. According to it (Article 169), the amount of benefits and the list of categories that receive them are determined at the regional level. But the main categories are the same for different regions. These include:

  • pensioners;
  • disabled people;
  • families with disabled children;
  • large families;

The benefit is calculated based on the standard living space, which, at a minimum, should be per citizen.

In some regions, the preferential area is determined to be 33 square meters. m, in others it may be slightly more or less.

Conditions

Do pensioners pay full contributions for the upcoming major renovation of their apartment building? When an elderly person reaches the age of 70, he can qualify for significant compensation under payments for major repairs.

The discount can be significant, up to 50%. Pensioners over 80 years old receive a 100% discount. But how to get the discount that the law on contributions for major repairs gives, what documents are needed for compensation? Some conditions for providing compensation should be taken into account.

  1. The pensioner must be disabled.
  2. Live alone or with other disabled persons.
  3. The apartment must meet the requirements established by housing legislation.
  4. It is important that the person applying for benefits does not have any debts for utility services.

How to get compensation for those who owe rent? There is a way out in such a situation, you just need to first contact the management company, housing office, and agree on an installment plan to repay the debt. Then it will be possible, on the basis of an installment agreement, to draw up documents for benefits.

Who is compensated

Many pensioners are perplexed when faced with the situation of refusal of monthly cash compensation (MCC) for major repairs due to errors in the data provided. There are established rules according to which a 50-100% discount on payment for the service is provided. The criteria that local authorities rely on are as follows:

  • If a pensioner is over 80 years old, lives alone, does not work, then he receives a 100% discount.
  • If a disabled Russian over 70 lives alone, you can get a 50% concession.
  • If a married couple of elderly unemployed people live together, one of whom is over 70 years old, the other over 80 years old, then there is no need to pay for major repairs.
  • If a pensioner over 80 years of age and other people, one of whom is under 70, live together or are registered in the same territory, the benefit is not provided, since an elderly citizen is not considered single.
  • People who are disabled people of groups 1 and 2, raising a disabled child, are given a 50% reduction in payment for the service.
  • If there are debts for payment of housing and communal services, the subsidy is not provided.
  • The house in which the applicant lives must be subject to major repairs, and the area of ​​the apartment must be within the established social norms for the applicant to have the right to apply for a subsidy.

Ownership of the apartment

One of the main conditions for providing compensation for payment for services is that the housing is in full ownership of the applicant. The pensioner must have documents confirming that the premises belong exclusively to him; there are no other homeowners who own shares of this real estate. If it is established that the apartment is divided between people, one of whom is over 80 years old, and the others cannot claim the benefit, then the subsidy will not be provided.

Living alone condition

Compensation is provided if a pensioner who has reached 80 years of age lives alone. The concept implies that the person applying for the subsidy is registered in the specified living space alone or with another person of retirement age who is entitled to the subsidy. For example, if a citizen over 80 years of age is the sole owner of the premises and lives with his wife registered there, whose age has exceeded 70, then a subsidy is issued. If the spouse is under 70 years old and is registered in the apartment, then the benefit will not be provided.

Many citizens living alone are perplexed when they are denied compensation. We must understand that government agencies do not base their decisions on the real state of affairs, but on documented data. If, in fact, one pensioner over 80 years of age lives in the apartment, but, according to the house register, two or more people, grandchildren, relatives of active age are registered in the living space, then the subsidy will not be issued. After these citizens are discharged from their living quarters, they can apply for compensation.

No debt for housing and communal services

For many people, the main obstacle to receiving a discount or exemption from fees for major repairs of an apartment building is the timely payment of utility bills to the housing department. If a citizen has not made a monthly payment, then the debt will accumulate like a snowball with fines and penalties accrued. A person is forced to take out loans to pay off debts. A pensioner applying for exemption from payments for major repairs must provide information about the absence of debt for utility bills.

Some regions provide cash compensation to senior citizens instead of exemption from payment. The payment receipt includes this expense item, with an obligation to make payment in full. After payment, the money is returned to the citizen’s card, or, in the form of cash, is transferred to the payer by postal employees delivering the pension.

Registration procedure

If compensation for major repairs is due to older people, where should they go to apply? First, you should find out which categories in the region are included in the list of preferential benefits.
You can find out more information at the social protection authorities or at a convenient multifunctional center located in the region. An application for compensation is submitted there. A convenient option is to make an application through the State Services website .

But you should definitely be sure that all conditions are met, not rent arrears. How much money will be compensated for the payment depends on the age of the pensioner or on the characteristics of the apartment and its area.

Required documents

  • You need to write your application correctly. There is a standard form on the State Services website; you can also see a sample at the social security department or at the MFC.
  • An extract is provided indicating that there is no rent debt.
  • There must also be a statement indicating that the first payment has been transferred for major repairs. If the house is a new building, payments for major repairs will be accrued no earlier than 5 years after commissioning.
  • A passport will be required.
  • Documents regarding ownership of the apartment are also needed.
  • It is also important to have a document that accurately confirms your right to a benefit in paying contributions for major repairs.

This package is also supplemented by those certificates that indicate the person’s incapacity for work and the absence of other persons with ability to work (living with him) in the house.

The benefit is issued only to the owner who has reached 70 or 80 years of age. If a pensioner who may be a beneficiary lives with able-bodied relatives, he will not receive the due discount.

It should also be taken into account that compensation is issued to the owner; those who live under a rental agreement can no longer count on such help from the state.

Benefits after 80 years

For pensioners after 80 years of age, the state awards some benefits automatically, and some should be applied for independently by personally contacting the services or through an official representative by proxy. Part of the subsidies depends on the physical condition of the citizen, region of residence and personal merits to the state.

Housing and communal services

Elderly people over 80 years old are provided with a 50% discount on utility bills. To obtain it, you should contact the MFC with the following documents:

  • a certificate containing information about the financial situation of the pensioner and those living with him;
  • documents for privatized residential property, in the case of renting a state-owned property - an agreement with the lessor.

Before contacting the MFC, you must make sure that there are no debts to pay for utility services. When requested, provide information or certificates of payments for previous months.

Benefits for purchasing home ownership

Before concluding a contract for the purchase and sale of living space, a pensioner over 80 years of age is granted a tax benefit by the state for the previous 4 years. Until 2012, only working citizens received such a subsidy, but now pensioners can also take advantage of this right.

This government subsidy can be used up to 12 months after the conclusion of a real estate purchase and sale transaction. If a pensioner whose age is 80 years or older continues to work, then he has the right to count on a refund of tax contributions made to the budget for all the previous 4 years.

Payments for major repairs

A senior citizen 80 years of age or older is exempt from paying amounts provided for major housing repairs. Such state relief is provided for in Article 169 of the Housing Code of the Russian Federation. In order to take advantage of the benefit, a pensioner should contact the MFC with the following package of documents:

  • a general passport certifying the date of birth and identity of the citizen;
  • SNILS;
  • a payment document confirming payment for the previous month, confirming the absence of debt for an earlier period;
  • pension;
  • house book;
  • a written application from the pensioner to suspend payment or reimbursement of a previously paid amount;
  • the current account number where to return overpaid funds.

At the same time, you should provide receipts for payment of other utilities to confirm your status as a good payer.

Tax benefits

Tax benefits for pensioners after they reach 80 years of age are prescribed in Articles 395 and 407 of the Tax Code of the Russian Federation. This category of citizens receives the right to the following benefits from the state:

  • income tax is not waived for working citizens;
  • land tax is not charged up to an amount not exceeding 10 thousand rubles;
  • no real estate tax is paid if the pensioner owns one property, the rest are subject to taxation;
  • if a pensioner owns a car with an engine of up to 100 hp, then he is exempt from vehicle tax;
  • exemption from payment of state duty when applying to court for the right to own housing, the cost of which does not exceed 1 million rubles.

Public transport

Labor veterans, WWII veterans and disabled people can count on discounted travel on municipal route transport. Travel is free for them. Other pensioners are provided with discounts or a limited number of free trips. Senior citizens-pensioners can apply for a travel card, and then part or all of the paid amount will be returned to the card. The amount of the refund depends on municipal and regional decisions made in a given region.

Veterans, former military personnel and employees of the Ministry of Internal Affairs travel free of charge on suburban transport and electric trains. The amount of benefits for other categories of pensioners is regulated by local authorities.

Rail travel for pensioners is 50% cheaper. For those who live in the Arctic and similar regions, the state provides free tickets to travel to resorts located in Russia twice a year.

To receive a transport card for free travel, a disabled person or a WWII participant must provide supporting documents: a passport and a pension certificate.

Russian pensioners do not receive benefits for purchasing air tickets, but airlines have the right to independently offer discounts or bonuses to this category of citizens. If a senior citizen flies frequently, he or she may want to consider getting a debit card with miles.

Private companies engaged in transportation around the city: minibuses and taxis do not provide benefits to any categories of citizens.

Benefits for medical care

Pensioners aged 80 years and older receive benefits for medications and paid medical services. To receive a discount when purchasing medicines, a citizen must provide a pension card and a prescription from the attending physician, in this case the discount will be 50%.

In the case when a person over 80 years of age needs sanatorium-resort treatment, the state provides him with free travel to the place, if the sanatorium is located in the same region where the pensioner is registered. A citizen has the right to apply for a voucher to a medical resort institution at the expense of the state once every 2 years. To do this, he should collect for the PF:

  • documents confirming the need for treatment;
  • pension;
  • general passport;
  • a written request.

The state reimburses pensioners for the cost of all dentures except dental ones. In medical institutions, they have the right to see a doctor without a queue or an appointment, and if they are unable to come in person, they can count on a doctor coming to their home.
