FSD for pension: what is it, how to calculate, conditions for payment

Pensioners who live in our country, unfortunately, do not always receive a pension that is enough to live on. From the point of view of the law, such a pension is defined as an amount of funds that is below the subsistence level. So that pensioners could somehow make ends meet, a special additional payment to the pension was invented. What is it and how to get it, we will look further in our article.

What is FSD for retirement?

So, FSD stands for Federal Social Surcharge. The establishment of this additional payment is made to pensioners who have stopped working due to the onset of a specific age threshold, illness or other reasons. However, it is very important that one condition be met: the pensioner must receive a state payment (pension), the amount of which does not correspond to the minimum cost of living that is relevant for a particular subject of our country.

It turns out that if a pensioner receives the minimum possible pension, then the state must pay him an additional certain amount of funds, which will allow him to receive the very minimum living wage that one person needs to survive in our country.

Of course, quite often the subsistence level is not enough for a decent existence, but these funds can at least allow a pensioner to survive.

Social supplement to pension for non-working pensioners

One of the ways to provide state social assistance is a social supplement, which is made towards the pension of non-working pensioners . This type of government support is significantly different from others, as it covers a wide range of people, increasing their level of material well-being.

For the first time, such a concept as a social supplement (SD) to a pension was introduced on January 1, 2010 in connection with the adoption of the Federal Law of the Russian Federation of July 24, 2009 N 213-FZ, which amended the Federal Law of the Russian Federation of July 17, 1999 No. 178 -FZ “On State Social Assistance”.

Long debates about the fact that a pension cannot be less than the subsistence level (ML), and multiple appeals by low-income pensioners to the courts, have led to the emergence of a new type of support - a social supplement to pensions .

How is the amount of the Federal social supplement to pension determined?

To determine the amount of the Federal social supplement added to the pension of citizens living in our country, the following monetary payments are taken into account, which, according to the legislation of our country and its individual regions, are established for pensioners:

  • the amount of the pension itself;
  • the size of all additional sources of material support of a social nature;
  • monthly payment of funds (in particular the price of a set of social services);
  • other measures of legally established social support that have a monetary value (for example, payment for telephone communications of a pensioner, payment for utilities and housing, payment for the use of all types of transport), excluding those measures of social support that are provided to pensioners at a time.

If a pensioner already receives a large pension and other social benefits, then most likely he is either not entitled to a pension supplement or is entitled to a very small one.

Taking into account the amounts of these payments will inversely affect the amount of the surcharge. So, if all of the listed accruals have a maximum amount, then the Federal social supplement will decrease, and vice versa, if the pensioner received really small amounts before its appointment, then it will be large in order to compensate for the lack of funds at least to the minimum level, that is living wage.

If the amount of all accrued material support for a pensioner is the minimum subsistence level, but the basic pension is less than this amount, the citizen is no longer entitled to a payment, since in this case he will not be officially considered poor.

Please note: the amount of the cost of living in each individual region of the Russian Federation will vary, therefore, if, for example, you have studied only the average amount of this payment in the country, you may later be surprised when you receive the wrong amount of funds, therefore, it is better to clarify the exact amount of the surcharge in advance.

What is a social supplement to pension?

A social supplement to a pension is a payment to a pensioner whose total amount of material support does not reach the subsistence level , up to the specified amount. This additional payment is made to low-income pensioners from the federal budget. It does not depend on the type of pension and the citizen’s personal contribution to its size.

Its main difference from financial assistance, which, as a rule, is targeted and paid in a lump sum, is that it is established and paid monthly until the pensioner gets a job or the amount of his income reaches the minimum wage.

Let’s look in more detail at what is included in the total amount of material support (income) of a pensioner and what the subsistence level is. When determining the right to a social supplement, the pension provision paid consists of the following types of payments:

  1. All types of pensions , including through law enforcement agencies.
  2. All types of monthly cash payments (MAP), (disabled people, veterans, family members of victims (deceased veterans, Chernobyl survivors, as well as categories equivalent to them), including a set of social services (NSS) (travel in suburban transport and to the place of treatment, medicinal provision, sanatorium-resort treatment, even if received in kind).
  3. Additional material (social) support (payments for various services to the Fatherland - Heroes of the Soviet Union and the Russian Federation, order bearers, etc.). It is not entirely clear why the legislator provided this clause, since this category of honored persons has an amount of material support that significantly exceeds the subsistence level. Social support measures established by regional authorities (except for those provided at a time).

The total income of a pensioner does not include measures of social support that are provided in kind , except for the cash equivalent of paying for the telephone, residential premises, housing and communal services, as well as travel on passenger transport of all types (urban, suburban and intercity).

Petrova E.V., born in 2005, is the recipient of an insurance pension in the event of the loss of a breadwinner in the amount of 7,400 rubles. In addition, the regional law granted her the right to free travel on city public transport, the monetary equivalent of which is 421 rubles. The total amount of payments to Petrova E.V. to determine the right to social supplement is: 7400 + 421 = 7821 rubles.

How are the social allowances in question assigned and paid?

Receiving an allowance, like all other social payments in our country, is of an application nature. In other words, funds will be credited to you only if you appear at the relevant government authorities with a statement indicating a request to receive a payment.

At the same time, as you remember, only non-working pensioners have the right to submit an application, since working people are considered able-bodied.

The assignment of payments will be made starting from the first day of the month that followed the previous 30-day calendar period within which the pensioner applied for the accrual of the specified payment.

Please note: the only situation in which the Federal social supplement is assigned without a declaration relates to children. At the same time, these children will also be pensioners, only in this case their pension will be assigned not due to reaching a certain age, but for the following reasons:

  • due to children having disabilities;
  • due to the fact that children who have not reached the age of majority, that is, the age of 18, have lost their breadwinner.

Thus, pensioners applying for this payment can be not only old men and women, but also people of much younger age. Moreover, regardless of which category you belong to, the Federal social supplement will be established for you for the same period as the main pension, in accordance with the letter of the law.

So, for example, pensioners who retired due to the fact that they have reached a certain age (in our country this age threshold is now 60 years for women and 65 years for men) will receive this additional payment as long as their pension is valid, that is, until the end, essentially, of his life.

The same persons who have lost their breadwinner and receive a pension due to being a minor will receive this additional payment until they turn 18 years old, since, according to the law, at this age they will already have reached working capacity and will be able to support themselves.

Social supplement to pension

If the total income of a pensioner, which consists of the pension itself and various social payments, turns out to be lower than the annual minimum subsistence level for a pensioner (PMP) in the region of his residence, then in such a situation a social supplement to the pension is provided. Thanks to this, the state’s obligation to maintain the level of income of Russian pensioners not lower than the established minimum is fulfilled.

At the same time, a distinction is made between federal and regional social supplements to pensions. They differ in the following points:

— the place of application for the purpose of this payment.

It should be noted that the amount of such an additional payment is individual for each citizen, taking into account his specific income level. Only pension recipients can expect the right to such assistance from the state if a number of conditions are met, and the type of pension provided does not matter. The validity period of the social security payment is equal to the period for which the pension itself is assigned, if during this time the conditions confirming the right to receive it are met.

Should pensions be paid up to the subsistence level?

The activities of the Government of the Russian Federation are aimed at improving the quality of life of Russians, increasing trust in government and maintaining a stable situation in the social sphere. The state guarantees citizens of the Russian Federation the receipt of a minimum cash income subject to certain conditions. A unique measure for comparing the level of income of Russians, including pension payments, is the cost of living.

This indicator is established per capita for three categories of citizens:

The values ​​of these quantities are determined in accordance with Law No. 134-FZ of October 24, 1997 “On the subsistence level of the Russian Federation.”

The cost of living is a subject of constant debate in society, as it does not fully reflect the real life and needs of a person. However, its significance is great and is intended:

— to assess the standard of living of citizens;

— to establish the amount of social benefits at a minimum level;

- for budget formation.

The estimated size of many pension payments established in our country sometimes does not even reach the minimum. In this regard, it is simply necessary to pay extra to pensioners so that they can provide themselves with what they need.

The value of this indicator is not constant and depends on the cost:

— food set necessary for normal human life support;

— a minimum set of non-food products;

— a set of services necessary to meet the social and cultural needs of a person;

— expenses for mandatory payments and fees.

The PMP indicator is calculated once a quarter, and data on this is then published in official publications. However, to establish social benefits, the cost of living is established once a year: for the regions by separate resolutions, at the federal level - by the budget law.

The value of PMP is determined at two levels: federal and regional. The procedure for establishing this indicator is also different:

- in the first case, it is regulated by the Government of the Russian Federation as a whole for the country;

- in the second case, it is determined on the basis of local laws for a specific subject of the Russian Federation.

What is a social supplement to a pension?

Social supplement to pensions was introduced in our country on January 1, 2010 with the introduction of amendments to the current legislation, namely Art. 12.1 Federal Law No. 178 of July 17, 1999 “On state social assistance.”

This payment is established strictly under certain conditions:

— residence on the territory of the Russian Federation;

— receiving a pension in accordance with the legislation of the Russian Federation;

— the recipient is a non-working pensioner;

- the total amount of payments he receives is below the PMP value established in the region of his residence.

Here it is important to specify what makes up the total amount of financial support for a pensioner:

— any type of pension payment;

— additional material support (ADS), including payments for special merits to Heroes and WWII veterans;

— monthly cash payments (MCB), including the cost of a set of social services;

— measures of social support in monetary terms, including payment for using the telephone, utilities, travel on all types of passenger transport.

The following payments are not taken into account when calculating the total financial support of a pensioner:

— social support measures established in kind;

Thus, a social supplement to a pension is the amount paid to non-working pensioners if the pension payment assigned to them is less than the minimum subsistence level established in the region of residence.

If a pensioner has stopped working, he can also apply for a social supplement, provided that he receives a total amount of cash payments that is less than the minimum monthly wage in his area of ​​residence.

Types and amount of financial assistance

Depending on the source of funding, the following types of financial assistance are distinguished:

— federal — paid through the Pension Fund of Russia at the expense of the federal budget;

— regional — paid by social security authorities at the expense of the local budget.

The amount of social supplement is established on the basis of data on the pensioner’s cost of living and changes in two cases:

— when changing the value of the PMP in the region of actual residence of the payment recipient;

- when changing the amount of any payment taken into account when calculating the total amount of material support for a non-working citizen.

Federal social supplement

Social supplement at the federal level is assigned subject to two conditions:

— the total amount of material support is below the subsistence level applicable in the region of residence of the citizen;

— the value of the regional PMP is less than the minimum for the country as a whole.

You should apply for federal social benefits to the territorial office of the Pension Fund of the Russian Federation at your place of residence.

The value of the federal PMP for 2021 is set at 8,726 rubles. The cost of living for a pensioner for the same year in the Vladimir region is 8,452 rubles, which is lower than the subsistence minimum in the country as a whole.

Let us assume that the amount of material support for a non-working pensioner from the same region is 7,500 rubles, which is lower than the PMP established in the Vladimir region. Accordingly, such a citizen will be provided with a federal social benefit up to PMP in his region in the amount of 952 rubles:

8726 - 7500 = 952 rubles.

Regional social supplement

The amount of additional payment at the regional level is assigned under the following conditions:

— the total amount of material support is lower than the PMP value established in the region at the place of residence of the pensioner;

— the value of the regional PMP is higher than the value of this indicator in the Russian Federation as a whole.

You should apply for regional social security payments to the territorial social security authority at your place of residence.

Where to apply for identification?

The additional payment is paid from the 1st day of the next month after applying for it with all the necessary documents. An exception is made for disabled children and minors who are entitled to a survivor's benefit (insurance or social). They are assigned a social supplement from the date of assignment of such a pension without a declaration, provided that the right to it arises.

An application for additional payment is made depending on its type:

— to the territorial body of the Pension Fund when assigning a federal supplement;

It is important that in order to assign the amount of additional payment, you must fill out the appropriate column in the application for the establishment of a pension or transfer from one type of payment to another.

The period for establishing the social supplement is equal to the period for which the corresponding pension payment is assigned. When you get a job or change your place of residence outside our country, the right to financial assistance is lost.

To apply for financial assistance, you must prepare the following documents:

— identification of the citizen and his place of residence;

— pension insurance certificate;

- a document confirming the absence of the fact of work.

Payment of the amount of financial assistance is carried out according to the schedule simultaneously with the established pension payment.

It is the responsibility of the pensioner to promptly notify the Pension Fund of the Russian Federation about employment or changes in other circumstances that entail a recalculation of the amount of additional payment or its termination.

In what cases is the payment of the Federal social supplement suspended?

Payment of FSD towards pension may be suspended. Unfortunately, there are many different reasons for this. Let's look at them further in the table.

Thus, if a pensioner encounters circumstances that deprive him of the right to receive this bonus, he must inform the Pension Fund of our country about this, and immediately. This applies to all cases of employment, training, employment and other situations that would entail changes associated with this additional payment.

Provided that the recipient of the Federal social bonus does not bring any notice to the Pension Fund directly in the month of employment or does not verbally declare that appropriate temporary or permanent changes have occurred in his life, the territorial body of the Pension Fund will be forced to take all possible measures aimed at compensation amounts of the Federal social allowance.

Only those amounts that were paid to the pensioner excessively and through his fault in the framework of legal proceedings, if required, will be reimbursed.

Registration of social supplement up to the subsistence level

The assignment and payment of FSD is carried out by the bodies of the Pension Fund of the Russian Federation on the basis of an application , which is submitted simultaneously with the assignment of a pension, or after the right to receive it arises, to the Pension Fund of the Russian Federation at the place of residence.

The assignment and payment of RSD for pensions is carried out by the social protection authorities at the place of residence. The information necessary to assign additional payments is transmitted from the authorities that own the information automatically, without the participation of the pensioner .

Thus, the pensioner is only required to submit an application. No certificates confirming the presence or absence of payments included in the total income of the pensioner taken into account when determining the right to social benefits are required.

When receiving any type of social benefits, the pensioner is obliged to immediately notify of all circumstances entailing termination of the right to receive social benefits, such as:

  • apparatus employed;
  • departure for permanent residence outside the Russian Federation;
  • moving to another region, etc.

Of course, in order to have an idea of ​​how much extra money you will be paid, you need to roughly understand what the cost of living is for a particular region of our country. As we have already said, the amounts for each subject, although slightly, vary, and as a result, the amounts of additional payments will also differ slightly. The Russian subsistence minimum (MSP - for pensioners) has always been a subject for discussion and criticism, if not a reason for ridicule. It is clear that its size has little correlation with real life. However, it is with this that the income of the population, including pensions and wages, is compared. It is established separately for three categories of the population: able-bodied citizens, pensioners and children. In addition, the cost of living is different for all regions. It is calculated and approved by local authorities independently.

The principle of assigning this payment is simple. If the amount of the assigned pension is less than the PMS established in the region (subject of the federation), then to the amount of the pension the Pension Fund must assign an additional payment (financed from the federal budget) in such an amount that the total amount of the pension received is equal to the PMS. Moreover, if the amount set in the region is higher than the total for the country, then in addition to the federal budget this additional payment is financed by the regional authorities.

As a result of this formulation of the question, it is clear that in the vast majority of regions of our country it does not exceed the federal size.

Thus, for 2015, the federal PMP was set at the level of 7,161 rubles, while only 18 subjects of the Federation set it higher than the federal level and pay extra from their budget.

The spread in the amount of payments across the country is quite large (more than 100% relative to the average) - from 6 thousand rubles in the “poorest” regions to over 15 thousand rubles for the Chukotka Autonomous Okrug. Let us note that at the end of 2014, the federal PMP amounted to only 6,354 rubles, i.e. in 2015, the cost of living of a Russian pensioner increased by 12.7%. For reference: the Ministry of Economic Development forecasts consumer inflation at the end of 2015 at 10%, i.e. theoretically, the increase in PMP should cover the increase in prices.

Let's sum it up

The federal social pension supplement is a kind of monetary support from the state to pensioners who are below the poverty line, that is, they receive money that is not enough to have at least a monthly subsistence minimum. This additional payment, in fact, serves to “hold out” the pension to the required subsistence level. Unfortunately, it is not used in every case, and this must be taken into account. And also remember that payment may be suspended at any time.
