For doctors and teachers, much will remain the same. The list of these categories of persons is established at the level of federal legislation. They are discussed in detail and the benefits that these workers may qualify for are discussed in this article.

Classification

List No. 1 and List No. 2 of preferential professions for early retirement were introduced by a legislative act of the Presidium of the Supreme Soviet of the USSR, which has not lost its force to this day, therefore these lists are used to determine recipients of preferential pensions in modern Russian practice.

This type of document is not regulated in any way by law, but is only a requirement of the Pension Fund. But you will not be able to submit reports if your company involves professions and positions that give you the right to early retirement.

Professions that make it possible to receive a pension earlier than the generally established period are listed in paragraphs. 1-18 hours 1 tbsp. 30 of the Law of December 28, 2013 No. 400-FZ - these are the so-called lists 1 and 2. But for an employee to receive an early pension, the presence of his profession in these lists is not enough; it is also necessary to reach a certain age and have sufficient work experience, and the employer in relation to such employees is obliged to transfer “pension” contributions at a special additional rate. To monitor these indicators, it is required to submit a report to the Pension Fund for preferential professions.

In 2021, the disability pension will be awarded to workers whose profession involves dangerous and harmful working conditions. The list of such professions is approved in the relevant regulatory documents. The calculation of payments is regulated by the Law “On Insurance Pensions” No. 400-FZ of 2013. The conditions for the employee’s departure and the calculation of pension payments are clearly stated here. The new draft pension reform does not provide for adjustments to these circumstances, so the right to receive early payments remains unchanged for workers.

Preferential disability pension in 2021

For Russian citizens working in difficult and hazardous working conditions, in underground work or in hot shops (the so-called list No. 1, list No. 2 and “small lists” of hazardous professions in the Russian Federation), the legislation provides for the possibility of early retirement if they have a specified amount of special length of service The retirement age for these categories of workers is established according to a special grid, depending on the type of work activity performed , as well as on the number of years of accumulated “harmful” experience .

  • mining operations (construction of tunnels and subways, open-pit mining of minerals, etc.);
  • work in difficult and harmful conditions (food and light industries, production of medical products, gas, peat, oil, etc.);
  • work in transport (railway, city, sea, aviation).

  • all types of underground work (geological exploration, extraction of minerals in mines and mines, laying subways and tunnels, etc.);
  • work in hot shops (glass melting, non-ferrous and ferrous metallurgy, production of ceramic products by firing, etc.);
  • work with very hazardous to health and difficult working conditions associated with oil refining, production of electrical equipment, production of ammunition and other similar things.

For men who have worked in professions from list No. 1 for at least 10 years with 20 years of insurance experience, the retirement age has been reduced to 50 years. Women on list No. 1 receive the right to early retirement at the age of 45 if they have 7.5 years of work experience in particularly hazardous work and 15 years of insurance experience. If employees worked in the above-mentioned industries for less than half of the annual working hours, then they are given a pension according to list No. 2.

What does the law say?

The issue of pension benefits, security, and access to rest is regulated by Resolution of the Cabinet of Ministers of the USSR dated January 26, 1991, number 10 “On approval of Lists of production, work, professions, positions and indicators giving the right to preferential pension provision.”

Although this normative act relates to a state that no longer exists, it was edited to adapt to new realities. The edition is dated October 2, 1991.

The law is in force in Russia, which is the successor to the USSR, to this day.

Lists 1 and 2, which will be discussed later in our article, are approved by the said Resolution and are applied in the event of early assignment of an insurance pension due to old age. This point is determined by Art. 30 of Federal Law No. 400-FZ “On Insurance Pensions”. The procedure is fixed in Decree of the Government of the Russian Federation No. 665 of July 16, 2014.

Thus, the list of preferential professions provides guarantees for citizens who worked (or are still working) in heavy and hazardous industries to receive preferential pensions and social security. Reasons for early retirement

This refers to poor-quality working conditions or the achievement of a specific status.

In the first case, this means working in a difficult environment for a long period of time. The employee has the right to expect early termination of work.

In the second case, this is an early pension due to a special working condition.

As we have already said, lists of professions were developed during the Soviet era. From that time to this day, two lists are relevant.

As part of the pension legislation, early retirement is provided for the following categories of citizens:

  • women who gave birth and raised more than 5 children;
  • parents who have children who are disabled at an early age (though this only applies to either mom or dad
    );
  • visually impaired – first group;
  • disabled due to military trauma;
  • persons suffering from various forms of dwarfism;
  • persons with work experience in the Far North.

Those who have worked for a long time in circumstances dangerous to life and health have similar rights.

“Preferential” lists of professions: differences, guarantees

Most of the enterprises and organizations in our country do not have favorable conditions for their employees. That is why the state is deliberately trying to provide these individuals with early retirement due to the harmful effects of working for a long period of time at certain enterprises. 2 lists were published representing positions and professions applying for a preferential pension.

Their differences are the following facts:

  1. List 1 – professions that are most dangerous to health are indicated.
  2. List 2 – professions are not so dangerous, but more difficult.

Additional benefits and benefits according to the second list

Despite the fact that people who perform work from one of these lists are guaranteed to receive early retirement, they are also entitled to a certain number of benefits, namely:

  1. Additional preferential paid leave on an annual basis;
  2. Salary increase;
  3. Free trips to sanatoriums and health centers.

Important! Benefits can be assigned at different levels, and can also be modified. But the assigned benefits cannot be reduced.

Lists of preferential specialties

Next, we will study in more detail the issue of the previously mentioned lists, enshrined in law in Resolution No. 10.

“1”

The specialties from this list have a common feature: they are associated with working conditions that are hazardous to life and health.

To receive a pension the following conditions must be met:

  1. For men, work experience in hazardous work is from 10 years. Then the employee goes on vacation at 50.
  2. For women, the special experience must be at least 7.5 years, the general insurance indicator must be at least 15 years. The minimum age is 45.

Overall, a full ten years are gained for both women and men when compared with standard retirement conditions.

What types of activities are implied:

  • Atomic industry;
  • paper and pulp production;
  • interaction with radioactive substances;
  • mining;
  • production of explosives;
  • production of building materials;
  • beneficiation, roasting, agglomeration of ore;
  • metal processing;
  • gas and oil processing;
  • printing;
  • production of non-ferrous and ferrous metals;
  • production of electrical equipment;
  • work related to coke (coal);
  • work related to generator gases;
  • transport service;
  • creation of chemicals;
  • creation of glass and artificial fibers;
  • energy.

These are all the points that are enshrined in the Resolution for the first list.

“2”

A characteristic feature of the list is that it contains specialties related to work in difficult conditions.

To receive a pension, the following nuances must be observed:

  1. For men, the special experience should be 12.5 years. The total insurance time is 25. Then the employee goes on vacation at 55.
  2. For women, special experience must be at least 10 years, the general insurance indicator must be at least 20 years. The minimum age is 50.

The fact that a citizen is employed in one of the areas of labor indicated below is, in most cases, sufficient to confirm with an entry in the work book. If there are times when a certificate is required.

What types of activities are implied:

  • mining;
  • activities in the field of communications;
  • oil production and refining;
  • production of coke, coal;
  • production of hardware;
  • metallurgical production;
  • ore beneficiation;
  • food industry;
  • production of refractories, gas generators;
  • production of medicines;
  • work with mercury substations;
  • working with printing inks;
  • repair of electrical equipment;
  • maintenance of power trains and steam power plants;
  • construction and reconstruction;
  • peat mining.

The pension is assigned based on harmful working conditions.

Early pension by category

All organizations must conduct special assessment activities to check the degree of danger of working conditions and their harmfulness

for the health of specialists.

This obligation is enshrined in the Federal Law “On Special Assessment of Working Conditions” dated December 28, 2013 No. 426-FZ - in Article 14.

Based on this assessment, the employer forms and makes contributions to the Russian Pension Fund. It turns out that the higher the danger posed by certain factors at work, the larger the amounts paid.

It happens that detailed analytics are not mandatory. In its absence, the employer has the right to make payments on a general basis. In other words, in this case he is guided by the provisions of lists 1 and 2

, which involve the calculation of percentage bonuses based on the actual salary level: 1 - 9 and 2 - 6 percent, respectively, for each of the lists.

If an organization evades payment of these monetary benefits to its employees, sanctions are provided - administrative liability and fines.

How to calculate a pension according to harmfulness

The preferential disability pension in 2021 is calculated. To calculate the amount of future accrual according to list No. 2, use a formula that has the following form - Spsk = IPK*SPK, where:

  • SPsk – old-age insurance pension;
  • IPC – pension coefficient, determined individually;

The individual pension coefficient (IPC) is determined by the following formula – IPC = IPKs+IPKn, where:

  • IPKs is the size of the insurance part of the labor pension (without a fixed base amount) divided by the SPK. Accrued for time worked until January 1, 2017(18);
  • IPKn is the sum of the SPK, which are determined annually, starting from January 1, 2015

The allowance for professions included in list No. 1 is calculated using the following formula – SP=IPK*SIPC*K+(FV*K), where:

  • SIPC – total pension amount;
  • SIPC is similar to SPK;
  • K – coefficients of bonus accruals, depending on the time for which the application for accrual of a pension was delayed.;
  • FV - a fixed payment from February 1, 2021, amounting to 4805.11 rubles. As can be seen from the formula, all elements included in it are multiplied, with the exception that the product of the fixed payment and the bonus coefficient is added to the total product of the remaining components.

In practice, there is a close relationship between the individual coefficient and wages, so the IPC is calculated using the following formula - IPC = SV/SVmax*10, where:

  • SV – the amount of insurance premiums transferred by the employer during the year;
  • 16% of the maximum base for calculating contributions, which changes annually.

Surcharge

The preferential pension for harmfulness in 2021 is accompanied by an additional payment assigned in accordance with Article 219 of the Labor Code (Labor Code) of the Russian Federation and is guaranteed for employees who are directly involved in work processes associated with harmful and dangerous factors, where their influence on the body is inevitable. The type and amount of compensation amounts is determined at the discretion of the employer on the basis of the norms prescribed in the Labor Code of the Russian Federation. As a rule, the amount of the surcharge is more than 4% of the wages of employees engaged in labor operations under normal conditions.

Pension specifics for men and women

The assignment of pension benefits depends on a number of factors, such as:

  • severity of harm received or received at work;
  • individual pension coefficient;
  • citizen's gender;
  • seniority.

Retirement age limits are different for men and women. This is where the difference in pension schemes comes from.

Practice shows a long-observed trend: representatives of the “weaker sex” live longer. This point has to be taken into account in legislation, which explains the existence of proposals to equalize ages. So far, these regulations have only draft forms, so in fact, women retire earlier than men.

Nuances for different categories of workers

There are four categories of professionals for whom special pension conditions are provided.

Unemployed

The law guarantees that any worker who remains unemployed due to staff reduction or liquidation of an institution has the right to demand early provision of a pension. An additional argument here is the inability to find a new job in the specialty.

In this case, it is necessary that the “unemployment experience” be at least 3 months. It is also important to have a minimum work experience to receive pension benefits.

Residents of the Far North

We are talking about early retirement here.

What conditions must be met:

  • having a minimum working experience;
  • reaching retirement age;
  • availability of a certificate confirming the fact of residence in an area hazardous for work;
  • availability of a certificate confirming the fact of minimum work experience in the Far North.

It is also important to take into account the age factor. It is necessary to take a well-deserved rest on time.

Small peoples

Small nationalities include those that have no more than 50,000 people.

If representatives of such national communities do not have time to complete the required length of service, they receive pension assistance provided in advance.

Rights in connection with these circumstances are enshrined in Article 11 of the Federal Law of December 15, 2001 No. 166-FZ “On State Pension Security in the Russian Federation”.

To receive payments, you need to confirm:

  • their belonging to a small nationality;
  • the fact of residence in a certain territory.

Documents – passport, birth certificate.

Teachers

The list of positions to which benefits apply includes:

  • educator;
  • director;
  • deputy;
  • manager employee;
  • speech therapists;
  • organizers of extracurricular activities;
  • educational psychologists;
  • representatives of the direction of additional education;
  • teacher;
  • employees of music educational institutions - schools and colleges;
  • teachers working in schools.

Pension benefits here also depend on a number of other factors, such as length of service.
