Legal regulation

  5. payment for travel by rail to the place of treatment and back. A ticket to the sanatorium and travel expenses are also provided to the person accompanying the disabled child. For disabled people of group 3 since childhood, such a privilege is not provided.

Who is granted group 3 disability?

The 3rd disability group is assigned to a person suffering from physical or mental health problems. A disability group is assigned after a diagnosis is made by a doctor.

Disability limits a person's activities, so the state provides additional payments. A person with the third group of disabilities is limited in the choice of profession and career growth, therefore not only material support is provided, but also social support.

Legislative regulation of the issue

Having disability group 3, a person retains the opportunity to work and enjoy social benefits with certain benefits. The procedure for registering disability

The group in the Russian Federation is determined within the framework of the MSEC (medical and social expert commission). This procedure can be carried out on the direction of the attending physician or on the patient’s personal initiative (he informs his doctor about his intention to undergo MSEC). If assigned to group 3, the disabled person is given two important documents - an individual rehabilitation program and a certificate of disability. To obtain the required preferences, you should contact the Social Protection Fund. Then you need to write a pension application to the Pension Fund.

Types of payments and benefits for disabled people of group 3

The pension payment can be social, insurance or state. To calculate the funds, take into account its type and the root cause of the status. For example, to provide an insurance pension, the recipient’s work experience is important. In addition, the assigned group and the basic rate are taken into account. Note that the minimum fixed payment (FAP) to the insurance pension for group 3 is equal to 2227.55 rubles, and the social benefit from April 2021 is equivalent to 4491.30 rubles.

Social benefits for disability group 3

Each disabled person is allocated 889.66 rubles per month for medicines. For rehabilitation and treatment in a sanatorium they give 137.63 rubles, and for travel to a place of recovery - 127.77 rubles. All this is included in the set of social services (NSS), which can be abandoned in favor of money, in order to receive on average 1,155 rubles in addition to the pension (depending on what services will be excluded from the benefit package).

Relief for citizens with group 3 disabilities provided by the Ministry of Taxes

Tax concessions apply only to the disabled person. According to the 2021 tax legislation, citizens with physical disabilities are generally exempt from payments to the insurance fund. The contribution when purchasing a car is paid 100% in connection with possible employment.

Disabled citizens of 3 groups have the right to:

  • receive a subsidy to pay for electricity, water, gas, garbage removal;
  • do not pay tax when purchasing real estate;
  • purchase land with concessions;

Taxation

Russia provides tax benefits when hiring disabled people for employers who willingly take advantage of them. In this case, tax benefits are allocated for enterprises and organizations where disabled people work in relation to property and land taxes. In fact, they do not pay taxes, but only if the following conditions are met:

  • if the organization was formed by a society of disabled people and among the workers there are only people with disabilities;
  • if the organization managed to hire people with disabilities, who make up 80% of the total number of employees;
  • if the organization contains 50% of people with disabilities and wages are 25% of the available salary fund.

There are also additional discounts on the payment of certain types of taxes for companies created by a society for the disabled:

  • Organizations created by a society for the disabled are fully exempt from VAT, and the staff of workers with disabilities is 80%;
  • are completely exempt from paying income tax - in accordance with Article 264 of the Tax Code of the Russian Federation;
  • full discount on the payment of property and land taxes in accordance with Articles 381 and 395, respectively.

You can receive benefits immediately as soon as the required number of employees with disabilities has been recruited. Information on the acceptance of employees is submitted to the Federal Tax Service, where they indicate whether the employee has a certificate.

In this case, there are no restrictions regarding the type of organization that is ready to hire employees with disabilities. Here are the following benefits:

  • Transfers to the Pension Fund are reduced by 21%;
  • the tariff for the Social Insurance Fund is reduced by 2.4%;
  • payments to the Federal Compulsory Medical Insurance Fund are also reduced by 3.7%.

There are no additional benefits for the company. You can get discounts by submitting documents to the FSS office.

Companies can also take advantage of government subsidies, which are aimed at providing assistance in the form of compensation for additional costs. Costs may include all monetary expenses intended to create a workplace for a worker with a disability. Funds are transferred to the company’s account in accordance with the generated report.

Please note: For example, if a company driver is injured resulting in a disability, he may be transferred to another position or the control mechanism in a work vehicle may be altered so that the disabled person can continue to work in the same position. Remaking a car will require investments, which will be partially or fully covered by the state.

Contributions to the company's capital are subject to restrictions as follows:

  • if it was necessary to create a place to work for a disabled person of group 1, then the state will transfer a maximum subsidy of 100 thousand rubles;
  • for people with group 2 disabilities - the maximum amount is 72 thousand rubles;
  • for workers with group 3 disabilities - 65 thousand rubles maximum.

At the same time, you can also receive payments from the employment center if company managers wish to create appropriate conditions for workers with disabilities. In this case, you can make maximum use of a budget of 500 thousand rubles per workplace.

It is not only company managers who have privileges regarding the employment of a worker with a disability. A whole list of requirements for the working conditions of a disabled worker has been compiled. The hiring of a person with disabilities must take into account the following concessions:

  • working hours, rest time, number of vacation days comply with the requirements of the Labor Code of the Russian Federation and cannot be less;
  • the number of working hours per week does not exceed 35 for disabled people with groups 1 and 2, while their wages are not reduced - they receive the same payments as workers who work 40 hours per week;
  • if an enterprise is forced to work on an irregular schedule, an employee with a disability must give consent to this - in writing and in the absence of harm to his health;
  • in matters of what other benefits a disabled employee is entitled to, mandatory paid leave is allocated - it is 30 days, in contrast to the established 28 days per year;
  • disabled people have the right to receive their due sick leave on an open sick leave certificate with appropriate payments;
  • persons with disabilities have the right to refuse business trips and work hours at night.

They also provide the opportunity for a disabled worker to go on vacation for 60 days, but only the required 30 days will be paid.

Separately, you should consider the question, if the child is disabled, what benefits at work the father or mother is entitled to. Here are the following subsidies from management:

  • when staffing is reduced, an employee with a disabled child is not affected;
  • a single mother or father receives the right to retire 5 years earlier than the required age;

  • There is a tax incentive of 13% of 12,000 rubles.

Depending on the additional status - low-income family or large family - additional benefits are awarded.

In order for the employer to provide the guarantees and benefits established by the state, a disabled employee must provide two certificates during employment: ITU and IPR. Having received such documents, the employer provides the special conditions necessary for work and leisure. In addition, according to the IPR certificate, the employer will establish the work schedule for the disabled person, workload and regularity of rest.

When hiring employees with health limitations, the employer enters into an employment contract with them. Compared to a contract for ordinary employees, such a contract will have several features. For example, such an agreement must stipulate preferential working conditions in accordance with current legislation. For disabled people and persons with limited abilities, a longer vacation of at least 30 calendar days is provided (181-FZ).

At the request of a disabled employee, he can also be granted leave “at his own expense”, the duration of which can be as much as 60 days. To do this, the employee needs to write an application, and the employer cannot refuse such leave.

Depending on the disability group, the length of the employee’s working week is also distinguished. For example, for group 3 it is 40 hours, and for groups 1 and 2 – no more than hours per week.

The working conditions provided by the employer must comply with the IPR specified in the certificate provided by the employee. If the data in the IPR is not enough to determine the characteristics of the workplace, the employer has the right to resort to the Sanitary Rules, which contain recommendations regarding this issue.

For employers who employ disabled people, there is a set tariff for insurance premiums for injuries. They charge contributions for NS insurance from amounts paid to disabled people at a reduced rate: equal to 60% of the established insurance rate (Law No. 419-FZ of December 19, 2016).

Some employers are reluctant to hire people with disabilities. In this case, they are brought to administrative responsibility. Thus, for an organization that does not create jobs for people with disabilities, the fine is 5–10 thousand rubles. In addition, fines are also provided for the fact that employers do not provide information to the employment service about hiring disabled people. In this case, the fine for an organization will be 3–5 thousand rubles, and for an official – 300–500 rubles.

The employer's activities in providing jobs to persons belonging to preferential categories are controlled by the Rostrudinspektsiya. Moreover, at the local level, the implementation of both all-Russian and regional standards and compliance with the rules of the corresponding level are checked. Responsibility for violation of federal acts is provided for in the articles of the Code of Administrative Offenses (CAO). So. Violation of the deadlines for the provision of primary statistical reporting is punishable under Article 13.19. Its text contains information about penalties imposed on:

Concessions to disabled citizens of group III provided by housing and communal services

Medical benefits

Cash payments represent an important measure of support from the state. In particular, the beneficiary can receive:

Indexation of social and labor pensions

Pension payments to disabled children are indexed on April 1, 2021. The increase factor is 3.4%, that is, the following changes in numbers will occur:

— holders of group 1 and children with disabilities of group 2 will receive 11,593 rubles;

— citizens with group 3 will receive 4927 rubles.

Benefits related to work activities

The employer is required to create the necessary conditions at the enterprise described in the labor code.

Group 3 disabled people who are able to work have the right to take advantage of the privilege of a 60-day vacation when traveling to a sanatorium, resort or planned treatment.

The working week is no more than 40 hours, and the maximum lifting weight is 2 kg (according to the Labor Code of the Russian Federation).

Like other employees, disabled people of group 3 are allowed to work in production on weekends, holidays, and at any time of the day.

The law prohibits the dismissal of an employee at the initiative of the employer.

Benefits for working disabled people of group 3

If a disabled person of group 3 has found the desire and opportunity to find a job, he is entitled to a number of labor benefits, which the employer has no right to ignore. A working disabled person of the third group is entitled to additional benefits related to working at an enterprise:

  2. The right to demand from the employer the creation of favorable working conditions, taking into account the specific situation of a group 3 disabled person. The performance of work duties should not have a negative impact on the employee’s health.
  3. If a group 3 disabled person is unable to be at the workplace for the entire working day due to poor health, the employer is obliged to provide him with the opportunity to work in a part-time shift or week (at the employee’s choice).
  4. An employee with a disability has the right to take annual leave at any time of the year, regardless of the vacation schedule.
  5. If a disabled person of group 3 meets the employer’s requirements, he is obliged to hire him without assigning a probationary period.
  6. An employee assigned to disability group 3 may be assigned to night shifts only with his written consent. If a disabled person does not give consent, coercing him under pain of dismissal is prohibited by law.

Driver with a disability

Until recently, the procedure for the use of parking space by a disabled person in a parking lot was not prescribed in the legislation. Nowhere were they informed about the requirement to have an identification card or that not everyone is allowed to put on the “Disabled” sign. The sign was installed on a car where a disabled citizen was periodically transported. Traffic police officers had the opportunity to fine any car for illegal parking, regardless of whether a disabled person’s license was present. It was not included in the list of documents presented by the driver to the traffic police inspector.

Who has the right to use a free parking space:

  • a guardian (parent, relative, 3rd person) has the right to use it;
  • free parking is provided for only one car;
  • parking spaces are marked with a special sign.

According to the new traffic rules of the Russian Federation, it is provided for attaching a sign to a car if a citizen with a disability is inside. Penalties for violation are provided in the amount of 5,000 rubles.

Transport advantages

For disabled people 3 gr. free travel on public transport (bus, metro, commuter train) is provided. Taxis and minibuses are not considered social transport; the trip is paid in full.

Russian Railways gives a 50% discount on a train ticket (Aeroexpress, Lastochka) across Russia round trip once a year or for 1 free trip every 2 years.

According to the legislation of the Russian Federation, air travel for people with disabilities provides benefits, but in reality there are none, since most airlines are private companies. The plane ticket is paid for 100% of the amount.

A special category of people with disability group 3

Special categories of people with disabilities include:

  1. Disabled children from childhood who remain with the status for life.
  2. Military personnel who took part in combat military operations (Great Patriotic War, Chechnya) and received injuries of varying degrees of severity, preventing them from living a normal, fulfilling life.
  3. Disabled workers who have become disabled due to an accident at work or as a result of an occupational illness.
  4. Pensioners of the Ministry of Internal Affairs.

Disabled military personnel have the same benefits as disabled people of group 3, but with minor additions.

An unemployed WWII veteran or Chernobyl survivor has the right to draw up the necessary documents free of charge. This is free travel on city public transport and a half discount on the cost of a train ticket. Medicines are also purchased free of charge.
