A change of surname usually occurs due to a change in marital status (marriage, divorce) and requires the bearer of the new surname to replace their passport. If he has a driver’s license (DL), then there is an additional need to replace his license when changing his last name in 2020. To understand whether it is possible not to change your rights when changing your last name, you should familiarize yourself with the regulations of the Government of the Russian Federation. Resolution No. 1097 dated October 24, 2014, which regulates access to driving vehicles, established the obligation of citizens to replace their driver’s license in connection with a change of name. The advantage of this method is that through the portal you can make an appointment at the traffic police department at a time convenient for the applicant. In addition, you can submit an application and pay the state fee online at a discount, but you will not be able to avoid a visit to the traffic police department, since you will need to submit documents in paper form.

To replace rights, you can use one of three options:

  1. Traffic police The car owner is sent to the traffic police with an application and the papers mentioned above. With this option, you can change your rights if your last name changes during the day. All issues are resolved in one window.
  2. MFC. The second way is to contact an intermediary organization. In this case, it takes longer to replace the ID – up to nine days. To reduce time costs, it is recommended to take a coupon earlier. If events develop successfully, you can submit your application and documents the next day. By comparison, there are longer queues at the traffic police department, and you often have to wait up to 30 days for your time.
  3. Via the Internet (the registration process is discussed in the next section).

Sometimes it is possible to refuse to issue new documents. Then the traffic police will return the papers, and the MFC employees will confront the applicant with a fait accompli.

To save time, you can carry out the procedure online using a PC. To do this, you need to go to the State Services website and complete full registration. After this, the driver enters information into the form for the traffic police and information from the package of papers. The next step is a personal visit to the traffic police, submitting certificates and obtaining a new certificate. In terms of time and level of complexity, the online registration option is the most attractive.

  2. Pay the state fee and prepare documents (this can be done before making an appointment).
  3. Come to the traffic police department, submit an application and documents.
  4. Take a photo (this will be taken by a department specialist).
  5. Receive a ready-made UI.

What documents are needed when changing rights

  • old VU;
  • medical certificate.

The amount of the state duty when replacing a driver’s license in 2020 is established by the Tax Code of the Russian Federation (Article 333.33):

  • for the standard version of the national VU 2,000 rubles;
  • for a new generation national university 3,000 rubles;
  • for an international university 1,600 rub.

When submitting an application online and paying through the State Services portal, replacing rights when changing your last name costs 30% less.

The procedure for making changes to the PTS

Before submitting documents to the MREO inspector, you must pay the state fee for replacing the vehicle title. This can be done at any bank branch. .

In accordance with the latest changes in the legislation of the Russian Federation (from January 1, 2015), the amount of the state duty for carrying out legally significant actions (amending the PTS) is 350 rubles. Through the State Services website 245 rubles.

A traffic police officer in a situation where the car owner was unable to change the data in the title in time, draws up an administrative protocol in accordance with the Code of Administrative Offenses of the Russian Federation (Article 19.22), explaining this as a violation of the registration of documents for the vehicle. Therefore, it is quite easy to challenge such a protocol in court. But it will be easier to contact the MREO in time and change the data rather than argue with the inspector, much less go to court. Therefore, it is better not to delay the data replacement procedure.

Having collected copies and originals of the above documents, the car owner must contact the MREO. There is no need to provide or show the car itself. After the application, a PTS with changed data is issued or it is replaced with a new one (if there is no space for entering new data). Usually the document is received on the day the application is submitted. The exception is a situation that requires additional verification. At the same time, the maximum period for issuing a vehicle passport has been established - no more than 30 working days from the date of application.

It must be remembered that when changing your last name, along with changes in the PTS, you need to change your driver’s license, vehicle registration certificate, compulsory motor liability insurance policy and a number of other documents. It is advisable to do this within the period established by law in order to avoid fines.

Penalty for late replacement

Clause 35.b of Resolution No. 1097 classifies a driver’s license that does not reflect the owner’s changed personal data as invalid. Therefore, driving a car with such a document means committing an administrative offense (Clause 2 of Article 12.3 of the Code of Administrative Offenses of the Russian Federation). Punishment for this is a warning or a fine of 500 rubles.

However, in practice, it is not always possible to determine that the driver’s last name has changed, but his ID has not been changed. After all, the traffic police inspector often demands to present a license, a vehicle certificate and a compulsory motor liability insurance policy, and not a general passport, which will reflect the driver’s new name. But if somehow it turns out that the name in the VU is not relevant, then sanctions cannot be avoided. To prevent this from happening, it would be correct to refrain from traveling until you receive a new document.
