Amount of lump sum payment upon retirement of a civil servant

I often hear talk that when an employee retires, he is paid a large sum of money at once, but I would like to understand whether such payments are made to all retiring employees or is this exclusively a privilege for civil servants?
The main federal laws governing these legal relations include: It should be noted that these laws consider general provisions. Considering that payments for length of service are provided from local budget funds, many municipalities adopt their own bills regarding the conditions of appointment and the amount of established amounts.

Federal Government Employees Pension

In accordance with the legislation of the Russian Federation, certain categories of citizens, due to the performance of functions that are especially important for the state, have the right to receive financial support upon retirement on special grounds. A civil servant's pension is payments received as a result of long-term work in positions in the state federal service. The amount of this pension provision depends on the duration of the corresponding work (experience) in the public service. Federal employees have the opportunity to receive a pension, which is established in accordance with three legislative acts - the laws “On State Pension Provision”, “On the State Civil Service” and “On Insurance Pensions”. "

Who are federal civil servants?

A federal civil servant is a citizen who carries out professional activities in a federal civil service position and receives a salary for this from the federal budget. It is worth remembering that not every public sector employee is a civil servant. These can be considered those who are endowed with power, administrative and managerial functions , employees of executive bodies of state power. All features of the federal service are determined by Federal Law No. 79-FZ of June 27, 2004 “On the State Civil Service of the Russian Federation.”

Conditions for granting pensions to federal employees

Citizens have the opportunity to receive pensions only under certain conditions (death, disability or old age). These conditions cannot depend on the will of the citizen. A long-service pension for a civil servant is established if the following conditions are simultaneously met :

  • Government experience service for at least 15 years (was in 2021).
  • Dismissal for one of the following reasons:

      government staff reduction employees or liquidation of federal agencies;
    • dismissal from positions due to termination of their powers by persons;
    • reaching maximum age;
    • due to poor health, which prevents continued service;
    • dismissal at will due to retirement.

    The right to state pension benefits accrues to persons who have worked in federal civil service positions for at least 12 months .

    This rule does not apply to those dismissed during the liquidation of the state. authority or staff reduction.

    Raising the retirement age for civil servants from 2021

    On May 11, 2021, the State Duma of Russia adopted a law that increases the retirement age of government employees to 65 years for men and 63 years for women .

    The increase in the retirement age will be gradual - it is expected that from 2021 it will increase every year by six months until it reaches the required level.

    Thus, the maximum values will be reached in 2032 for women, and for men already in 2026.

    In addition, in order to receive a state pension for long service, civil servants must work for 20 years , instead of the previously established 15.

    advantages in raising the retirement age :

  1. Qualified personnel are retained, which are difficult to find due to the annual decrease in the working-age population.
  2. This is a significant budget savings.
  3. Alexey Kudrin (ex-Minister of Finance of the Russian Federation) has repeatedly stated that this innovation will be followed by an increase in the age for receiving an old-age insurance pension for ordinary citizens (now it is 55 and 60 years, respectively). The only thing is that it is still unknown to what level the increases will be carried out and whether the retirement age will be equalized between men and women or not.

    This has been discussed in the Government for a long time and it is assumed that such measures may be taken starting in 2019 , i.e. after the presidential elections scheduled for March 2021.

For example, in St. Petersburg, increases are provided for persons who have more than 10 years of experience as a civil servant and are native residents of St. Petersburg. How to calculate future pension payments? In order to independently calculate the amount of future payments, we will give a clear example of calculations: For example, citizen Ivanov A.A. is applying for a pension in 2021. The period of work activity is 25 years. Salary - 5000 rubles.

Amount of pension contributions

The average size of pension payments for civil servants is 25,000 rubles . In this case, the region in which the civil servant works plays an important role.

It is important to know! Additional payments for pensioners over 80 years of age

As a percentage, the size of the pension depends on wages. Thus, for 15 years of service, a civil servant is assigned 45% of wages. For each year of work over 15 years, a government employee receives 3% of the basic pension. The maximum amount is 75% of wages.

In addition, the amount of payments increases due to annual indexation. Thus, in April 2021, the pension was indexed by 4%. In February 2021, a recalculation of 6% is planned.

Local authorities have the right to establish additional allowances for civil servants. For example, in St. Petersburg, increases are provided for persons who have more than 10 years of experience as a civil servant and are native residents of St. Petersburg.

How to calculate future pension payments?

In order to independently calculate the amount of future payments, here is a clear example of calculations :

For example, citizen Ivanov A.A. is applying for a pension in 2021. The period of work activity is 25 years. Salary - 5000 rubles.

Calculations:

5000 * 2.8 (salary coefficient) = 14,000 rubles - the amount of the salary part; 14000*75% = 10,500 – pension amount 75% – service coefficient.

The pension amount is 45% of the average monthly salary plus 3% for each year over 15 years of service.

The maximum figure is 75% , which is taken into account in the above calculations.

One-time payments upon retirement to civil servants

That is, in essence, the same 26 percent (Article 425 of the Tax Code of the Russian Federation) of the salary that the future pensioner transferred for the last year will be added to his preferential pension for length of service in the civil service, divided into smaller amounts, given that the pension for The civil servant will receive length of service not for a year, but for the rest of his life or transfer to an old-age pension.

  • Experience - from 15 years . The length of service will increase annually by six months.
  • The age of pensioners (2021) is 60.5 years among men and 55.5 years among women.
  • Continuous service for more than a year before applying for a pension.
  • A civil servant is dismissed for one of the following reasons: deteriorating health;
  • staff reduction;
  • company reorganization;
  • reaching retirement age. The full list of grounds is specified in Article 7 of Federal Law-166 dated December 15, 2021.

Procedure and conditions for assigning pensions to civil servants

At the same time, the amount of an employee’s pension directly depends on the earnings previously received. So, in particular, in pursuance of the norms of Part 1 of Article 14 of Federal Law No. 166, the amount of long-service benefits is equal to 45% of the previous average payment based on 15 years of experience. If there is employment of a longer duration, another 3% is added for each additional year worked, but not more than 75% in total, which in principle equals 25 years of service for the benefit of the Russian Federation.

The funded part of the pension is formed regardless of the wishes of the employee if he was born before 1967.

Younger workers have the choice to have this part of their pension formed only in the form of voluntary contributions. Such savings are a kind of contribution, since this money can even be bequeathed to heirs.

Civil servants

Civil servants are another category of citizens entitled to additional benefits and discounts. A certain increase in pension is also paid. Its size depends on the period of employment.

If a person worked for at least 15 years as a civil servant before retiring, the increase will be 45% of his salary.

Pensioners who were former government employees also have the opportunity to enjoy some benefits:

Old age pension for civil servants in 2021

According to the 2021 changes, an increased retirement age is provided for government employees. Along with this, fixed payments and a gradual increase in payments from the state budget in the amount of 4% each year are prescribed.

The State Duma is considering a bill to increase the retirement age for employees employed in the Investigative Committee of the Russian Federation and the Prosecutor's Office, when establishing the right to a pension. In 2018, wages for this category of government employees did not increase. In connection with this, on January 1, 2021, a decision was made to increase monetary allowances by 4% in the current period and in 2021. In 2021, pension benefits for employees of the prosecutor's office are expected to increase by 12%. The initiative was supported by employees of higher authorities.

The main factor is engaging in a certain type of professional activity. Employees entitled to long-service pensions include citizens employed in federal and regional authorities. Their earnings are financed from the central or regional state budget. The employer under contracts with such persons is the Russian Federation or a subject of the Russian Federation in the form of a specific government body. The law defines the specifics of setting salaries, bonuses and other additional payments for this category of employees. Also, Law No. 58 and a number of other normative acts define the procedure for assigning state support and the procedure for the retirement of such persons.

Each region of the Russian Federation has the right to independently establish a list of benefits when assigning pensions to civil servants. These include:

  • supplement to pension payments to civil servants;
  • preservation of state guarantees;
  • free medical care;
  • providing vouchers to a health facility or monetizing those vouchers that were not used.

For example, the legislative act of Nizhny Novgorod dated June 24, 2003 number 48 defines a pension supplement for complete loss of ability to work. Samara Legislative Act No. 19 of March 13, 2001 established a monthly supplement equal to 45-75 percent of the pension.

The procedure for calculating payments directly depends on the period of time worked and the type of work activity. Retirement benefits may be calculated based on:

  • length of service - special labor experience in a municipal or state body in a certain position;
  • paid insurance premiums for the period of work at non-state facilities. Payments in this case are transferred from the Pension Fund treasury.

Important! Longevity benefits are awarded subject to the completion of a minimum length of service and achievement of the appropriate retirement age.

Deductions for special experience are made from the federal, regional or local budget.

One-time payments upon retirement to municipal employees

Also a necessary condition for assigning this type of payment is the establishment of old-age insurance.

    Conditions for assigning length of service payments to civil servants

    To receive a service pension, a civil servant must fulfill the following list of conditions:

    1. 15 years of experience, half of this period must be carried out directly in a government agency. From 2021, the length of service will increase until it reaches 20 years. Every year the figures increase by six months. So, the minimum length of service in 2021 is 15.5 years, in 2021 – 16 years, and so on.

    The length of service includes periods in accordance with Federal Law No. 400, which was signed at the end of 2013.

    1. The retirement age in 2021 must be at least 55.5 and 60.5 years for female and male employees.
