Legislative framework for social security

The legislation of the Azerbaijan Republic on social services includes the Constitution, this Law, international treaties, and other legal acts of the Azerbaijan Republic.

The Azerbaijani Law “On Individual Accounts in the State Social Insurance System” was approved by the President on November 27, 2001. This law granted powers to the State Social Protection Fund to carry out individual registration in the state social insurance system/

Based on Article 35 of the Constitution of the Azerbaijan Republic, everyone has the right to freely choose, based on their ability to work, the type of activity, profession, occupation and place of work.

The Law of the Azerbaijan Republic “On Pension Provision of Citizens” does not apply to pensioners deprived of liberty.

Money has been allocated for the first pensions and benefits with an allowance in 2021

The state guarantees material support for all its elderly citizens. If they do not have a job, people can apply for social benefits issued based on age. Currently, women from 62 years of age and men from 67 years of age receive it.

At the same time, a package of proposals was sent to the Milli Majlis to lower the age limit for social benefits, equating it to the retirement age of 65 years. The bill was recently approved by parliamentarians in the second reading.

In 2021, Russia carried out a pension reform: then the retirement age was raised by 5 years (60 for women, 65 for men). But due to criticism of the reform, a transition period was established with a gradual increase in the retirement age. So, in 2021, women could retire at 55.5 years, and men at 60.5.

Here's who can retire in 2021:

  • Women who turned 55 in the first half of 2021 . They will retire in the second half of 2021, when they will be 56 years and 6 months old.
  • Men who turned 60 years old in the first half of 2021. They will become eligible for an old-age pension at 61 years and 6 months, that is, also in the second half of 2021.
  • Women and men in the civil service who turned 55 and 60 years old in the second half of 2021 . They will receive the right to a pension no earlier than the first half of 2021 - at the ages of 56.5 and 61.5 years, respectively.
  • In the first half of 2022, it will also be possible to retire at 56.5 and 61.5 years.

The pension cannot be less than the cost of living in the region. In Karelia it is 12,249 rubles. If your earned pension is less, then you are entitled to a social supplement, which is calculated without taking into account annual indexation. But only non-working pensioners or those registered as self-employed are entitled to such an increase.

In 2021, mothers of many children will be able to use their right to early retirement for the first time on new grounds. This will affect mothers who have four children. In the second half of 2021, mothers of four children can retire at 56 years old - six months earlier than others. Mothers of three children will be able to use the benefit no earlier than 2023.

No experience or points? You can count on a social pension. It is equal to the fixed part of the insurance pension with an increase in the form of a social supplement. But the right to such a pension arises 5 years later than usual. Since the transition period continues in 2021, women aged 61 years and 6 months and men aged 66 years and 6 months can count on it.

For the most part, pensioners' pensions increased by 1,000 rubles. Some citizens were paid the least - 503 rubles each.

Note: the January indexation has passed, and some categories of pensioners will receive a little more than 30,000 rubles. However, for many this figure will not exceed 10,000 rubles.

The authorities indexed pensions by 6.3% in 2021.

Referring to international experience, the ministry decided to stimulate the competitiveness of the population in the labor market. To put it simply, the country raised the retirement age from 61-63 to 65 years. Over the next years, the retirement age will increase in Azerbaijan gradually, adding six months each year until it reaches 65 years.

Currently, the retirement age for women is 61.5 years, and for men - 64.5 years.

At the same time, several categories of citizens are identified who can qualify for a pension much earlier. For example, these are heroine mothers (if they have five or more children), women raising disabled children, as well as people with disabilities.

Government regulation

Under the leadership of the country's State Social Protection Fund, social security programs are drawn up, and the Ministry of Labor and Social Protection of the Population implements social insurance programs.

Changes in the social protection system began with the implementation of the “Concept of pension reform in the Republic of Azerbaijan”, approved by the Decree of the President of the Azerbaijan Republic dated July 17, 2001.

On June 8, 2010, the Military Doctrine was adopted, the main goal of which was to develop the social protection system and improve the living conditions of military personnel.

The regulation on the criteria for determining disability and health status was approved by the Resolution of the Cabinet of Ministers of Azerbaijan dated December 30, 2015.

The Cabinet of Ministers made a number of amendments to the “Rules for filing an application for targeted state social assistance, its appointment, issuance and refusal to issue” by decision of 02/11/2016.

On January 9, 2013, the President of Azerbaijan signed the Order “On additional measures to provide social services to disabled children and persons in a dangerous social situation who have not reached adolescence.” In 2013, the Ministry of Labor and Social Protection of the Population approved 17 priority projects. During the implementation of projects in 2013, 800 children under the age of 18 received social, psychological, legal and reintegration services.

On February 1, 2007, the President of the Republic of Azerbaijan, Ilham Aliyev, signed a Decree “On additional measures to improve social protection of the population,” according to which the amount of social benefits was increased by 25%. Over the past few years, this amount has increased 2.6 times. With the adoption of the Law “On Benefits”, the use of indexation of social benefits at least once a year began.

In the spring of 2006, a program for targeted social protection was launched, within the framework of which about 50 thousand families were provided with financial assistance. Next year, 68 million manats were allocated. The amount of financial assistance to low-income families has also been increased.

The Social Security Department was created on the basis of Decree of the President of the Republic of Azerbaijan No. 462 dated September 27, 2006.

The “Action Plan of the Ministry of Labor and Social Protection of the Population of the Republic of Azerbaijan for 2014” was prepared and implemented to ensure the implementation of the “State Program for Deinstitutionalization and Alternative Assistance in the Republic.

In the summer of 2014, an agreement on cooperation in the field of pensions was concluded between the Government of the Republic of Belarus and the Government of the Azerbaijan Republic. It was determined to cooperate with the Ministry of Labor and Social Protection of the Republic of Belarus. The agreement covered all types of pensions.

Medical social examination and rehabilitation subsystem (TSERAS) was created in the centralized information system of the Ministry of Labor and Social Protection of the Population by Presidential Decree of September 14, 2015 “On improving the system for assessing disability limitations and opportunities in the field of health care.”

The Twinning project “Development of Social Services”, organized by the Ministry of Labor and Social Protection of the Population with financial support from the European Union, was carried out from June 1, 2015 to May 31, 2021.

In March 2021, President Ilham Aliyev signed a decree establishing a Commission for the Regulation and Coordination of Labor Relations in connection with the application of the Decree “On the approval of “Strategic road maps of the national economy and main sectors of the economy.”

One of the provisions of the Development Concept “Azerbaijan 2021: Looking into the Future” is:

  • development of human potential and creation of an effective social protection system,
  • improvement of the social protection system
  • By order of the President of the Republic of Azerbaijan, a need criterion was approved in the country to determine the amount of targeted social assistance for 2021. The growth rate of average monthly wages in 2021 was studied and an algorithm for increasing pensions from the beginning of 2021 was developed.

In Belarus, there is a more or less standard option for calculating pensions - they depend on length of service and average salary. In order to receive a full monthly payment, you need to work for at least 25 and 20 years for men and women.

The amount of payments will be about 55 percent of the average monthly income for a career.

The retirement age in the country has been gradually increasing since 2017, and this process will end by 2022. Men will retire at 63 (now 61), women at 58 (now 56).

The average pension for the CIS countries is quite decent - as of September 2021 it was 446.8 rubles, or 13,807 Russian rubles.

Kazakhstan has a rather complex system for calculating pensions. As in Russia, its size consists of several factors, the main ones being length of service and income. Taking them into account, the state can assign one or more types of pensions to its citizens: basic, labor or funded.

Those who were granted a pension before 1998 had to be content with the basic option, with allowances, of course. For the rest, labor and funded pensions have been calculated since then. The main part of payments for ordinary workers is labor; it can be received by those who have worked for 25 or 20 years (for men and women, respectively) and have reached the ages of 63 and 59 years, respectively. Moreover, in 2021 the country raised the retirement age for women; now it is gradually increasing in increments of six months per year and in 2027 it will reach the same 63 years as for men.

The size of a person’s income also makes a significant contribution. The bonus for it is calculated based on the three most “highly paid” years of experience; the final amount of the pension cannot exceed 75 percent of the average monthly income.

As for the average pension, in the country as of June 2019 it was 85,785 tenge, or 14,215 rubles.

In Kyrgyzstan, 63-year-old men or 58-year-old women who have worked for 25 and 20 years, respectively, can retire. The calculation system is as follows: a very small base part, its size depends on the length of service, plus insurance - it is already formed based on the amount of deductions from the salary.

The national average is low - only 5,820 soms, or 5,280 rubles.

In Tajikistan, the situation with pensions is the most difficult in the former CIS. Local pensioners are the poorest. The country itself, of course, is also not rich - it is at the bottom of the list in terms of GDP, but the situation with pensions is terrible. The average pension at the beginning of November 2021 is 303 somoni, which is 1978 rubles per month. The maximum since September 2018 is 850 somoni (5523 rubles). That is, not a single pensioner in the country receives more than this amount.

The age for calculating the labor pension in the country is 63 and 58 years for men and women, respectively, the minimum length of service is 20 and 15 years. This one is pretty simple. The only thing that is unclear is the calculation of the final monthly payment. The law only says that “the pension capital will be calculated through an automated program” and then divided by the survival age - 180 months, or 15 years. It seems that the Tajiks themselves do not understand exactly how the computer calculates this “pension capital”. In addition, men in the country live 74–76 years, that is, several years less than expected. Thus, they simply cannot receive part of the money.

In Moldova, as in most other CIS countries, there is a gradual increase in the retirement age. Men have already reached it - 63 years, women will reach it by 2028. Moreover, the insurance period required for a full pension is the strictest in the CIS - both men and women will have to work at least 34 years after 2024 in order to receive a decent pension.

The formula is as follows: the total length of service is multiplied by the cumulative coefficient (1.35 percent) and multiplied by the monthly average income. Such mathematics allows the population to receive on average 1895 lei, or 6.7 thousand rubles.

Social Protection Fund

The history of the formation of the State Social Protection Fund of the Republic of Azerbaijan is directly related to the dynamics of fundamental changes in economic relations, as well as social insurance and pensions in the country.

In Azerbaijan during the USSR period, issues of social insurance and pensions were structured according to the principles of the independent pension system “insurance without paying contributions”.

The necessary financial resources were taken only from the state budget or from payments from enterprises.

In 1990, the State Social Insurance Fund of the USSR was created, and regardless of their subordination, it was decided to transfer contributions to the account of this fund by all organizations, departments, cooperatives, state farms, collective farms, and other organizations. Then, in 1991, the State Social Insurance Fund of the Azerbaijan SSR was created under the Council of Trade Unions of the Azerbaijan Republic.

After the announcement of the Constitutional Act on the restoration of State Independence of the Azerbaijani people, by decree of the President of the Azerbaijan Republic dated December 16, 1991, the Azerbaijan branch of the USSR Pension Fund was transformed into the Pension Fund of the Azerbaijan Republic.

Since June 1, 1992, the law of the Azerbaijan Republic established social insurance contributions in the amount of 40% of the wage fund. 85% of this amount was transferred to the Pension Fund, and 15% to the Social Insurance Fund. In order to improve management in the field of financing social insurance and pensions, the State Social Protection Fund of the Azerbaijan Republic (SSPF) was created by the Decree of the President of the Azerbaijan Republic dated September 30, 1992, on the basis of the Pension Fund and the Social Insurance Fund.

The State Social Protection Fund of the Republic of Azerbaijan is the central executive body that carries out management in the field of compulsory State social insurance and labor pension provision.

Types of state pensions

a) labor (social insurance) pensions:

  • by age (old age),
  • on disability,
  • on the occasion of the loss of a breadwinner,
  • for long service

b) social pensions.

Social benefits consist of monthly (age pension, pension for the disabled, for children under 18 years of age with disabilities) or lump sum payments (for parents of newborn children able to work, for funerals, support for treatment of victims of radiation, accidents (annually)) in order to social assistance to persons with different categories.

In 2012, a total of 1,277,596 people received a labor pension.

Increasing the retirement age in Azerbaijan to 65 years

Our government is wondering if it has ever lived on 105 manats at current prices for utilities and food prices??? That we have some kind of benefits for those who are unemployed, benefits like this is done in civilized countries, food cards??? I’ve been unemployed for 16 years. I’ve been looking for work for 16 years, I’ve been spinning around and surviving as best I can. I’ll turn 60 this year. I want to ask those who make these laws, are you going to bring your pension to the cemetery? How long is this a mockery? I don’t know a second state will continue to be over us, where pension laws have been changed three times in 6 years. When will those who make laws come down to the population and find out how those who can’t wait for their pension to at least be able to pay for utilities, not to mention food, live?? I would like to propose that all those who signed the retirement contract should live without work for 16 years and use the pension they received as a basic + funded pension for at least 1 month. In our country there is no way that the average retirement age would be 72. Ridiculous. People of my generation and older do not live to see 66. I want to ask how to survive for those who are alone, at my age, have no job, no husband, no help? What do you offer us? Replenish the army of beggars and stand with outstretched hand on the porch??? How many years should I wait for retirement, having a bunch of age-related diseases (hypertension, osteoarthritis, chronic bronchitis), without any support? Answer me how can I live and how can someone like me live??? And I’m not even talking about the minimum wage. Are you kidding me??? Go to the market and buy a set of groceries for one person for a month + pay for electricity, gas, water, rent, telephone, television, Internet. Do the math, and then withdraw your pension and minimum wage. Don't make fun of or disgrace your people and state. These are the deputies who receive exorbitant salaries from taxpayers and they don’t care what laws they are considering or the whole people in general. How long will deputies receive exorbitant salaries, pursue their own interests, for which they got into the Majlis, and do not care about the interests of their own people? Do we have jobs for those who are over 35 or pensioners who live up to 80 years old??? Stop mocking people!!!!! We are the only state that has increased the retirement age three times for such a short period of time and is not going to stop there. Then let them give pensions and benefits to those over 55 and benefits so that we can pay for utilities, and I’m not even talking about food. This is what they do in all civilized countries. In Russia, women retire at the age of 55, as in Soviet times, and this law will not change until 2024. When they change the law on the retirement age, you should not sleep at meetings, but read and analyze how and what these potential pensioners will live on?

Conditions for receiving a pension in Azerbaijan

Today there are about 1.3 million pensioners in Azerbaijan, the lion's share of whom, 58.5%, are recipients of old-age pensions, while the remaining types of pensions are intended for the disabled and people who have lost their breadwinner or head of family.

Under what conditions does the right to an old-age pension arise:

  • When women reach 61 years of age and men 64 years of age, this age minimum is valid from 2021.
  • Availability of pension capital or a minimum work experience of 25 years. Pension capital consists of those insurance contributions made by the employer or the employee himself. If the accumulated funds do not provide the minimum pension established by law, then calculations will be based on income during working life.

The size of pensions in Azerbaijan for 2021 has been clarified
