Even if he previously retrained as an entrepreneur or went to work as a civilian, the benefits remain. What is an insurance pension and which former military personnel is entitled to it in old age? What it is?

Payments are calculated based on actual length of service and the volume of insurance , which was paid monthly to the Pension Fund. The main condition is to take into account contributions during official employment. The final amount is influenced by wages.

After the occurrence of an insured event (a man has crossed the age mark of 60 years, and a woman has crossed the age mark of 55), a citizen can count on government payments every month.

Attention ! The conditions and procedure for registering pension contributions are prescribed in Federal Law of the Russian Federation No. 4468-1 (effective from 02/12/1993). On the basis of this act, payments to persons employed in the military sphere are regulated.

Until the age of 60, a former military man has the opportunity to earn the minimum length of service to receive a second pension. But it is difficult to get the minimum established by the state in a short period of time due to low salaries, and it is problematic for a citizen without specialized experience to count on big earnings.

Conditions for additional payment to pensioners for civil service

A serviceman who continues to work after dismissal in a civilian occupation has legal rights to pensions from both the law enforcement agencies and the Pension Fund of the Russian Federation. This right is enshrined in Federal Law No. 136. According to this law, to receive the second additional payment for civil service, a pensioner needs :

  1. Reaching retirement age: men - 60, women - 55. In the case of work in the far north and in areas equivalent to it, Federal Law No. 400 is applied, which describes special working conditions. According to it, retirement age may come earlier.
  2. The insurance period (the period of full payment of contributions to the Pension Fund from wages) outside the law enforcement department must be at least 8 years.

Article 5 of Law N4468-1 states that persons with work experience in military departments apply for long-service benefits from the Ministry of Defense. The payment includes monthly accruals for former military personnel who continue to work after retiring.

Private entrepreneurs, employees of companies and departmental structures receive civil pensions only if they meet a number of requirements:

  • suitable age;
  • experience;
  • sum of personal points;
  • the amount of payments received.

How and when can a military pensioner apply for a civil pension?

Subject to receiving appropriate payments for length of service, a working military pensioner has the right to receive a civil pension.

To do this, the following conditions must be met:

  1. has reached the generally accepted retirement age (before the start of the pension reform, it was 60 years for men and 55 for women, but a gradual increase is envisaged).
  2. You must have a minimum insurance experience in a civilian specialty. Until 2021, it was 6 years, but it is expected to increase by 1 year annually. Thus, in 2021 it is already 10 years old.

How is a civil pension calculated for a military man?

It is calculated from three components:

  • insurance payment;
  • storage part;
  • fixed payment.

The amount of the fixed payment does not depend at all on how long the citizen has worked. The assignment of an insurance component to a military pensioner differs in its specific features. It is calculated using the following formula:

The legislation provides that a military pensioner who receives the appropriate funds has the right to receive a second, civilian pension if the conditions mentioned earlier in this article are met.

The payment is subject to accrual if a citizen works officially at any state enterprise for at least 5 years . You can get it after turning 60 years old.

In addition to the long service pension, which is due to all military personnel who have served a sufficient period of time, military pensioners are also entitled to an insurance pension. The so-called second pension underwent another indexation at the very beginning of 2021.

It should be borne in mind that the second pension is not intended for all military pensioners as a whole, but only for those who meet the requirements of this program. These requirements include the following:

  • upon completion of service, a military pensioner must again get a “civilian” job;
  • employment must be official;
  • the employer is obliged to make contributions to the Pension Fund, from which the second pension will be formed in the future;
  • the employee must register in the Mandatory Pension Insurance system, after which he will be assigned his own account in which funds will accumulate.

In addition to the basic requirements, there are also secondary ones that must also be taken into account by military personnel applying for a second pension. Among these conditions are:

  • reaching retirement age. To be eligible for a pension, women must reach fifty-five years of age, and men must reach sixty years of age . Some circumstances provide for early retirement (work in dangerous conditions, presence of disabled children in the family, and so on);
  • having a minimum insurance period. The negative point is that this length of service does not include military service. Accordingly, in order to be eligible for a second pension, a military man must work for at least ten more years in civilian conditions. After some time, this experience will increase by another five years;
  • minimum number of IPCs. The number of IPCs directly depends on the time of retirement. For example, for citizens who became pensioners in 2021, it does not exceed 16 points. However, in five years this figure will almost double and reach 30 points, according to forecasts.

Military personnel applying for a second pension in the near future should take into account several nuances:

  • the second pension for military pensioners does not have fixed minimum values ​​and is calculated individually without upper or lower limits;
  • in order to start receiving a second pension, the military man will need to provide the documents that ordinary citizens provide when applying for a standard pension;
  • In addition to the second pension, a military man can also receive financial support from the military department due to disability or length of service.

Registration procedure

The procedure for processing this type of payment is not accompanied by significant difficulties. In order to apply for a second pension, a military pensioner will need to take the following actions:

  • come to the nearest Pension Fund branch;
  • provide the Pension Fund employees with the required package of documents;
  • receive a pension certificate.

The documents that a pensioner will need when applying for a pension are as follows:

  • an identity document (most often a passport of a citizen of the Russian Federation);
  • SNILS;
  • certificate confirming receipt of a military pension;
  • labor record (original, if the pensioner has already finished working);
  • documents confirming the fact of having experience, which is not reflected in the work book for one reason or another);
  • salary certificate for the last 5 years;
  • information about dependents.

After 60 years

According to the current regulations “On Labor Pensions in the Russian Federation,” military personnel who go on vacation partially receive a labor pension. The required age to start accruals is 60 years .

What are the accrual conditions?

From the current amount, the amount is calculated according to the updated schemes. To qualify for such a payment, you must meet a number of conditions (articles - Federal Law N173).

  1. Age . Workers in the North or enterprises where working conditions pose a danger to life will be able to apply for payments up to 60 years of age.
  2. Minimum work experience (for the current year, this is 6 years of civilian work). The length of service in military departments is not taken into account.
  3. Minimum personal scores . Since the previous year, the required amount has been gradually increasing. For 2021, the coefficient was 6.6, and by 2026 it will increase to 30.
  4. Received service pension (or availability of disability assistance).
    Its size depends on the former position, length of service, and rank. The average pension value for 2021 is up to 20 thousand rubles. The amount of disability assistance depends on the group (from 5 to 20 thousand rubles). By 2023, the minimum experience outside the military departments will be at least 15 years.

The main option for pension provision for military personnel is a long-service pension, which is assigned to those military personnel who served for at least twenty years before dismissal. In addition to this requirement, this pension also includes other features. For example, a serviceman will be able to start receiving payments only after he resigns. If, after twenty years of service, he does not leave his post, then his payments will be denied.

The option described above is also called the first category. However, there is also a second category that has slightly different conditions. A military man can apply for it if he meets two main requirements:

  • at the time of retirement, the serviceman must be at least forty-five years old;
  • The serviceman's work experience is at least twenty-five years. In this case, half of the specified period should be allocated to military service.

One of the most important questions concerns what rules are used to calculate length of service and what specific periods are counted. This calculation takes into account the following categories of service:

  • military, as well as service in the police department;
  • in authorities involved in drug control;
  • in criminal executive bodies.

Pension amount

There are no universal pensions - each of them is calculated individually, regardless of whether we are talking about civilians or military ones. If we talk about military personnel, then the amount of future payments is influenced by several indicators:

  • military experience (aka length of service);
  • job title;
  • rank;
  • DD amount;
  • possible conditions for additional payments.

At the same time, there is a simpler rule for approximate calculation of future pension:

  • with twenty years of service, military personnel will receive a pension equal to half of the previous DD;
  • for each additional year of service after twenty years, the soldier will receive three percent of the DD, until the pension is 85%.

Allowance refers to the “salary” of a military personnel, if expressed in civilian terms. The military’s “salary” consists of the following components:

  • military official salary;
  • salary, the amount of which is determined by rank;
  • bonus for length of service (in monthly or percentage format).

Reference. At the moment, reliable information is known that the size of the DD will be increased by four percent from the fall of 2021.

How are payments made?

Since the Pension Fund does not take part in the calculation and payment of long-service pensions, the procedure for receiving these payments differs from the procedure that exists for civil pensioners. Receiving a military pension presupposes several conditions:

  • Payment of pensions occurs through the mediation of the Savings Bank of Russia. The funds due to the pensioner are transferred to a personal account or by mail;
  • receiving payments is possible both personally and with the assistance of an intermediary (if the mediation is documented);
  • a retiree is entitled to a military pension regardless of whether he continued to work in a civilian setting or not. Any other sources of income also do not lead to the termination of payments;
  • if a pensioner, for subjective reasons, was unable to withdraw his pension on time, he has three years left to receive the rest of the payments.

How to apply?

This type of payment has a declarative nature of accrual (no application - no payments). This document with the requirement to accrue payments must be submitted no earlier than 30 days before the date of entitlement.

You can write an application to the Pension Fund (PF) using several options:

  • personal appeal;
  • submitting an application through the online account (using the Internet);
  • transfer through the employer;
  • sending an application by mail;
  • writing an application to the MFC (multifunctional center).

What to take from the documents? The list requires proof of identity (passport or alternative), a certificate from the military department on the purpose of payments. You also need to provide a work book or notarized copies from the direct employer (this is evidence of real work experience obtained in civilian life).

Another aspect for calculating a civil pension is the presence of a personal account and an open account in the pensioners’ insurance system (SNILS). It contains up-to-date information about the length of service received, the amount of insurance, the total period of work outside the law enforcement agencies.

How to open an account? You need to contact the Pension Fund. There you will have to enter current information about yourself in the applicant’s application form and show your passport.

Registration process

In the standard case, the rules for calculating benefits vary depending on the employee’s status, working conditions, place of residence and other factors. However, regional and special coefficients affect mainly the fixed part of the payment, which is not accrued to employees of the Ministry of Internal Affairs.

  1. Prepare data on work experience.
  2. Submit an application and papers to the Pension Fund through the district office of the Fund or the MFC. You can submit documents both at your place of permanent registration and at your place of residence.
  3. You can send an application through your Personal Account on the website of the Pension Fund of Russia, a representative or the Russian Post. Documents are sent by registered mail. The date on which the application is submitted is considered to be the date on the stamp. To transfer papers through another person, a power of attorney is issued to him.
  4. Wait for a response from the Pension Fund. The application review period is 10 days. If the package of documents is incomplete, the citizen must be notified within 3 days.

Increasing the length of service in the Ministry of Internal Affairs may cause an extremely dangerous chain reaction within the department. Payments

For a former military man, such a pension includes personal contributions for the period of work outside the army. For example, for an ordinary citizen, the payment amount includes a guaranteed payment (4800 rubles) and savings from monthly contributions.

The civil pension is subject to annual indexation. If a citizen continues to work after turning 60, from August 1 the amount received is subject to recalculation based on insurance contributions and the level of personal score for the past year.

If a former military man has cumulative personal points and he goes to open his first account in the Pension Fund, the opportunity is open to choose various accruals (one-time, regular).

The formula for calculating the insurance part of pensions for retired Russian army employees has been truncated when compared with the formula for calculating payments to civilians. Individual pension points are multiplied by their current price. The product will indicate the size of the insurance part of the pension for a former military man.

For retired military personnel who are not working, the 2nd pension was indexed in January 2021. Payments have increased due to changes in the price of pension points; now it is 87.24 rubles.

The amount of insurance payments for employed former military personnel has not changed. However, it is planned to increase it slightly at the end of summer. The increase is planned to be carried out by increasing the price of pension points that were earned in 2021.

A significant increase in pensions is planned in mid-autumn 2019, when the state recalculates the pension provision for long service. Military pensions will increase by 6.3 percent due to an increase in pay by 4.3 percent and two percent indexation.

A former military man has the right to apply for an insurance pension. However, its size will be smaller than for civilians. This is due to the fact that military pensioners already receive a good basic pension; the state cannot afford to allocate additional funds for their maintenance, especially with the current pension reform.

How is it calculated?

Federal Law No. 156, in force since 2008, “On Amendments to Certain Parts of Legislation on Pension Issues,” eliminates the limitation of guarantees for those who continue to work after receiving monthly payments. Previously, the category of former military personnel could not count on civilian payments.

With mixed service, the second pension is calculated using the formula:

  • B – the amount of monthly payments;
  • D – subsistence level of the region;
  • T – length of service;
  • P – reduction coefficient (for 2021 72.23%).

The formula is taken from Article 14 of the Federal Law “On Labor Pensions”.

When will it be cancelled?

Similar ideas were submitted for government discussion back in 2015. The goal is to save money from local budgets.

To launch the mechanism, it was proposed to cancel pensions for citizens whose income exceeds 1 million per year, freeze payments to working pensioners, and eliminate fixed payments.

But in the end, the abolition of second pensions for military pensioners was not officially adopted. There is no exact deadline for freezing payments for this category of the population .

What is a mixed pension

Mixed is a military and civil pension. A former military man has the right to receive both parts in accordance with Federal Law No. 400 “On Insurance Pension”. There are two main conditions:

  1. A citizen must officially find a job, register an individual entrepreneur, a legal entity.
  2. A military pensioner is listed in the OPS system: he has an individual insurance number and a confirmation certificate (SNILS). You can obtain the document at the branches of the Pension Fund of Russia, the MFC or the human resources department of your employer.

Subject to these conditions, the assignment of insurance pension benefits to former military pensioners is practically no different from a similar procedure for ordinary citizens. The mixed pension (military and civilian) is delivered to the recipient in the way he chooses: to a bank card, current account, or through the postman.

The insurance part, like for ordinary citizens, is subject to annual indexation - increased by a certain percentage. To establish this coefficient, the PMP (living wage for pensioners) for the past year is analyzed.

An insurance pension for military pensioners is assigned under the following conditions:

  1. Reaching retirement age. This figure is currently gradually increasing to reach 70 years for men and 65 for women in 2023. In 2021, women can receive an insurance pension from 60.5 years, men - from 65.5.
  2. Having a minimum civil experience. In 2019 this is 10 years. In the future, the indicator will increase annually by one unit, until the final mark of 15 years is reached in 2024.
  3. A sufficient number of accumulated pension points. This is not a fixed number. Every year it increases. For 2019, the minimum required number is 16.2 points. By 2025, the figure will increase to the final indicator of 30 points.

Standard requirements for length of service and age may be reduced when working in dangerous, harmful, difficult conditions - early receipt of the insurance portion of payments is possible. But provided that the citizen managed to accumulate the required number of points.

Early retirement is also available for those former military personnel who suffered from harmful man-made (radiation) exposure. Or became disabled due to injuries received during service.

Is it possible to receive two pensions (military and civil)? Yes, but with the following conditions:

  1. There is no fixed payment. For civilians today it is 5,334 rubles (monthly social benefit for people of retirement age who have not earned points in the compensatory pension system). That is, the insurance part of a former military man’s security depends only on the length of service and the size of his employer’s contributions to the Pension Fund.
  2. From the total working experience of a citizen, those periods of labor activity that have already been counted when establishing long-service coverage will be excluded.
